Mayor Merritt called the regular meeting of the City Council to order at 7:31 p.m. on Tuesday, May 19, 1981, in the Council Chamber of the City Hall. 2. The invocation was given by Dr, Marshall Ketchum, First United Methodist. Church, 5957 N. Golden West Avenue.. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Merritt Absent: Councilmen - Tyrell Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Associate Planner Chris Peterson, and Julie Estrada, Temple City Times Councilman Gillanders moved to excuse Councilman Tyrell for cause, seconded by Councilman Atkins and carried. 5. CONSENT CALENDAR: Councilman Atkins directed Councils attention to Exhibit A of staff memo relating to the proposed change in the zoning ordinance, stating it applies to mobile homes, modular homes, relocatable homes, and on page 2 to all single family residential construction, and Council members should bear that in mind when considering the Planning Commission recommendation. On motion by Councilman Atkins, seconded by Councilman Gillanders, Items A through E on the Consent Calendar were approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of May 5, 1981 Approved as written. B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of May 12, 1981 (1) PROPERTY NUISANCE CASE NO. 81 -64, 5802 Alessandro Avenue Adopted Resolution No. 81 -1986 ordering abatement of property nuisance at subject location within 30 days. (2) PROPOSED ORDINANCE AMENDMENT. RE: MODULAR HOMES IN RESIDENTIAL AREAS Set public hearing for June 2, 1981 to consider Planning Commission resolution recommending a zoning ordinance amend- ment regarding inclusion of modular homes in residential areas. (3) Received and filed memo relating to action taken by the Planning Commission at their regular meeting held on May 12, 1981. Council.Minutes, May 19, 1981 Page 2 C. AWARD BID: RESURFACING OF LONGDEN AVENUE /OLIVE STREET Accepted the low bid from Vernon Paving Company in the amount of $48,003.20 and authorized the Mayor and City Clerk to sign. D. SUMMER YOUTH EMPLOYMENT PROGRAM Authorized staff to implement the Summer Youth Employment Program as outlined.in staff memo dated May 7, 2982; appropriated additional funds in the amount of $400:00, and amended the adopted budget accordingly. E. RESOLUTION NO. 81 -1987: WARRANTS AND DEMANDS Adopted Resolution No. 81 -1987 A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $119,374.51, DEMAND NOS. 1887 THRU 1983. 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: 7:30 p.m. ANNEXATION NO 1 (ANNEXATION AREA 80 -7.) TO THE CITY -WIDE LIGHTING DISTRICT City Manager Koski presented background information, stating the proposed annexation to the City -wide Lighting District is to include the recently annexed area into the City boundaries since the City will be responsible for the maintenance of the street light system within that area. City Council, at their regular meeting held April 21, 1981, adopted Resolution No 81 -1981 declaring its intent and set public hearing for May 19 to hear protests. Public hearing was noticed in the Temple City Times and posted at 300 foot intervals in the area to be annexed.. Mayor Merritt declared the public hearing open and invited anyone wishing to speak to come forward. There being no one come forward to speak, Councilman Gillanders moved to close the public hearing, seconded by Councilman Atkins and carried. Councilman Atkins moved to adopt Resolution No. 81 -1988 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING ANNEXATION NO 1 TO THE CITY -WIDE LIGHTING DISTRICT, seconded by Councilman Gillanders and carried. Councilman Gillanders moved to adopt Resolution No. 81 -1989 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY WITH- DRAWING ALL TERRITORY LYING WITHIN THE CITY OF TEMPLE CITY FROM THE LONGDEN LIGHTING DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 19290 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, seconded by Councilman Atkins and carried. 7. NEW BUSINESS: A. PUBLIC HEARING: 7:30 p.m. PROPOSED USE: REVENUE SHARING FUNDS City Manager Koski presented background information, stating the City must, pursuant to federal law, hold a public hearing on the proposed use of revenue sharing funds for citizen input. A second hearing is required in conjunction with the adoption of the annual budget. The amount of general_ revenue funds to be discussed for fiscal year 1981 -82 is $136,000 which is proposed to be used for law enforcement services. Mayor Merritt declared the public hearing open and invited anyone wishing to speak to come forward. There being no one , come forward to speak, Councilman Gillanders moved to continue the 1 1 Council Minutes, May .199 1981 -_Page 3 public hearing to the June 16, 1981 City Council meeting when the-.1981 -82 budget will be considered, seconded by Councilman Atkins and carried. 8. COMMUNICATIONS: A. TEMPLE CITY Y'S MEN'S CLUB - REQUEST APPROVAL OF WAIVER OF THE DEADLINE DATE FOR FIREWORKS BOOTH LICENSE City Manager Koski presented a communication from the Temple City Y's Men's Club requesting approval of a waiver of the deadline to file application for fireworks booth for Temple City Family YMCA and Temple City Y's Men's Club. They had been working to secure new.locations and missed the filing deadline. Bruce Clayton, 720 N. Louise, Arcadia, represented the YMCA in their request stating he felt the letter is self - explanatory. Councilman Atkins stated he has mixed feelings, particularly since learning the fireworks companies do work with the organi -. zations and remind them of the filing dates and a month has gone by since the applications were approved. This seems to be a chronic problem and Council always says they are not going to extend the deadline. Councilman. Dennis stated that his feelings were expressed at the time the deadline was extended for Kare Youth that if the dead- line is extended for one it should be extended for all. He feels Council should either adhere to the March 31 deadline or allow all of them extra time, rather than continuing to extend the time frame one at a time. Councilman Gillanders stated he does not have a problem with the request, however there is not much time for Fire Department in -. vestigation and he feels the late applications are a discourtesy to the Council and staff. City Manager Koski advised these applications would still bring the total to under the number of booths approved last year and the organization has indicated they have all of their paper work done and ready to submit. Mayor Merritt stated that if it would be no problem to the staff he would move to extend the filing deadline for YMCA for 10 days and City Manager authorized to approve, seconded by Councilman Atkins and carried, Councilman Dennis noting his objection. B. L. A. COUNTY FIRE DEPARTMENT - REQUEST FOR USE OF E.O.C. Councilman Gillanders moved to approve the request of the Los Angeles County Fire Department to use the E.O.C. May 26 and 27 for training purposes, seconded by Councilman Atkins and carried. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK; No one came forward. RECESS TO CRA: City Council recessed at 754 p.m. to meet as the Community Redevelopment Agency; approved the minutes of the regular meeting held May 59 1981 and adopted resolution approving warrants and demands. ACTION ON REQUEST BY CRAB There was no action to be taken 110 MATTERS FROM CITY OFFICIALS: A. Councilman Atkins stated the monthly meeting of the San Gabriel Valley Association of Cities will be held May 21 at Brookside Country Club and the program will be related to the Pasadena Helicopter program. 12. ADJOURNMENT°. On motion by Councilman Gillanders, seconded by Councilman Dennis, meeting adjourned at 756 p.m. Next regular meeting of the City Council will be. held Tuesday, June 2, 1981, 7 :30 p.m. in the Council Chamber of the City Hall.
