HomeMy Public PortalAbout1992-038Member Jj introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-3 g RESOLUTION GRANTING FINAL APPROVAL FOR WINDEMERE ACRES WHEREAS, R. A. Olson and K. Dedeker (Applicants) have requested final approval for the plat of Windemere Acres; and WHEREAS, the planning commission and city council have reviewed this matter and have compared the final plat with the plat given preliminary approval previously . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final approval is granted for Windemere Acres, subject to the following conditions : 1. It is acknowledged and agreed that the existing sheds on Lots 3 and 4 do not meet setback requirements for animal structures and may only be used for storage; 2. When the existing septic system on Lot 2 fails or is replaced, the property owner must relocate the driveway from Lot 2 so that it accesses directly onto Outlot A; 3. The Applicants must construct a road on Outlot A to City specifications and enter into a private road agreement satisfactory to the city attorney regarding the road. Construction of the road will also require work on the ditch and replacement of the culvert on Medina Road; 4. Lot 1 must have ingress and egress from Outlot A and not Medina Road; RBB36295 ME230-144 5 . A driveway easement satisfactory to the city attorney must be recorded against Lot 3 for the benefit of Lot 2; 6. The Applicants must pay a park dedication fee in the amount of $4, 915 for the lots within the subdivision; 7. It is acknowledged that Lots 3 and 4 will have sufficient room for animal structures; 8. The Applicants must pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing this application; 9. The Applicants must post with the city a letter of credit in the amount of $ to ensure completion on the private road to city specifications; and 10. The Applicants must file the plat with Hennepin County within 60 days of the date of adoption of this resolution, after which time this approval becomes null and void. Dated: , 1992. ry M.
