GPA 96-01 AND ZONE CHANGE CASE NO ZC 96-01 APPLICANT: CITY OF LYNWOOD Comments: To request that Council amend the General Plan designation from Commercial to Multi-Family and the zoning from C-2 and R-2 to R-3 (Multi-Family Residential) for approximately 3.6 acres of land north and south of Olanda Street bounded by Cookacre Street on the west and Atlantic Avenue to the East in order to develop sixty-five (65) single family detached residences. The proposed change covers lots 16, 17, 21, 22, 25, and a portion of lot 15 of Tract 7099, as recorded in Book 101, pages 6 and 7, County Recorders Office. Recommendation: Staff respectfully requests that after consideration, the City Council: 1. Certify that General Plan Amendment GPA 96-01 and Zone Change ZC 96-01 will not have a significant effect on the environment and that a Negative Declaration has been issued pursuant to the provisions of the California Environmental Quality Act and State CEQA Guidelines. 2. Adopt Resolution No. approving General Plan Amendment, Case No. GPA 96-01 changing the General Plan designation for the northerly portion of the subject property from Commercial to Multi Family Residential. 3. A RESOLUTION OF THE CITY OF LYNWOOD ASSESSING THE COST OF ABATEMENT AT 2955 AND 2957 POPLAR DRIVE, LYNWOOD, CALIFORNIA Comments: The City Council is requested to adopt a resolution assessing the cost of abatement existing at 2955 and 2957 Poplar Drive, generally known as Tax Assessor's Book No. 6170, Page 023, Lot 006, in the City of Lynwood, California. Recommendation: It is recommended that the City Council adopt the attached resolution. PROPOSED UNDERGROUND UTILITY DISTRICT N0. 11 SETTING OF PUBLIC HEARING Comments: The construction of the new high school on the south side of Imperial Hwy, between Cornish Avenue and 50 feet East of .lackson Avenue, has required the removal of overhead utilities on Imperial Hwy. Recommendation: It is recommended that the City Council adopt the attached resolution entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD SETTING A PUBLIC HEARING FOR THE FORMATION OF THE UNDERGROUND UTILITY DISTRICT N0. 11". ~ ~ 13. ACCEPTANCE OF BELLINGER STREET AND tORRAIN STREET IMPROVEMENT PR0IECT .Comments: On January 2, 1996 City Council awarded a contract to All American Asphalt, Inc. for the Bellinger Street and Lorrain Street Improvement Project. The project started February 12, 1996 and was completed. on February 29, 1996. Staff conducted a final inspection on March 1, 1996 and found that all work had been completed satisfactorily in accordance with project plans and specifications. Recommendation: ~It is recommended that the City Council adoptthe attached resolution accepting the Bellinger Street and Lorrain Street Improvement Project, Project 5-5168, as being completed in accordance to project plans and specifications. 14. PROPOSED MERGER BETWEEN WESTERN WASTE INDUSTRIES AND USA WASTE SERVICES, INC. Comments: Western Waste Lndustries is under contract with the City of Lynwood for the collection of solid waste from all residential, commercial, and industrial premises in Lynwood. A stipulation in the. contract between the City and Western Waste Industries provides that no interest in the Contract may be sold, assigned or transferred to any other person, firm or corporation without first obtaining the approval of the City. Recommendation: Staff requests that the City Council adopt the attached ..resolution authorizing, consenting to, and approving the merger transaction between Western waste Industries and USA waste services, Inc.. 4 ~ ~ 15. RESOLUTION SUPPORTING SB1590 (GUARDING CASE) Comments: In mid-December, 1995 the Supreme Court decided the case of Santa Clara County Local Transporation Authority vs. Guardino. The decesion, which overturns prior Apellate Court decesions to the contrary, requires that voter approval be obtained prior to imposing general or special taxes. SB1590 would assure that the Guardino decesion not be applied retroactively thus mitigating a potentially devastating loss of revenue in many California cities, including Lynwood. SB1590 should be supported. Recommendation: That Council adopts the attached resolution. 16. HUMAN RELATIONS MUTUAL ASSISTANCE CONSORTIUM Comments: The County Board of Supervisors for the County of Los Angeles through the Commission on Human Relations for the County of Los Angeles has endeavored to unify efforts to improve inter- cultural and inter-racial understanding through developing a consortium including various agencies throughout the County of Los Angeles. It is the desire of the County of Los Angeles to enter into agreements with all agency members of the consortium to promote civic. peace and improve human relations as well. as inter-group understanding. It has. been recommended by members of the city Council that the Community Affairs Commission be the City's representative to this Consortium. The staff assigned to this Commission is the Recreation and Community Services Department. Recommendation: Staff respectfully recommends that the City Council for the City of Lynwood. approve the attached "Human Relations Mutual Assistance Agreement." • • 17. LOS ANGELES COUNTY PARK, BEACH AND RECREATION ACT 1996 Comments: This year, the Trust for Public La d (TPL), which was involved in the 1992 Proposition "A" campaign, is organizing a November 1996 proposition, modeled after the successful 1992 campaign. The Los Angeles County Park, Beaches & Recreation Act of 1996 will provide approximately S270 million in bonds to generate additional acquisition and capital improvement funds for qualified regional and neighborhood parks, recreation and cultural facilities,. at-risk youth projects and beaches through out the County. The per parcel allocation estimated for Lynwood is 5157,500. Recommendation: 1. To have the Mayor and City council of the City of Lynwood. authorize staff to prepare proposed projects for possible inclusion in the Specified Project Portion of the funding through the Los Angels County Park, Beach & Recreation Act of 1996. 2. To authorize staff to apply for Specified Project Grant funds for the tasks noted in this document. These specified Project Grants if approved by the Trust for Public Land to be included in the Bond Measure, and if approved by the voters in November 1996, will be available to the City of :Lynwood: 3. To have the Mayor and City Council of the City of Lynwood adopt the attached resolution confirming authorization and support of Items 1 and 2. 18. DIAMOND JUBILEE PROMOTIONAL ITEMS Comments: The City is celebrating its 75th Diamond Jubilee Anniversary this year. As a result. of this event, the City will be preparing souvenir and other commemorative items in recognition of this special birthday celebration. Don Martin of Entertimement Company is a local vendor who specializes in custom gifts and accessories for this type of special event programming. Mr. Martin requires S500 for research ahd development of various items that the Lynwood City council may approve relative to the 75th Anniversary commemorative items collection. Recommendation: That the Lynwood City Council approve the .payment of .5500 to research and develop various promotional and commemorative items relating to the Diamond Jubilee Celebration. 6 ~ • 19. .NOMINATIONS Comments: At Council's regular meeting of February 20, 1996 .announcement was made of a current vacancy on the Community Development Block Grant Advisory Board. Recommendation: Nominations at Council's regular meeting of March 5, 1996. Appointment at Council's regular meeting of March 19, 1996. 20. INFORMATION ONLY Comments: Information has been received that Youth Commissioners Predijios Cendejas, Rasheed Gregory and Lizeth Gutierrez have .been absent for 3 meetings. . In order to comply with City Ordinance No. 1356, which states " Three absences within a twelve month period, shall constitute a vacating of the position for boards, ~cornmissions, or committee meetings held once a month" it is requested that notification be made of 3 current vacancies on the Youth Commission. IN THE COUNCIL CHAMBERS OF THE CITY HALL, 11330 BULLIS ROAD, CITY OF LYNWOOD, CALIFORNIA. s LYNWOOD CITY COUNCIL ,_.,FEBRUARY.20, 1996 The City Council of the City of Lynwood met in a Regular Session in the City Hall, 11330 Bullis Road on the above date at 7:33 p.m. Mayor Richards presiding. Councilmembers Heine, Henning, Rea and Richards answered the roll call. Also present were City `Manager Gonzales, City Attorney Rudell, City Clerk Hooper and City Treasurer Pygatt. It was moved by Councilmember Henning, seconded by Councilmember Rea-and carried to excuse Councilmember Byrd. City Clerk Hooper announced the Agenda had been duly posted in accordance with The Brown Act. It was moved by Councilmember Henning, seconded by Councilmember Rea and. carried~to approve the following minutes: a) Regular Meeting, February 6, 1996 Councilmember Henning announced a presentation that was made to the St. Francis Medical Center Trauma Center, Director of Recreation & Community Services Davis, announced celebrations in association with Black History Month and Sheriffs Captain Herrera introduced Charles Porter the newly appointed Traffic Supervisor. Mayor Richards reordered the Agenda in order to hear discussion and take action on item #12, Recycling Center, item #18, Proposed Pilot Program for Part-Time Community .Development Liaison Specialist, and .item #20, California Executive Academy, and Public Orals related to these items. City Attorney. Rudell stated subsequent to the posting of the ' formal agenda, a matter. involving Public Employee .Discipline/Dismissal/Release has been brought to the Councils attention. It was moved by Councilmember Henning, seconded by Councilmember Heine to continue the item pending clarification of certain issues. City Manager Gonzales offered an overview of the estimated costs. Councilmember Rea questioned whether or not the residents that participate in the recycling program will be exempt from the recycling bin fee that is already in effect. Hearing no further discussion, Mayor Richards clarified that the item would be brought back after. further review by Council and staff. It was then moved by Councilmember Henning, seconded by Councilmember Heine to adopt: APPROVAL OF A PART-TIME COMMUNITY DEVELOPMENT LIAISON SPECIALIST AS A PILOT PROGRAM FOR A SIX MONTH PERIOD AND DIRECT STAFF TO IDENTIFY THE APPROPRIATE FUNDING SOURCES. Spoke in opposition to the proposed loitering ordinance. City Attorney Rudell stated he had received a request from Pacific Pipeline, Incorporated to delay adoption of the ordinance. However, they had been informed that Council would adopt the ordinance and any recommendations could still be considered and the ordinance could be amended at a later time. It was then moved by Councilmember Henning, seconded by Councilmember Rea to adopt: • • ORDINANCE #1429 ENTITLED: "AN ORDINANCE AMENDING SECTION 25-4.2 C 3, 6 AND 12, OF CHAPTER 12 OF CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE TO DELETE CARPORTS, PORTE COCHERES AND COMMERCIAL RADIO AND TELEVISION TRANSMITTING ANTENNAS AS PERMITTED USES IN THE R-1 (SINGLE FAMILY) AND R-2 (TWO FAMILY) RESIDENTIAL ZONES, TO MAKE RELATED CHANGES IN SECTION 25-4.6 c.3 AND SECTION 25-16.4 AND TO MOVE A PORTION OF SECTION 25-4.2 c.12 TO SECTION 25-4.7 SPECIAL REQUIREMENTS". Council received and filed: RESIGNATION OF COMMISSIONER MARSHA WILLIAMS ON THE COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD. PUBLIC ORALS Adolph Lopez 11431 Plum St. discussed the proposed ordinance pertaining to minors, and it's purpose of protecting the community. Dr. Jaquez discussed truancy issues and questioned any input from the School District in the preparation of the item. Also discussed support against the closure of the E.D.D. Robert Bristol spoke in opposition to the proposed loitering ordinance. Salvador DeLaTorre discussed the lack of truancy law enforcement by the school district. Feels the proposed loitering ordinance is important. Benjamin Miranda discussed youth problems in the city. Lucy Hernandez 3973 Lugo Ave. does no agree with the loitering ordinance. Justin, 5146 Martin Luther King Jr. Blvd. spoke in opposition to the loitering ordinance. Alberto Valencia introduced himself as a Block Watch Captain. Derrell Hunter discussed excessive laws on youth, and the need for restroom facilities along the green line. Repeated requests for street repairs along Ernestine. Arturo .Reyes discussed the proposed ordinance pertaining to loitering and the need for regulations in the city. Also discussed the need for a better attitude from Code Enforcement. Dr. .Jaquez discussed a previous encounter with the Sheriffs Department. Bill Cunningham discussed problems within the School District involving truancy issues. Mel Brown discussed the pros and cons involved with the proposed truancy ordinance. Also discussed Western Waste Industries and • • the Community Development Liaison Specialist position. The proposed change covers lots 16, 17, 21, 22, 25, and a portion of lot 15 of Tract 7099, as recorded in Book 101, pages 6 and 7, County Recorders Office. Project Characteristics: The General Plan Amendment (GPA 96-01) and associated Zone Change (ZC 96-01) would allow for residential development of this property to a density of approximately 18 dwelling units per acre, either attached or detached. The Redevelopment Agency has previously approved in concept a development proposal for this property consisting of sixty-five (65) single family detached residences on individual lots, with common open space. A Tentative Tract Map, Conditional Use Permit application and variance request for this development was heard by the Planning Commission on February 27, 1996. DISCUSSION: Project Consistency with General Plan The proposed residential development of this property is inconsistent with the existing zoning classification and portions of the General Plan designation. The General Plan Amendment and Zone Change, if granted, would make the proposed development consistent with the General Plan and Zoning. The proposal is consistent with Land Use Goal No. 1 ("Provide a balanced mix of land uses which takes advantage of the unique position of Lynwood in relation to the region"), Land Use Policy No. 2 ("Develop programs for eliminating inconsistencies between existing land uses and those incorporated within the General Plan") Area Suitabilitv The surrounding area is primarily developed with mixed residential and commercial. The property to the north is developed with multi- family residential at a similar density of 18 units to the acre of the proposed project. The proposed amendment and zone change is compatible with existing development in the area. Public Response The Community Development Department has received two letters in opposition toa=-the proposed plan amendment and zone change. The authors both state that the proposed residential development would result in increased crime, violence drugs and other problems. The first letter states a preference for commercial development of the property. Planning Commission Action On February 13, 1996, the Planning Commission approved the proposed General Plan Amendment and Zone Change and recommended approval of the proposal by the City Council. During discussion, two Commissioners expressed concern about inadequate open space and play areas. RECOMMENDATION: Staff respectfully requests that after consideration, the City Council: 1. Certify that General Plan Amendment GPA 96-O1 and Zone Change ZC 96-01 will not have a significant effect on the environment and that a Negative Declaration has been issued pursuant to the provisions of the California Environmental Quality Act and State CEQA Guidelines.
