HomeMy Public PortalAbout1992-027Member M(yQnt°l/ introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 9a, � % RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR AN ACCESSORY STRUCTURE TO GREG AND LINDA SCHERER WHEREAS, Greg Scherer and Linda Scherer (Applicants) have requested a conditional use permit in order to construct an accessory building on their property located at 1022 Medina Road; and WHEREAS, the City's zoning ordinance requires a conditional use permit for accessory structures of more than 3,000 square feet; and WHEREAS, the Applicants' proposed accessory building will contain approximately 4,088 square feet; and WHEREAS, this application was reviewed by the planning commission on March 10, 1992, and by the city council on April 6, 1992; and WHEREAS, it has been determined that construction of the proposed accessory structure will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants to construct an accessory structure at the above address, subject to the following terms and conditions: 1. The accessory building may not exceed a footprint of 2,250 square feet and may not contain more than a total of 4,500 square feet; 2. No more than six horses may be maintained on the property; 3. The accessory structure may be used for keeping and riding horses as an accessory use to a single family dwelling and no commercial use may be made of the structure; 4. No living facilities are permitted in the accessory structure; RRB33145 ME230-150 5. The Applicants must completely remove the existing barn and replace it with the new accessory structure; 6. The Applicants must maintain all fencing on the property in good repair; 7. Manure must be disposed of in accordance with the standards of the City and the Minnesota pollution control agency; and 8. The Applicants must pay to the City a fee in the amount determined by staff to represent the actual cost to the City Qf reviewing this conditional use permit application. Dated: al , 1992.
