March 30, 1982
The Council of Bal Harbour Village met Tuesday, March 30, 1982 at 9:30
A.M. in the Village Hall.
Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray
Also present were Fred W. Maley, Village Manager; Mary T. WetteLer, Village
Clerk and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Sherman and voted the minutes
of February 23, 1982 were approved as presented.
Mr. Maley reported that bids were opened on March 29th for the Collins
Avenue and 96th Street lighting project which includes roadway, sidewalk and
the Collins Avenue median strip. TWo bids were received from the five contract-
ors who took out plans; Southeastern Electric System, Inc., $278,580 and Isern
Engineering, Inc., $339.000. It is his recommendation, and that of our con-
sulting engineers, that the contract be awarded to Southeastern Electric Services,
Inc. Inasmuch as this pLuject was not completed during the last fiscal year money
will be transfarmed fLum Fund Balance for the contract. He said according to
the time table for fixture delivery the project should be completed by the end
of September. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted that
the contract be awarded to Southeastern Electric Services, Inc.
Mr. Stanley Whitman of the Bal Harbour Shops introduced Mr. Arnold Ramos
of Mid -South Engineering Co. Mr. Ramos explained through the use of sketches
the present Bal Harbour Shops' entrances and the following proposed changes:
The main entrance on Collins Avenue would be closed and moved to Bal Cross Drive,
east of Park Drive; the present south drive would be relocated to align with the
north end of the Sun Bank island; and the bus and taxi pull -off lane fLum Collins
Avenue would be eliminated. The reason for the relocations is to transfer the
stack up of cars for ingress into the Shops to Bal Cross Drive. However, no bus
or truck traffic would be allowed at the Bal Cross Drive entrance They will apply
to Dade County and the Department of Transportation for relocation of the traffic
signals. Mr. Samuel Leigh, President of the Balmoral Condominium Association,
Lead a statement from the owners requesting that the Village deny the application.
Also speaking against the proposed entrance change was Mrs. Suzanne Hipyins, Pres-
ident, and other owners in the Fairfield Manor Apartments. Mr. Charles Sacher,
attorney for the Fairfield Manor owners, pointed out that Bal Harbour Shops
should not be able to infringe on the rights of private citizens. Objections
were also heard from representatives of the Tahoma Apartments and the Bal Harbour
Environmental Association. Mr. Chuck Conkling of the Florida Department of
Transportation remarked that the new entrance location would help the Llaffic
flow on AlA. Councilman Sherman told those present that he had made a survey
of cars stacking up on Collins Avenue and found the count to be more than that
claimed by Mr. Ramos. Also that the proposed new main entrance would create a
traffic jam in front of the Tahoma and Fairfield Manor Apartments and not permit
Balmoral residents to enter the south bound lanes of Collins Avenue after their
"U" turns north of their building. Miss Gray pointed out that the sketches
did not allow for pedestrians coming from the residential section on Bal Cross
Drive. In answer to a question of who owns Bal Cross Drive, Mr. Gold said that
in his May,1978 opinion to the council he feels that all owners have the right to
use the streets. After further discussion Miss Gray craved that the proposal be
denied. Mr. Dan Paul, attorney for the Bal Harbour Shops said the motion was

out of order due to the fact that the Bal Harbour Shops had made no formal
request. The item was deferred until Bal Harbour Shops makes a formal request.
Mr. Gold Read
Ordinance No. 237
regulating noise in the Village in full. It was moved by Mr. Sherman,
seconded by Mr. Beatty and voted that the ordinance be adopted on final reading.
The Village Clerk read
Ordinance No. 238
amending the Employee's Pension Plan by title. On n tion of Miss Gray,
seconded by Mr. Beatty, and voted the oftlinance was adopted on final reading.
Mr. Maley reported that Representative Kuten's Bill to raise the Resort
Tax to 3% had passed, even though Surfside, Bat Harbour and the Bal Harbour
Resort Association had opposed it. He said Mayor Printup has written the
Governor asking that he veto the Bill. The Bill provides that each munici-
pality will have to hold a referendum to pass the additional one -cent tax
if the Governor signs the Bill
The Village Manager explained that in order to achieve the most efficient
use of the Village's Burroughs computer, that the system be modified to use
a Fixed Disk Memory. After discussion on motion of Mr. Taplin, seconded by
Miss Gray and voted, Mr. Maley was authorized to modify the system at a cost
of $7,153.00
Mr. Maley said that the Dade League has requested Dade County
to ban armor piercing bullets, except for Police use and is asking the cities
to join the request. It was moved by Mr. Beatty, seconded by Miss Gray and
voted that Bal Harbour concur in this and Mr. Gold was instructed to draw
a Resolution requesting Dade County to ban this type of bullet except for
police use.
Mr. Maley said that State lawprovides that municipal police departments
may mutually aid one another under written contracts. Dade County is presently
desirous of entering into mutual aid agreements with the municipalities, but
he is concerned about the language in their proposed agreement. He would
like to have agreements with Surfside and Bay Harbor Islands. The council
referred the matter to Mr. Gold for research.
Mr. Maley said that a traffic hazzard exists at the entrance to the
Bal Harbour Club due to people stopping their cars before entering due to the
height of the sidewalk. He requested that the contractor now building the
bus -bay be authorized to lower 32' of sidewalk at a cost of $3,940. This
amount is more than offset by unclaimed Resort Tax matching advertising funds
generated by the Club. It was moved by Mr. Sherman, seconded by Miss Gray
and voted to contract with Martell and Sons, Inc. to lower the sidewalk.
The Village Manager reported that he and the consulting engineers for
the village are suggesting that the village have an architectural competi-
tion among three firms selected to provide designs for the maintenance and
storage garage Each firm would receive a $2,5000 stipend to prepare their
concept. It was the council's decision that only one firm should be selected
to work under the consulting engineers and Mr. Maley should ask Ludovici and
Orange to recommend an architectural firm for the council's approval.

Mr. Maley told the council that under the contract with P.B.A. all
officers covered under the contract are to receive a 3% salary raise on
Aril 1, 1982. He said he believed it would be appropriate to extend this
raise to all employees. The cost would be $6,300 for the officers or
$16,800 for all employees. After discussion on motion of Mr. Taplin, seconded
by Mr. Beatty and voted all village employees were given a 3% raise as of
April 1, 1982.
On motion of Mr. Sherman, seconded by Miss Gray the meeting was
adjourned at 12:10 P.M.

COUNCIL MINUTES
April 27, 1982
The Council of Bal Harbour Village met Tuesday, April 27, 1982 at 9:30 A.M.
in the Village Hall.
Present: Messrs. Beatty, Printup, Taplin and Miss Gray
Absent: Mr. Sherman
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village
Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of
March 30, 1982 were approved as submitted.
Mr. Maley reported that the Street Lighting Contract has been signed and
work should be completed by October. The Residential Storm Sewer work should
begin next week. Mr. Maley also reported that the main Cable Television cables
have been connected and the residents are being contacted. Residents of the
Balmoral spoke of their experience with cable installation.
Mr. James Rizzo, our retirement plan acturial consultant, reviewed the
status of the plan with the council and reported that the fund had done very
well last year.
Mr. Gerry Gutenstein of the Resort Tax Advisory Committee said the committee
had discussed the use of a celebrity to promote Bal Harbour, and wondered how the
council felt about this idea. It was suggested that the committee explore both
Bert Parks and Arthur Godfrey. Mr. Gutenstein also suggested that it would
be nice to have chickee huts on the beach for shade. He said he has a cost
figure of $650.00 for a 10' x 10' hut. Mr. Maley said he would write the pro-
perty owners to see if they would like them in front of their property.
The council considered the operating statements for the first six months'
operation in all deparIm nts. It was suggested that excess cash investments
be diversified. On motion of Miss Gray, seconded by Mr. Beatty and voted the
statements were filed for audit.
