No. C9-1S8 Date of Adoption July 9, '2J.J:fJ RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, AUTHORIZING THE SALE OF BOROUGH OWNED PROPERTY .WHEREAS, the Borough of Carteret (the "Borough") is the owner of properties located at Block 251, Lot 2 (68 Unioo Street) and Block 252, Lot 1 (68 Essex Street) in the Borough; and WHEREAS, NJ.S.A: 40A: 12.2 1 provides, in pertinent part, that when a governing body of a municipality determines that all or part of a tract of land (with or without improvements) owned by the municipality is not needed for municipal purposes, said governing body may authorize a private sale and conveyance of such property for a consideration , which may be nominal, and containing a limitation that such property shall be used only for the purposes of the organization to which the property is conveyed; and WHEREAS, N.J.S.A: 40a:12.21 (1) provides, in pertinent part, that a municipality may convey property to a duly incorporated nonprofit housing corporation for the purpose of constructing housing for low or moderate income persons or families, or handicapped persons: and WHEREAS, the Borough intends to convey the properties known as Block 251, Lot 2 (68 Union Street) and Block 252, Lot 1 (68 Essex Street) in the Borough of Carteret Housing and Development corporation ("CRADCO"), a New Jersey Non-Profit Corporation, to build housing for low or moderate income persons or families. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough ofCarteret, in the County of Middlesex, State of New Jersey, as follows: 1. The aforementioned recitals are incorporated herein as though fully set forth allength. 2. The properties known as Block 251, Lot 2 (68 Union Street and Block 252, Lot 1 (68 Essex Street) in the Borough are no longer needed for municipal purposes. 3. The properties known as Block 251, Lot 2 (68 Union Street) and Block 252, Lot 1 (68 Essex Street) in the Borough may be conveyed to CRADCO for a nominal consideration, which may be deteanined by the Mayor in his discretion, and such conveyances may be subject to such other low or moderate income persons or families, and such conveyances may be subject to such. other restrictions as the Mayor may deem appropriate, in his discretion. 4. This Resolution shall take effect immediately. 5. Upon final adoption hereof, the Borough Clerk shall forward a certified copy of this Resolution to McManimon & Scotland, L.L.C., attn: Kevin P.
