HomeMy Public PortalAbout1992-036Member Thi eS introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. CO - 3b RESOLUTION GRANTING A VARIANCE FOR ROBERT HEBZYNSKI AND CONNIE HEBZYNSKI WHEREAS, Robert Hebzynski and Connie Hebzynski (Applicants) have requested a variance to reduce the required lakeshore setback from 75 feet to 51 feet to construct a three season porch on their house at 3075 Lakeshore Avenue, which is legally described as Lot 6, Block 8, Independence Beach, Hennepin County, Minnesota; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minnesota Statutes § 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request and has recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for the above variances is granted, subject to the Applicants paying to the City a fee in the amount determined by staff to represent the actual cost to the City of reviewing this application. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance hereby granted is justified by the by the size of the lot, the unusual nature of Lake Independence properties and would be consistent with other variances granted previously in the area.
