HomeMy Public PortalAbout12-8465 Appoint Joanna Flores City Clerk Sponsored by: Commissioner Holmes Resolution No. 12-8465 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, TO APPOINT JOANNA FLORES AS CITY CLERK OF THE CITY OF OPA- LOCKA; PROVIDING FOR INCORPORATION OF RECITALS;PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Clerk position of the City of Opa-locka has been vacant for a number of months; and WHEREAS, the City Commission of the City of Opa-locka previously advertised for candidates for the position of City Clerk; and WHEREAS,it is now incumbent upon the City Commission of the City of Opa-locka to appoint a City Clerk for the City of Opa-locka; and WHEREAS,Joanna Flores has been the Interim City Clerk for the past several months;and WHEREAS,Joanna Flores previously served as the Assistant City Clerk; and WHEREAS,the City Commission of the City of Opa-locka desires to appoint Joanna Flores as City Clerk of the City of Opa-locka. NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby appoints Joanna Flores as City Clerk of the City of Opa-locka. Section 3. The City Commission of the City of Opa-locka, Florida, hereby employs Resolution No. 12-8465 Joanna Flores as City Clerk, on the following terms: a. The City Clerk is to receive an annual base salary of Eighty-Five Thousand Dollars ($85,000)per year. b. The City Clerk is to receive Six Hundred Dollars ($600.00) per month for car allowance, which includes maintenance and insurance. c. The City Clerk shall accrue and receive personal annual leave of twenty-five (25) days per year and annual sick leave of fifteen(15)days per year,both of which may be rolled over if unused in any year. At the time of separation from the City,the City Clerk will be entitled to be paid for any unused annual personal leave and unused sick leave. d. The City Clerk shall receive the City's premium insurance package,including health insurance (PPO Plan), major medical, life insurance, accident, disability benefits, non-cosmetic dental insurance and vision. e. The City shall pay the required premiums on the basic life insurance policy provided to the City Clerk and, in addition, the City shall provide a supplemental life and disability policy to the City Clerk, provided, however that the yearly cost of said policy will not exceed 7% of the City Clerk's annual base salary. f. The City shall provide travel insurance for the City Clerk while she is traveling on City business, with the City Clerk to name a beneficiary. g. The City shall execute all necessary agreements on behalf of the City Clerk's retirement benefit participation in ICMA-RC Retirement Plan. (The City will pay an amount equal to 9%of the City Clerk's annual base salary). h. The City will pay up to Three Thousand Dollars($3,000.00)reasonable professional fees and expenses for the City Clerk, including travel related to City business. All such expenses and other reasonably incurred business expenses shall be charged on a City credit card to be provided to the City Clerk. All such expenses and reimbursements shall be subject to the furnishing of original paid receipts or original invoices, and appropriate backup. Resolution No. 12-8465 i. The City will pay certain expenses of a non-personal and generally job-affiliated nature, and agrees to reimburse the City Clerk for such general expense. The City will defend the City Clerk against any tort, professional liability claim, demand or legal action arising out of any alleged act or omission occurring in the performance of the City Clerk's duties. k. The City shall bear the full cost of fidelity or other bonds required of the City Clerk. 1. The Commission, in consultation with the City Clerk, shall fix any such reasonable terms and conditions of employment,as it may determine from time to time,relating to the performance of the City Clerk, provided such terms and conditions are not consistent with, or in conflict with, the provisions of this resolution, the CITY Charter, or any other law. m. All provisions of the City Charter and Code, and regulations and rules of the City, relating to annual and sick leave, retirement and pension system contribution, holidays and other fringe benefits and working conditions as they now exist or hereafter may be amended, also shall apply to the City Clerk as they would to other employees of the City,in addition to said benefits enumerated specifically herein for the benefit of the City Clerk, except as herein provided. n. Such other benefits (such as paid holidays) as are generally afforded to City employees. o. In the event of termination of her employment by the City, the City Clerk will be entitled to five (5) months Severance pay, in accordance with the provisions of Florida Statutes, Section 215.425. Section 4. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this lot"day of October, 2012.
