AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE
PERTAINING TO GRAFFITI.
BE IT ENACTED BYTHE COUNCIL OF THE CITY OF JEFFERSON,MISSOURI,AS FOLLOWS:
Section 1. Chapter 18 (Mist. Offense) Section 75 (Defacement of property by graffiti)
is amended as follows:
Sec. 18-75. Defacement of property by graffiti.
A. For purposes of this section "Graffiti" shall mean any inscription,word fl gure,markin
or design that is written, marked,etched,scratched,drawn or painted on real property that was not
authorized in advance by the owner of the property.
B.-A Any person who writes, sprays,scratches or otherwise affixes graffiti upon any property,public
or private, ' without the consent of the owner such other Versmr shall be

In addition to such penalty the court-may shall sentence the defendant to serve 2 days in jail but may
suspend such sentence only if the court shall order the defendant to pet tot in the necessmy labm to cle...rp,
ay any costs incurred by the owner related to the
cleanup,repair or replacement of property damaged by that person.
C.In a proceeding in municipal court in which the defendant is accused of a violation of section
B evidence if otherwise admissible of the defendant's commission of another offense or offenses
utilizing the same or similar graffiti techniques or characteristics,may be considered for its bearing on
anv matter to which it is relevant.
D.+�- It shall be the duty of the owner and/or occupant of a building,residence or any other structure
or property that has been defaced by graffiti to clean up or otherwise cover such graffiti,however, no person
shall clean up or otherwise cover such graffiti without first notifying the police department and allowing the
police an opportunity to photograph such graffiti. IF,

C. Graffiti is declared a nuisance. In addition to issuance of a summons as provided in Section
B.the Citv Administrator or designee may declare the graffiti to be a nuisance and apply all policies and
procedures set forth in Chapter 21. Notice to abate the nuisance of graffiti shall allow no less than 7 days
from the date of the notice to abate the nuisance.
F. The City and all political subdivisions subject to the City's autbority shall abide by this
section.

Section 2. This Ordinance shall be in full force and effect from and after the date of
its pa ager-aipd approval.
