RESOLUTION AUTHORIZING THE EXECUTION OF AN
AMENDMENT TO THE BRISTOL PONDS DEVELOPER'S
AGREEMENT

WHEREAS, the Borough of Carteret (the ''Borough'') entered into a Developer's
Agreement with Carteret Investors, L.L.C., aIkIa Bristol Ponds at Carteret, whose
address'is 1411 Route 35 North, Ocean, New Jersey 07712 (the "Developer"),
dated March 24, 2005, as amended by that amended Developer's Agreement by
and between the Borough and the Developer, dated August 8, 2006 (collectively,
the ''Developer's Agreement"), in connection with the develo~ment of the
development of property designated as Block 9.02, Lots 15.03 and 15.04, Block
114, Lot 1 and Block 115, Lot 1 on the Borough's Tax Map; and
WHEREAS, the Borough Council desires to authorize the Mayor and Municipal
. Clerk to exeGute the second amendment to the Developer's Agreerpent in the
substantially the same form as that attached hereto as Exhibit A.
NOW, THEREFPRE, BE AND IT IS HEREBY RESOLVED by the Mayor
and Council of Borough of Carteret, in the County of Middlesex and the State of
New Jersey, as follows:
Section 1. The Mayor and Municipal Clerk are hereby authorized and
directed to execute the Second Amendment to the Developer's Agreement in
substantially the same form as that attached hereto as Exhibit A.
Section 2. . This resolution shall take effect innnediately.
