A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, TO AUTHORIZE THE
CITY MANAGER TO ENTER INTO A CONTRACT WITH

PAYABLE FROM ACCOUNT NUMBER 72-572340;
PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS,the City of Opa-locka requested quotes from seven pool vendors; and
WHEREAS two companies submitted quotes; 1) Miami Pool Tech Inc. —3x weekly pool
maintenance service at a cost of$950.00 per month;and 2)All Florida Pool&Spa—3x weekly pool
maintenance services at a cost of$1,380; and
WHEREAS, the City Commission of the City of Opa-locka desires to authorize the City
Manager to enter into contract with Miami Pool Tech, Inc.
NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby authorizes and directs
the City Manager to enter into contract with Miami Pool Tech, Inc., at a monthly cost of$950 for
maintenance service to be provided for Sherbondy Park pool,three(3)times weekly,payable from
Account No. 72-572340.
Section 3. This resolution shall take effect immediately upon adoption.

REQUEST FOR QUOTE
SPECIFICATIONS FOR POOL CLEANING SERVICES
Scope of Services: The successful bidder shall provide pool cleaning services at the City of Opa Locka,
Sherbondy Village Pool, 215 Perviz Avenue, Opa Locka, Fl 33054. The successful bidder shall provide
all services required by the State of Florida and the Health and Rehabilitative Services Department, per
Florida Administrative Code, Chapter 64E-9.004, Public Swimming Pools and Bathing Places, whether or
not these requirements are specifically mentioned in the scope of services contained herein. In addition,
the successful bidder shall be a certified pool/spa operator as required by the National Swimming Pool
Foundation and provide a copy with bid submittal. The successful bidder shall bear the full and sole
responsibility of coordinating with any and all federal, state, and local governmental agencies concerning
the regulation and proper operation of this swimming pool in reference to the health, safety, and welfare
of those that so choose to use said swimming pool.
Schedule of Pool Maintenance: Pool cleaning service shall be performed seven (7) days a week. Pool
services shall be performed prior to 7:00AM, early enough in the morning so as to ensure that one pool
cycle has occurred prior to the opening of the swimming pool to guests. Pool operating hours will be
modified according to the season. It is the successful bidder's responsibility to adhere to the current
operating hours.
Pool Services: The successful bidder shall chemically balance the pool and clean the tile at the water
level on a daily basis. The successful bidder shall vacuum the swimming pool, brush the walls, and skim
the surface a minimum of three (3) days a week, preferably on Mondays, Wednesdays, and Fridays. The
pool filters within the filtration tank shall be cleaned at least once a month, during the off-peak season,
and weekly or daily during the peak season as necessary. The filtration tank shall remain free of debris,
including leaves, oils, and trash at all times. The successful bidder is required to inspect the filtration
tank, daily service is performed to ensure that the pool filtration system, including the filtration tank, water
supply lines, drains, and scuppers, that pool water is free from debris at all times. The successful bidder
is to perform a water consumption evaluation once a week.
Additional Services: There may be additional services that are necessary, mandated by the regulating
authority, statute, administrative code, or policy not listed herein. In such cases, said regulation, policy,
statute, and/or administrative code shall govern the services to be provided, with the exception of any
requirements the CITY may impose. Regulations may change from time to time. These changes may
affect the service and operation of the swimming pool and shall be followed as required when they
become effective; therefore, it shall be the sole responsibility of the successful bidder to keep up to date
with said regulations and to incorporate any additional services that may be required as a result of
changes in said regulations.
Operational Requirements: The pool maintenance and service should meet the following requirements:
a. Bacteriological Quality: The water shall be free of coliform bacteria contamination.
b. Clarity: The pool water shall be five-tenths (5/10)or less Nephelometric Turbidity Units and the
main drain grate must be readily visible from the pool deck.
c. Chemical Quality: All chemicals used in controlling the quality of the pool water shall be tested
and approved using the National Sanitation Foundation (NSF-ANSI) Standard 60, 2005, dated December,
2005, incorporated into the Florida Administrative Code, Chapter 64E-9.004. The following parameters
shall be adhered to for pool water treatment:
pH -7.2to7.8
ii Disinfection— Free active chlorine residual shall be between 1 milligram per liter(mg/L)to 10
milligram per liter(mg/L) in all swimming pools. Bromide residual shall be between 1.5 milligram per liter
(mg/L) to 10 milligram per liter(mg/L).
iii. Cyanuric Acid— 100 mg/L maximum
Quaternary ammonium —5 mg/L maximum
Copper— 1 mg/L maximum
vi. Silver—0.1 mg/L maximum
vii. The chemical balance of the pool shall meet or exceed the minimum standards of Florida
Administrative Code, Chapter 10D-5, during all hours the pool is open.
d. Manual application of chemicals will be allowed under special conditions and will require that the
swimming pool be closed for at least one(1) pool turnover period. After treatment for breakpoint
chlorination and algae prevention, use of the pool can be resumed when the free chlorine levels
drop to 10 mg/L. The successful bidder shall be responsible to monitor, certified and stay on
premises until the drop occurs.
e. A daily record journal for the pool operation using the Monthly Swimming Pool Report obtained
from the Miami-Dade County Health Department shall be kept on site as well as the Material Data
Safety Sheets (MSDS) book shall be contained within the journal book. Said journal book shall
be kept up to date and be readily available for inspection at all times.
f. The pool re-circulating system shall be operating at all times. A Pool Water consumption
evaluation is to be completed once a week and its results noted on the daily record journal.
g. Test Kits are required to be on the premises to determine free active chlorine and total chlorine
using N, N-Diethly-p-Phenylenediamine (DPD, or bromine level, total alkalinity, calcium hardness and pH.
h. Should a human fecal accident occur, the successful bidder shall comply with all recommendations
found in the Centers for Disease Control and Prevention's (CDC) "Fecal accident response
recommendations for Aquatics Staff' dated February 15, 2008 found on the department's internet
website: http://floridashealth.org/Environment/water/swim/index.html. The successful bidder shall be
called. The alternative emergency disinfection methods that are approved by the CDC, shall be used.
Chemical storage: Chemicals shall be stored in an area designated by Project Manager. Chemicals
shall not be stored in the equipment room or any other public area. Empty chemical containers shall be
disposed of in a manner that they are not accessible to the public.
Extended Services: The successful bidder is expected to degrease the filtration system as necessary
and on a regular basis. The successful bidder is also expected to back flush the filtration system on a
regular basis, on a schedule to be determined by the successful bidder and approved by the City.
Maintenance and Repairs: The successful bidder shall be authorized to provide minor repairs providing
the successful bidder (a) contacts the City in advance, (b) obtains a valid purchase order, and (c)
provides reliable service with a reasonable warranty. The maintenance and repair portion as a result of
the awarded Agreement shall utilize time and materials pricing. The time and materials pricing provides
for the acquisition of these services based on direct labor hours and material costs. Direct labor costs
shall be paid at specific hourly rates; inclusive of all wages, overhead, general and/or administrative
expenses and profit; The successful bidder shall submit invoice of the parts used along with the
successful bidder's invoice to be compensated. Repair service in excess of the cleaning service in
accordance of the scope of service. All parts and components shall be original manufacturer's parts and
components and readily available to expedite repairs. Used parts or components is strictly prohibited.
Emergency Services:
The successful bidder shall be prepared to provide emergency services as soon as possible with
a maximum of two (2) hours response time in situations where the successful bidder is not on site
and the City has to contact the successful bidder.
Since many mechanical or hydrologic breakdowns may result in an emergency hazard to life,
limb, or property, the successful bidder is encouraged to participate in the repair process.
The City intends to pursue its relationship with the successful bidder to provide regular and
emergency repairs as necessary; however, the City reserves the right to contact outside vendors
to obtain estimates, goods, services, or advice from time to time as may be necessary.
Termination for Violation: Any act of the successful bidder, its assigns, heirs, and/or representatives
that results in a direct or indirect violation of Florida Administrative Code 64E-9.004, Public Swimming
Pools and Bathing Places, shall be grounds for termination of the Agreement for such violations at the
sole discretion of the City. Such violations may not be a direct emergent hazard to life, limb, or property,
but may also include, but not be limited to, failure to report damages or vandalism of pool or pool related
systems, health unit violations, or violations of emergency services.
General and Additional Services: It is the responsibility of the successful bidder to ensure the work
areas are free from trash and other debris before leaving the premises each day. The successful bidder
shall remove all trash and debris at its own expense, with no exception. Violations of this provision may
result in termination of the Agreement providing that this infraction is a violation of Florida Administrative
Code, 64E-9.004. The City will make available trash receptacles for the use of the successful bidder.
Report Forms: The successful bidder shall be required to furnish and complete, Monthly Swimming Pool
Report. Any and all other forms that are or may be required by current or future regulations are also
required to be submitted. Copies of all forms submitted are to be provided to the Park & Recreation
Department, attn: Charles Brown, on a monthly basis. No payment for services shall be made without
receipt of this report.
Material Safety Data Sheet: In accordance with chapter 422, Florida Statutes, the successful bidder
shall be required to submit Material Safety Data Sheets (MSDS) for all necessary products. Failure to
provide such after execution of the Agreement, but prior to starting the job, may result in termination of
the Agreement. Copies of all Material Safety Data Sheets (MSDS) shall be kept with the log book at the
swimming pool facility.
Failure to meet the above standards or citation of a Code Violation by the Miami-Dade County Health
Department or other Public Health Unit in respect to the Agreement will result in termination of the
Agreement or a penalty of ten percent(10%) of the monthly charge.
E15. City Responsibility: The City shall be responsible for:
(a) Provide a designated set-up area for the successful bidder to deliver all necessary materials and
equipment required for this services;
(b) Provide access to work area;
(c) Provide electrical services if required;
(d) The City shall make the facility available for evaluation and inspection on THURSDAY,AUGUST 16,
2012 AT 10:00 AM Local Time.

80 to 120 PPM, Calcium Hardness 250+, Cyanuric Acid/Conditioner 20 to 50ppm, and
Algaecides. To meet standards of oxidation and sanitation.
• Also add and monitor amounts of Algaecides, Filter Coagulants and Shock treatments.
• Monitor and interpret gauges, flow meters, operational and recirculation efficiency of
various filters and filter media systems.
• Maintain pool ladders, railings and monitor bumpers, o-rings, gaskets and gauges.
• Skim,vacuum, brush, tile cleaning, check lint traps and cleaning of filters.
• All chemicals included, repairs and parts are not included.
• Insure all Health Department codes and regulations are maintained. 1
• Additional charges may apply for any named storms we may have, for extra chemicals
and labor. Prices range at approximately Fifty (50) to One Hundred (100) Percent (%)
of your monthly maintenance.
• Additional charges will also apply if pool or spa, have been vandalized,for extra labor.
• Accounts that show a history of over consuming product (based on operating the
Equipment within the recommended standards for normal operating conditions) may
get a rate adjustment in accordance with product consumption history. Miami Pool
Tech also reserves the right to provide only that amount of product which is necessary
to operate the Equipment within the recommended standards for normal operating
conditions.
We hereby propose to furnish labor and materials - complete in accordance with the above specifications, for
the sum of Nine Hundred Fifty Dollars (950.00) with payment to be made as follows: First of each month at
start of service. This proposal will become an agreement if signed and shall continue, unless sooner
terminated. Cancellation of service by either party is accepted upon 30 days written notice. All material is
guaranteed to be as specified. All work to be completed in a workman like manner according to standard
practices. Any alteration or deviation from above specifications involving extra costs, will be executed only
upon written orders, and will become an extra charge over and above the estimate. All agreements contingent
upon strikes,accident or delays beyond our control. This proposal subjects to acceptance within 30 days and is
void thereafter at the option of the undersigned.

ADDITIONAL TERMS AND PROVISIONS
1. CUSTOMER agrees to provide reasonable access to the pool location to the employees,
representatives, subcontractors, and agents of CONTRACTOR so that CONTRACTOR may fulfill its
obligations under this Agreement as efficiently as possible. CUSTOMER shall keep its employees,
agents,family, guests and pets away from the pool location during the course of CONTRACTOR'S
performance under the Agreement,
2, CONTRACTOR shall not be liable for any failure to perform due to strikes,acts of God,governmental
actions or conditions beyond its control,including unavailability of supplies or labor at prices that are
substantially similar to prices at the time of the execution of this Agreement.In the event that materials
or labor called for under this Agreement are not substantially the same price as at the time of making
this Agreement, CONTRACTOR shall have the right to amend this Agreement to cover such changes
or to terminate this agreement.
3. Should CUSTOMER fail to pay any monies due hereunder within five(5)days from the due dates, all
monies that are payable to CONTRACTOR under this Agreement shall Immediately become due and
payable without the need for further demand and this Agreement can be terminated by CONTRACTOR
without prior notice. Should CONTRACTOR retain the services of an attorney and/or Institute legal
proceedings to collect monies that are due under this Agreement or to enforce any provisions hereof,
CUSTOMER agrees to be held liable for any costs of said law suit and reasonable attorney fees.Title
to all Items that are supplied hereunder by CONTRACTOR shall remain property of CONTRACTOR
until paid for in full by CUSTOMER, and CONTRACTOR shall have the right to repossess said items
and/or remove same, with or without the benefit of legal process, to lien the premises of the pool
location without further notification,and to seek such further legal or equitable relief as may be available
to CONTRACTOR,
4. CONTRACTOR makes no representations,warranties,promises,oral or written,expressed or implied,
with respect to this Agreement, except as expressly provided herein. CONTRACTOR makes no
representations or warranties on equipment sold or installed, other than that offered by the
manufacturer of said equipment. Manufacturer warranty does not include any labor charges by said
CONTRACTOR,This Agreement can be modified in writing only,to be signed by all of the parties hereto.
5, CUSTOMER shall be responsible for damage,loss or destruction,from any source whatsoever,to all
material, equipment, appliances or goods, after they have been delivered to the pool location.
CONTRACTOR shall not be liable for any loss,damage or destruction to the pool location or premises
of pool location, by any person or cause whatsoever except when caused by the employees of
CONTRACTOR.CONTRACTOR shall not be liable for any type of damage,loss or destruction caused
by the pool waste or drain outlet line. CONTRACTOR shall not be liable for any damage to the pool
structure or piping due to underground water pressure, in the event the pool must be drained for
cleaning,testing or repairing.
6, CUSTOMER has the right to rescind service agreement at the end of any month by written notice only,
allowing five(5)days for mall delivery.This does not pertain to repair contracts.
7. Unless otherwise specified,time is not of the essence on repair contracts.
8. Any changes requested by CUSTOMER will require a new contract.
