Direct the City Clerk to defer the second reading until the conditions recommended by the Planning Commission have been met. 2 ""~ \ ~1 3 CITY COUNCIL MEETING OF NOVEMBER 18, 1997 i' 10. .ZONING ORDINANCE AMENDMENT~ZOA 97-06: REVISIONS TO SECTfONS 25-2, 25-2.2, 25-4.1, 25-4.2 C, 25-4.5 AND 25.4.6 REGARDING ACCESSORY STRUCTURES AND ILLEGAL CONVERSIONS Comments: The City of Lynwood is proposing to .amend several Zoning Ordinance Sections dealing with accessory structures in order to help reduce opportunities for the illegal, conversion of accessory structures to residential use and to specify the requirements for deconverting illegal accessory structures to a legal use. A definition of the PRD zone is also proposed to be added to the list of residential zones, and ordinance provisions are being renumbered to reflect the addition of a new ordinance section. Recommendation: Staff respectfully requests that, after consideration, the City Council: 1. Certify that the Ordinance amendment will not have a significant effect on the environment and that a Negative Declaration has been prepared pursuant to requirements of the California Environmental Quality Act. 2. Introduce and adopt Ordinance N0. ,amending Sections 25- 2.1, 25-2.2, 25-4.1, 25-4.2c, 25-4.5 and 25-4.6 of Chapter 25 of the Lynwood Municipal Code to modify requirements relating to accessory structures and amending certain sections of Chapter 25 of the Lynwood Municipal Code. 11. Also stated Council should be more responsive to the residents. ' Carmen Barraza stated she is not in favor of pre judging individuals. Adolph Lopez 11431 Plum St. discussed certain issues that come up because it is election - ~ time, and .asked that everyone conduct a clean election and have pride in their accomplishments. COUNCIL ORALS Councilman Rea discussed allegations made against a Councilmember, and informed residents that they have. an obligation to report any wrongdoing to the proper authorities. Directed staff to revisit complaints and concerns submitted this evening. from. Precision Auto, and Ms. Sanders regarding her Senior Grant. Reminded all residents to be prepared for `°EI Nino", and informed residents that. sand bags are available at both Fire Station l and.. 2. Requested stronger enforcement on the issuance of citations for loud parties, and the. importance of addressing safeguards for the upcoming "El Nino" predictions. Thanked the residents for the past four years. Councilman Rea issued rebuttal arguments to comments made during Council orals, and stated he is happy to have served for the past eight years. Mayor Richards discussed .key issues involved in Propositions T & U, and responded to questions posed by residents. Honorable Mayor and Members of the City Council FROM: Faustin Gonzales, City Manager ~~ " BY: Emilio Murga, Director of Public Works, Assistant City ger Gary Chicots, Director of Community Development SUBJECT: First "reading of Zone- Change 97-01 to change. the zoning of Assessor's 'Parcel No. 6170-019-029 from C-3 Heavy Commercial to R-1, .Single . Family Residential.. PROPOSAL " To secure City Council adoption of the attached ordinance changing the zoning classification of Assessor's Parcel No. 6170-019-029 at 11157 Bellinger Street from C-3, heavy commercial to R-1, single family residential zoning. FACTS The applicants, Mr. and Mrs. Villanueva, are requesting that the city rezone their property at 1.1157 Bellinger Street from C-3 to R-1 zoning. The applicant has the property for sale. However, the buyer is having a problem finding .financing because the site is ` . developed residential but it is zoned for Commercial development. The banking industry ` is reluctant to lend in this situation. Therefore, they are requesting the zone change to facilitate the sale of the property. The" General Plan designation for the site is Single Family Residential. This zone change would bring the zoning into conformity with the General Plan. Conformity between the zoning and the General Plan is a requirement of state law. The property also has; a commercial building on the rear of the property that is currently bei..ng .used as a .residence. The Planning Commission has conditioned their recommendation, that this building shall be removed prior to final approval of the.zone change so that a non conforming situation is not created. . DISCUSSION ® Thy proposed rezoning will redesignate the' applicant's property from Commercial to Single Family Residential zoning. The rezoning will bring the property in to conformity. with the .existing use and the General Plan designation. PUBLIC RESPONSE Staff has received no phone calls or inquiries regarding the proposed rezoning. Nor have ,any written comments been received. . COMMUNITY IMPACT The rezoning will not have "a negative effect on the values of the surrounding properties or interfere with or endanger the public health, safety or welfare. The rezone will make the property a conforming use therefore, eliminating the resale/financing problems of a nonconforming property. The applicant. has the property up for sale, however, the buyer is having a problem finding financing because the site is developed with two single family residences but it is zoned for Commercial development. The banking industry is reluctant to lend in this situation. Therefore, they are requesting the zorie change to facilitate the sale of the property. Tl~e General Plan designation for the site is Single Family Residential, this zone change would actually bring the zoning into conformity with the General Plan. Conformity between the zoning and the General Plan is a State Requirement. ANALYSIS AND ONCLU ION 1. Consistency with the eneral Plan and Zoning Ordinance The zone change will make the zoning consistent with the General Plan. The. property, however, is developed with a single family detached house and a commercial building that is now being occupied as a residence. This building has never been authorized for residential occupancy and will have to be removed when the property is zoned residential. 2. A definition of the PRD zone is also proposed to be added to the list of residential zones to correct an oversight. Discussion The City has had major ongoing problems with the illegal .conversion of garages and other accessory buildings into - residental units. Staff and the Planning Commission have prepared amendments to the Zoning Ordinance in order to make it more difficult to .make such conversions and to strengthen and clarify requirements for deconversion. The significant ordinance changes being proposed are summarized below. 1. The definition of "rumpus room" is being changed to clarify that .such rooms must be attached to the main dwelling. _ • 2. Cabanas are being deleted as a permitted use in any residential zone. 3. a new subsection is being added to list the PRD zone as one ~. of the residential zones (this is to correct an oversight). 4. a new section is being added to impose special restrictions on accessory buildings. These restriction prohibit conversion, requires deconversion and restricts the location and types of cooking and plumbing fixtures that can be provided in an accessory building or structure. The subject business has been an object of concern to Staff because of.the constant violations of the Code . Since 1994- the laiv enforcement agency of the City has. received numerous complaints ranging. from: violent assault involving fire arms; alcoholic related incidents; robbery; theft of personal property; ~ ` possess.ions of a controlled. substances for the purpose ' ' of sales; sales o~f al coholic beverage to minors; ~. brandishing weapons; possession of stolen merchandise; improper usage of surrounding areas by gang or uncontrollable youths;. etc. ` 7. The subject property has been an object of concern to the residentialneighborhood with the frequency.of complaints varying in intensity. .Earlier this. year,. the law enforcement agency of the City received a petition (See exhibit 2) with approximately 8OO signatures complaining about the activities taking place because~of `. said .establishment lack of control. over the customers. BACKGROUND: Community Development staff has informed the property and business owner by letter regarding the-violations existing at the . - site and all attempts. to obtain compliance from the property owner have been unsuccessful. THIS CITY COUNCIL therefore declares, pursuant, to Section 4-9.5 of the Lynwood Municipal Code that the above described conditions constitute a public nuisance meriting the revocation of the City business license, the' <-~ abatement of-which is appropriate under Police Power of the City of Lynwood; and, Section. 4. Luciano, respectively,-are ordered and directed to surrender their City business license- #875Q and to effect the closure of the business, no .less than ten (10) working days after receipt of notice of the adoption of this Resolution and Order. We and our families have been inconvenienced and threatened by some or all of the following activities which have occurred and continues to occur.at the market: These activities threatens our safety and the peace of mind as we live and raise~our children in this neighborhood. • :numerous gang members which use the parking lot of the business as a congregation point - • drug sales~at the location - adults and minors who openly consume alcoholic beverages on the premises • blocking of the street by vehicles •intimidation to pedestrians using the sidewalks adjacent to the business by gang members which congregate in the business' parking lot • gun shots - • robberies at the location • murders at the location • fearing the potential for violence, we take alternative streets in order not to pass by ® the market • the purchase of alcoholic beverages and cigarettes by minors • the sale of cigarettes and alcohol by persons using government food. stamps as payment • we fear for the safety of our children who ptay in our own yards in front of our houses It is our intent to live in a neighborhood free from fear, threats and intimidation. BACKGROUND: On October 7, 1997, City Council adopted Resolution No. 97-180, declaring its intention to vacate and abandon the above mentioned alleys and set the public hearing date for November 4, 1997. Staff sent out notifications to all affected utility companies informing them about the City's intention.. ANALYSIS: To date, staff has not received response from all of the affected utility companies, and hereby requests that a continuance of the public hearing be approved to provide all affected utility companies additional time to submit their responses.
