Presents the following Ordinance ,Seconded by Councilman
ORDINANCE OF THE BOROUGH OF CARTERET, IN THE COUNTY
OF MIDDLESEX, AMENDING THE REDEVELOPMENT PLAN FOR
THE WEST CARTERET MINUE STREET RETAIL REDEVELOPMENT
AREA, PHASE II
WHEREAS, by Resolution No. 06-211, duly adopted on July 20, 2006, the Borough of
Carteret (the "Borough") designated a portion of the Borough, consisting of the properties
identified as Block 49.03, Lot I, Block 50.1, Lots 10-17,27,28,29,30 and 32.04, Block 50.2,
Lots 1.01, 1.02, 2, 3 and 4 on the Borough's tax map, as well as Pendro Avenue, Ivenitsky
Terrace, Gulino PlaCe, Bryla Street and Milik Street between Bryla Street and the eastern
boundary of Block 50.1, Lot 27 (the "Redevelopment Area"), as an area in need of
redevelopment, entitled the West earteret Minue Street Retail Redevelopment Area, Phase II,
pursuant to the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-I ef seq.
(the "Redevelopment Law"); and
WHEREAS, by Ordinance No. 06-47, fmally passed on September 7, 2006, the Borough
approved and adopted a Redevelopment Plan, entitled "West Carteret Minue Street Retail
Redevelopment Plan, Phase 11" and dated June 2006, for the redevelopment of the
Redevelopment Area (the "Redevelopment Plan"); and
'WHEREAS, Beacon Planning & Consulting Services, LLC prepared an amendment to
the Redevelopment Plan (the "Amendment"), a copy of which is attached hereto as Exhibit A,
and, on July 29, 2009, presented same to the Planning Board; and
\VHEREAS, on July 29, 2009, the Planning Board determined that the Amendment is
not inconsistent with the Bo.t;ough's Master Plan or the Master Plans of Woodbridge, Rahway
and Linden, the Middlesex County Master Plan or the State Development and Redevelopment
Plan and endorsed and recommended final adoption of the Amendment; and
WHEREAS, the Borough Council hereby finds that the Amendment is in the best
interest of the Borough and now desires to adopt the Amendment.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough
ofCarteret as follows:
1. The aforementioned recitals are incorporated herein as though fully set forth at length.
2. The Amendment to the West Carteret Minne Street Retail Redevelopment Plan, Phase
~: II, attached hereto as Exhibit A and made a part hereof, is hereby approved pursuant to N.J.S.A.

3. The scctions of the Zoning 1tfap of the Borough that relate to the Redevelopment Area
are hereby amended to incorporate the provisions of the Amendment. i

4. If any part oftrus Ordinance shall be deemed invalid, such parts shall be severed an~
the invalidity thereby sball not affect the remaining parts of this Ordinance. I
5. A copy of this Ordinance shall be available for public inspection at the offices of th~
Borough Clerk. I
6. This Ordinance shall take effect immediately upon final adoption and publicatio9-
thereof according to law. ~
7. Upon fmal a~oPtion hereof, the Borough Clerk shall forward certified copies of thil
Ordinance to McManimon & Scotland, L.L.C., attn: Kevin P. McManimon, Esq., Special
Redevelopment Counsel to the Borough. I

EXHIBIT A
AMENDMENTS TO WEST CARTERET MINUE STREET
RETAIL REDEVELOPMENT PLAN, PHASE II
1. Amend Section 3.1 (Approach), to add the following text:
"Existing buildings may be redeveloped and/or rehabilitated for commercial and
light industrial uses provided adequate buffers are provided for neighboring
properties."
2. Amend Section 3.2 (Plan Interpretation), to add the following text on page 14:
"7) Provide for the redevelopment and/or rehabilitation of existing buildings for
commercial and light industrial uses deemed compatible with the mixed land use
development pattern envisioned for the WCMSRRAP2.
3. Amend Table 4 in Section 3.5 (Permitted Uses), to add an additional use, to read as '
follows:

19. Data/telecommunications centers, and similar data repositories and high technology
uses.
