The meeting was called to order at 7 : 00 p . m . by the Moderator , Stephen L . Doyle . The Tellers were June Gallant , Ruth Hanlon , Eleanor Nielson and Jean Gage . The Checkers were Sherry Ryder , Elizabeth Hardy , Robert Hardy , Catherine Flaherty , Sharon Morgan , Mildred Unger , John Unger , Patricia Kelsey , Lois Curcio and Liana Rasmussen . A quorum was present . The Town Clerk , Joan K . Cole , read the Annual Town Meeting Warrant and the return of the warrant . There being no objection the Moderator dispensed with the reading of all the articles . On behalf of the Board of Selectmen , Rita Lawler presented a proclamation in memory of Robert Rubino . PROCLAMATION AND RESOLUTION OF SYMPATHY WHEREAS The Town of Brewster and its inhabitants are called upon to mourn the passing of Mr . Robert Rubino , an honored and respected citizen of the Town of Brewster ; and WHEREAS It is appropriate for good citizens to honor their loyal and faithful public servants ; and WHEREAS Mr . Rubino served as the Town ' s Assistant Treasurer for ten years . He brought with him to Brewster his extensive 41 years of expertise as an accountant with the Atlantic Richfield Co . of Waterbury , Conn . and a broad knowledge of employee benefits management . Bob was a wealth of knowledge and know- how , and he was always willing to take the time to explain or research an issue . We came to rely on Bob ' s patience and gentle good humor to de - fuse and calm even the most hectic of office situations . Always cool and collected , Bob could relax and soothe anyone . THEREFORE The Board of Selectmen , on behalf of all the citizens of the Town of Brewster , extend our profound thanks and express our greatest appreciation to Mrs . Lucile Rubino , Bob ' s loving widow , for Bob ' s ten years of dedicated service . We are grateful for Bob ' s many contributions to the Town and to the Treasurer ' s Office . We will miss Bob and extend our deepest sympathy to Mrs . Rubino in the hope that this gesture will help to ease her and her family ' s loss . BREWSTER BOARD OF SELECTMEN Rita A . PROCLAMATION AND RESOLUTION WHEREAS It is appropriate for good citizens to honor their loyal and faithful public servants ; and WHEREAS Mrs . Dorothea Dugan has served the Town of Brewster _ in one form or another for over 34 years . In 1945 , she served the War effort as Clerk of the Rationing Board . She was Chairman and a member of the Swimming Committee for 12 years . She has served as a Registrar of Voters for 34 years , 26 of which she held the position of Chairman of the Board of Registrars . She served as Treasurer , and then President , of the Parent Teacher Association and as Treasurer of the Girl Scout Committee for 2 years . Mrs . Dugan and her family have been present in Brewster for decades and are very much a part of the Town ' s history . We are grateful for Mrs . Dugan ' s commitment to Brewster . THEREFORE the Board of Selectmen , on behalf of all the citizens of the Town of Brewster , extend to Mrs . Dorothea Dugan our profound thanks and express our deepest appreciation for her many years of dedicated service to the Town of Brewster . We wish her well in her much deserved retirement . PROCLAMATION AND RESOLUTION WHEREAS We , the inhabitants of the Town of Brewster , assembled at this Annual Town Meeting the tenth day of May 1993 " to act and do upon the whole as the inhabitants of said Town of Brewster shall think proper " ; and WHEREAS It is appropriate for good citizens to honor their loyal and faithful public servants ; and WHEREAS Mrs . Marion Wylie has served as Chairman of the Brewster Historical Commission for over twenty years . As Chairman , Mrs . Wylie led the Commission to complete an extensive 2 -volume catalogue of Brewster ' s historic buildings and landmarks . Completed in 1991 , " Historic Brewster " includes photographs , locations and historic data on over 200 of Brewster ' s historic structures . We are grateful for Mrs . Wylie ' s profound sense of history and her willingness to share with the Town her appreciation for architecture and antiques . She has shown us images and accounts of bygone eras in marvelous detail and given us an extraordinary resource . Her contributions to the preservation of Brewster ' s proud past have been invaluable . ATM 5 / 10/ 93 THEREFORE The Board of Selectmen , on behalf of all the citizens of the Town of Brewster , extend to Mrs . Marion Wylie a standing vote of thanks for her many years of dedicated service as a leader of the Brewster Historical Commission . Paul F . Saint has served as a member of the Board of Selectmen for 6 years , serving as Chairman from 1989 to 1990 . Paul served on the Board of Assessors from 1987 to 1993 , acting as Chairman from 1988 to 1993 . His expertise in the field of insurance was of great assistance to the Insurance Advisory Committee from 1990 to 1993 and he was extremely instrumental in the development of the Belmont Park Affordable Housing Project , as Chairman of the Brewster Housing Partnership from 1988 to 1991 . He also served as a member of the Drummer Boy Ad Hoc Committee from 1991 to 1992 . It would be impossible to list all the areas in which Mr . Saint and his family have contributed to the Town over the years . We are grateful for Mr . Saint ' s commitment to Brewster and its inhabitants . THEREFORE the Board of Selectmen , on behalf of all the citizens of the Town of Brewster , extend to Mr . Paul Saint a standing vote of thanks for his six years of dedicated service . We extend our profound thanks and express our deepest appreciation to Mr . Paul Saint for his willingness to serve our community . We will miss him , and his motions and seconds , on the Board of Selectmen , but we hope that he will enjoy some well deserved free time . BREWSTER BOARD OF SELECTMEN Rita A . ACTION : ADOPTED UNANIMOUSLY ATM 5/ 10/ 93 RECESSED the Annual Town Meeting in order to open the Special Town Meeting at 7 : 15 p . m . RECONVENED the Annual Town Meeting at 7 : 30 p . m . ARTICLE 1 . To act upon the Annual Report of the Board of Selectmen , Town Officers and / or other Special Committees , or to take any other action relative thereto . ( Board of Selectmen ) REPORT OF THE BREWSTER FINANCE COMMITTEE I . INTRODUCTION As the Finance Committee began deliberations in October , 1993 ; to plan for the fiscal 1994 budget , the town was working within distressed financial conditions . A number of events occurred between early October 1992 and January 1993 which presented a much more positive outlook for the town ' s financial condition . In late October , we were officially notified of the town ' s positive Free Cash position . Previous cash settlements of land litigation suits had strained the town ' s cash resources to the point where the town had a negative Free Cash position as we entered fiscal 1993 . The certification of our Free Cash created a more comfortable level at which to begin our fiscal 1994 budget preparations . Continuing in a positive frame , the town received legislative approval in late 1992 allowing it to use land trust funds to pay, further land damage litigation settlements . As the land trust funds , which had been built up as a result of monies escrowed to pay unknown owners for parcels taken by eminent domain , reached levels approaching 5110001000 . 00 . This again reduced the strain of litigation settlements on the town ' s cash . Further , a 15 % reduction in the town ' s total bonded indebtedness from $ 3 , 872 , 921 in FY1993 to $ 3 , 377 , 120 . 00 will reflect positively on our town ' s financial position . Although the debt had previously been excluded from Proposition 2 1 / 2 , this reduction has put the town in the right direction for the first time in many years . This reduction alone will have a positive impact on the reduction of our tax rate . Buoyed by the cooperative efforts of town departments , commissions and committees , the Finance Committee initiated its commitment to developing a FY1994 budget which would continue essential services at the least possible cost to taxpayers . II PROCESS The Finance Committee addressed the budgetary needs of the town disregarding our newly re - established " savings account " . It was decided early in the process that operating expenses would not be funded from Free Cash . Instead , realistic budgets would be examined within the guidelines of Proposition 2 1 / 2 . ATM 5 / 10/ 93 Beginning with a letter to all departments / committees in November , the Committee stressed its intention to ask for " accountability " in budget planning . The Committee decided against asking for across the board increases or decreases in reviewing FY1992 expenditures , it was realized that some departments would need growth oriented increases while others could deliver the same level of services at reduced costs . Members of the Committee continued to attend department / committee meetings and / or receive minutes in order to keep the full Committee abreast of financial situations requiring our input . III . OPERATING BUDGET The Finance Committee is proposing a final town operating budget of $ 9 , 795 , 872 . 00 representing a 2 . 5 % reduction from FY1993 , exclusive of school budget requests . It is the Finance Committee ' s opinion that this budget will allow for maintaining present levels of services . The budget reflects the deletion of two ( 2 ) part - time and one full - time position , and does not include the addition of a new full - time position at the water Department , as requested . Although the departments involved truly believe in the need for these positions , it is the Committee ' s opinion that the present level of services will be maintained . The proposed budget expense for the Nauset Regional School District results in an assessment to the Town of Brewster of $ 3 , 616 , 056 . 00 , a reduction of 10 . 27 % from the FY1993 assessment . Part of the reduction in our assessment is the result of a lesser percentage of enrollment in the Nauset District for Brewster students ( from 44 . 96 % to 43 . 41 % ) . Also , the anticipated reimbursements from SBAB for the Middle School expansion project weighs heavily in the reduced assessment for Brewster . Lest the town believe the reduction is the begging of a trend , it is important to note the proposed budget does not include any negotiated payroll increases for teaching services . At press time , the administration and union had not settled the bargaining process for the teachers new contract . The present three - year contract for the teachers will expire on June 30 , 1993 . Enrollment projections for both the Middle School and High School continue to increase . The Finance committee recommends approval of the Nauset Regional School District budget assessment to Brewster . The proposed budget request submitted by the Brewster Elementary School Committee is $ 3 , 238 , 531 . 00 representing an 8 . 6 % increase from FY1993 . Allowing for enrollment increases and anticipated state aid , the Finance Committee is recommending a budget figure which represents a 3 % increase or $ 3 , 070 , 583 . Again , it is noted that figures does not include any negotiated payroll increases for the teachers contract . Cape Cod Regional Technical High School has presented a budget assessment to Brewster of $ 2167514 . 00 , representing an 18 . 56 % decrease from Fiscal Year 1993 . The overall budget for Cape Cod Regional Technical High School also reflected a decrease of 5 % , reflecting the reduction of its debt position . The balance of this decrease reflects a decline in Brewster ' s share of the total enrollment . The Finance Committee recommends approval of the budget assessment from Cape Cod Regional Technical High School . ATM 5/ 10/ 93 IV . FINANCIAL OVERVIEW A . Revenue Projections and Proposition 2 1 / 2 Limitations For Fiscal Year 1994 the maximum levy limit ( or amount the Town may tax from property ) is $ 9 , 925 , 707 . 00 , including allowance for new growth . As of the time of printing , the total amount which may be expended by the Town of Brewster is $ 17 , 913 , 195 , 00 . 1 . LEVY LIMIT : $ 91925 , 707 . 00 2 . AVAILABLE FUNDS * * 553 . 587 . 00 $ 17 , 913 , 195 . 00 * ESTIMATED RECEIPTS INCLUDE : State Aid State School Building Assistance Town Receipts Golf Receipts Water Receipts * * AVAILABLE FUNDS INCLUDE : Free Cash Water Surplus Account Cemetery Perpetual Care Account Overlay Surplus Account Pension Fund Wetlands Protection Fund Ambulance Receipts Fund Water Betterments Receipts Fund Road Betterments Receipts Fund B . Expenses In addition to the town operating budget and school budgets and assessments , continued debt service payments , other accounts and charges must also be paid from the above - captioned revenue sources . These additional costs total $ 578 , 803 for Fiscal 1994 . Added to the Town ' s operating budget of $ 9 , 795 , 872 . 00 and school budget / assessments of $ 6 , 903 , 153 . 00 , this results in proposed expenditures of $ 17 , 277 , 828 . 00 , exclusive of warrant article expense . V . WARRANT ARTICLES The Finance Committee reviewed warrant article expense requests using the same parameters as budget requests . The Committee emphasized the necessity of providing level services and maintenance of property . Assuming budgetary recommendation constraints are accepted , revenues available for warrant article expense equals $ 631 , 417 . 00 . Submitted article expense requests total $ 21178 , 250 . 00 , exclusive of budget articles and contract settlement negotiations . No settlements had been reached through collective bargaining at press time . If settlements are reached , these articles will be addressed at Town Meeting . In making recommendations of article expenditure requests , the Finance committee explored the timeliness of the request and the availability of funds . In many cases it is recommended that funds be transferred from appropriate funding sources and / or request be approved subject to a Proposition 2 1 / 2 override election vote . ATM 5/ 10 / 93 Of the 29 articles on the warrant requiring financial expenditure , exclusive of operating and school budget / assessments , the Finance Committee has recommended approval of 21 articles , either in full or in part . VI . IMPACT ON TAX RATE As indicated earlier , the reduction of the town ' s total bonded indebtedness will have the greatest impact on the tax rate . Coupled with earlier town meeting action to use a portion of free cash to reduce the FY1994 tax rate , a positive reaction should be reflected from the Brewster taxpayer . It is not a small concern of the Finance Committee as to how the " one - time " tax rate reduction will affect taxpayers in the long term . However , with our continued debt reduction and the need to continue budgetary expenses at accountable levels , we are hopeful that the impact will remain positive . Our commitment to responsible appropriate debt encumbrance in the future will continue the town ' s positive direction in this area . The Town of Brewster faces several substantial capital projects in the nest five years , but with proper planning as is espoused by the Capital Planning Committee ' s most recent report , we feel the projects are economically feasible without over - burdening the taxpayer . VIII CONCLUSION The Fiscal Year 1994 operating budget and warrant article recommendations by the Finance Committee allow for maintaining level services to the Town of Brewster residents . The cooperation of all town department heads and town officials in providing the Finance Committee with accountable budget requests is appreciated . Particular thanks go to the Board of Selectmen , Executive Secretary , Charles Sumner and Town Accountant , Lisa Souve , for their extreme assistance and guidance . Linda E . Riedl , Chairman Nancy Shaw , Vice Chairman Leslie Joslin Mary Ella Parrott Earl Caudill Dion Dugan Steven Ellard Robert Kurisko Donald Poole REPORT of the NAUSET REGIONAL MIDDLE SCHOOL BUILDING COMMITTEE Since February of 1987 , the Nauset Regional Middle School Building Committee has been managing the renovation and addition of the Middle School in Orleans . After almost 6 1 / 2 years that task is coming to an end . The Middle School is 99 % complete . Monies paid to date are $ 17 , 000 , 160 . 78 . We are in the process of doing site work that was held over through the winter . We have paving and planting to finish . Any plantings and grass that failed to make it through the winter will be replaced as per the contract . The Architect and Contractor are going over Punch List items that need to be done . Punch List items are things , i . e . hardware , or work that is not done to the satisfaction of the Building Committee and / or Architect . These items must be corrected before payment is released . ATM 5 / 10 / 93 There are a number of small items ( in work scope and price ) that need to be done in the building . The Building Committee will be contracting these items on our own locally or doing them in house to save the General Contractor markup . There have been a number of articles in the local newspapers about complaints of air quality , asbestos , etc . in the new school . Let me assure you first that there is no asbestos in the school . The Building Committee takes every and any complaint seriously . We work with the Health Officer in Orleans and any test he deems necessary is done . Testing on the water from the monitoring wells on site has been very positive in the favor of the Nauset Region . The flow amount leaving the building is averaging 4500 gallons per day . The State limit is 15 , 000 per day . Installing water saving devices in the lavatories and kitchen should keep the flow under the State limit even as the population grows . The nitrate levels averaged 4 1 / 2 to 6 1 / 2 parts per billion depending on the monitoring well ' s proximity to the leaching field . Water leaving the property was at the low end of the State nitrate limit of 10 parts per billion . The Nauset Regional Middle School Building Project is number one in line for funding from the Commonwealth . We worked very hard to get to be number one and we will stay there until we get our funds . However , nothing runs smoothly when it comes to the State of Massachusetts . The Legislature is now grappling with Education Reform , specifically with School Choice . No funding for school construction will be debated until the School Choice issue is resolved . We are battling against the Legislator ( s ) from Boston . We need to make our resolve clear to our committment to this project and we want the State to honor its commitment to the Nauset Region . On behalf of the Nauset Regional Middle School Building Committee , I extend an invitation to attend the Dedication and Open House of the Nauset Regional Middle School on Thursday , June 10 , at 1 : 00 PM starting on the front lawn of the school and ending with a tour of the building . To see if the Town will vote to petition the General Court for special legislation authorizing the Town to adopt the following bylaw , to be identified as Chapter 95 of the Code of the Town of Brewster : Environmental Protection Bylaw for Septic Betterments Statutory Authority : The Town of Brewster shall financially assist property owners through a program to comply with the Town ' s requirements to repair and / or upgrade private septic systems . Where there is a situation that the existing septic disposal system constitutes a present or potential threat to human health , safety , welfare or to the environment , the Town will be authorized to use public funds to assist property owners to fund improvements or upgrades of their existing system . The Town is authorized to borrow and incur debt for the purposes of cleanup , abatement , repair , and / or septic system upgrade pursuant to this section . Such agreement shall be recorded as a betterment pursuant to section two of chapter eighty and the amount assessed shall be a lien on the property pursuant to section five of said chapter eighty and may be apportioned and reapportioned pursuant to section thirteen of said chapter eighty ; provided , however , that such assessment shall bear interest at a rate determined by the Board of Health by agreement with the property owner , but , in no event , shall such interest be less than the rate of interest chargeable to the Town for the financing of such cleanup or abatement . Any such borrowing shall not be included for the purpose of computation of the levy or borrowing limits otherwise imposed upon the Town by the Massachusetts General Laws . This bylaw will further authorize the Board of Health to establish regulations governing the operation of this program after an advertised public hearing . Procedure : The applicant ( who must be the property owner or owners ) for funding must submit a signed petition and a certificate of title to the Board of Health by October 15th of each year . The petition shall include the septic system plans and specifications , designed by a licensed Civil or Sanitary Engineer or a Registered Sanitarian . Said plans shall meet the minimum requirements for subsurface disposal of household wastewater as established by the State Environmental Code ( 310 CMR 15 . 00 ) , commonly known as Title 5 , or where stricter , the regulations adopted by the Brewster Board of Health . In addition , the petition application shall include a Disposal Works Construction Permit , issued by the Brewster Board of Health . ATM 5 / 10/ 93 An agreement between an owner and the Board of Health pursuant to this section shall not be considered a breach of a limitation or prohibition contained in a note , mortgage or contract on the transfer of an interest in property . The Board of Health shall obtain construction estimates according to the scope of work outlined in the plans and specifications submitted by the petitioner . The Board of Health shall hold a public hearing on the application after due notice to the petitioner . The Board of Health shall provide an estimate of all costs to be levied against said petitioner , including engineering , legal , construction , administration , interest and other related expenses . Upon receipt of the approval of the estimated costs by the property owner , the Board of Health will seek funding by an Annual Town Meeting . Upon funding approval , the Board of Health shall obtain bids in accordance with the provisions of Chapter 30B of the Massachusetts General Laws . Within six ( 6 ) months after the construction has been completed , the total costs and maintenance shall be assigned to the petitioner , and the time for payment , not to exceed fifteen ( 15 ) years , shall be specified . Monies repaid to the Town for Septic Betterments shall be deposited into a separate receipts reserved account . The total cost of the project shall not exceed the estimate and the Town shall not be responsible for any additional costs related to upkeep or maintenance ; if , through any eventuality , the cost of the project should exceed the estimate , the excess shall be the responsibility of the property owner . The Board of Health shall bill the property owner on the next real estate tax bill and may accept settlement in cash for the full amount within thirty ( 30 ) days , or shall bill the property owner for the total cost to be divided over a period of years , not to exceed fifteen ( 15 ) , with interest to be computed at the rate as set forth in Chapter 80 of the Massachusetts General Laws , and the Town shall have a lien to secure payment in the same manner as it acquires a lien for a betterment assessment under Chapter 80 . or to take any other action relative thereto .
