A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, TO APPROVE FINAL
SITE PLAN FOR APPLICANTS ANTONIO ACOSTA AND
GUSTAVO RAMOS, AND PROPERTY OWNER PEDRO O.
RODRIGUEZ'S REQUEST TO CONSTRUCT A
SUPERMARKET AT 2121 NW 135TH STREET,OPA-LOCKA,
ENCOMPASSING APPROXIMATELY 22,415 SQUARE
FEET;PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on May 8, 2012, the Planning Council met to consider approval of final site
plan for construction of a supermarket at 2121 NW 135th Street in the City of Opa-locka, at which
time applicants provided a traffic impact statement to the Planning Council; and
WHEREAS, on June 5, 2012, after reviewing applicants' traffic impact statement, the
Planning Council held another review of applicant's modified site plan, including some changes
based on input from area residents; and.
WHEREAS,at the June 5, 2012 meeting,the Planning Council recommended approval of
the site plan as it meets the requirements of Sec. 4.4 of the Land Development Code, and
WHEREAS,_if approved by the City Commission of the City of Opa-locka, the City will
realize an enhanced tax revenue,generating approximately$112,739 in FY 2013 once construction is
complete; and
WHEREAS,the City Commission of the City of Opa-locka desires to approves the final site
plan for the construction of a supermarket at 2121 NW 135th Street pursuant to site plan application
number 12-050803, as approved by the Planning Council.
NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA:

Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby approves applicant's
request for final site plan approval to construct a supermarket at 2121 NW 135th Street,Opa-locka,,
consisting of a 22,415 square foot building,as presented to and approved by the Planning Council,
subject to all conditions recommended by staff, specifically including:
1. The property must be served by sanitary sewer.
2. Any future signage shall comply with City sign ordinances.
3. All trash and garbage containers shall comply with City dumpster enclosure
requirements, and they shall be properly constructed in accordance with City
Ordinances.
4. Applicants must pay all development impact fees associated with project.
5. There shall be no outdoor storage of equipment, goods, or merchandise permitted,
and at no time shall any of these items be stored outside a wholly enclosed building,
in parking spaces, travel lanes, fire lanes, etc.
6. The execution and Recordation of the related Development Agreement.
Section 3. This resolution shall take effect immediately upon adoption.

Short Title:

Staff Summary:
On April 18, 2012, there was a pre-conference meeting with the applicant, Antonio Acosta and
Gustavo Ramos to review site plan checklist requirements and the site plan application. At that
meeting, the applicant met requirements all requirements except for providing the traffic impact
statement.
On May 8, 2012, the Planning Council met on May 8, 2012 to consider the applicant's request
for final site plan approval to construct a supermarket at 2121 N.W. 135th Street Opa-locka, FL.
At that meeting, the applicant provided the Planning Council with the traffic impact statement.
At the request of the Planning Council, the matter was tabled until June 5, 2012 in order to give
the Planning Council adequate time to review the traffic impact statement. Also, it was
expressed at that meeting that the Applicant should meet with area residents regarding their
concerns about not being notified about this development project. The applicant's request was
deferred to the June 5, 2012 scheduled Planning Council meeting.
On June 5, 2012, this application was presented again to the Planning Council. The applicant
modified the site plan, based comments from area residents, by providing more landscape
buffering on the south side of the property and by moving the parking to the west side of the
property. There was no noted opposition at the June 5, 2012 Planning Council meeting. There
was however support from Ms. Doretha Nixon, one of the affected residents from the previous
Planning Council meeting. The subject property is located within the B-2 (commercial liberal)
zoning district and is allowed as a permitted use.
Proposed Action:
The applicant's final site plan meets the site plan requirements of sec. 4.4 of the Land
Development Code.
Staff Recommends Approval of this request subject to the following:
1. The property must be served by sanitary sewer.

Request:
A resolution of the City Commission to grant final site plan approval to construct a
supermarket at 2121 NW 135th Street, Opa-locka, Florida. Folio No. 08-2121-013-0070
and contains 63,870 square feet, providing for incorporation of recitals; providing for an
effective date.
Description:
On April 18, 2012, there was a pre-conference meeting with the applicant, Antonio
Acosta and Gustavo Ramos to review site plan checklist requirements and the site plan
application. At that meeting, the applicant met all requirements except for providing the
traffic impact statement.

Analysis:
The applicant's final site plan meets the site plan requirements of sec. 4.4 of the Land
Development Code.
Financial Impact:
Indirectly once the site and building improvements are completed, the City will realize
enhanced tax revenues, franchise fee, impact fees, and 30% of all building permit fees.
We estimate the subject property will generate $112,739.60 in FY 13. Please see
attached revenue snapshot.
Project Time Line:
Once all building permits for the project have been issued, construction will start
immediately. The Developer intends to proceed with a 12-month construction schedule
after site plan approval and appropriate permit issuance. Project should be completed
on or about December 1, 2013.
