W H E RE A S, the Village of Key Biscayne ("Village") desires to purchase a new CAT
TH255C Telehandler (the "Telehandler") to facilitate the day-to-day and emergency operations of
the Public Works Department; and
WHEREAS, the Village solicited multiple quotes for the Telehandler and obtained a
competitively bid quote by the Florida Sheriffs Association, which has entered into Contract No.
FSA23-EQU21.0 (the "FSA Contract") with Kelly Tractor CO. (the "Vendor"); and
WHEREAS, the Village Manager recommends that the Village Council approve the purchase
of the Telehandler utilizing the terms, conditions, and pricing of the FSA Contract; and
WHEREAS, the Village Council desires to authorize the Village Manager to purchase the
Telehandler from the Vendor in an amount not to exceed $128,015 in accordance with the Vendor's
quote (the "Quote") attached hereto as Exhibit "A"; and
WHEREAS, the Village Council declares the existing telehandler, a
__________ (the "Surplus Telehandler"), as surplus property that has become
obsolete, has outlived its usefulness, has become inadequate for the public purposes for which it was
intended, or is no longer needed for public purposes in light of the purchases authorized by this
Resolution, and to sell or otherwise dispose of the Surplus Telehandler; and
WHEREAS, the Village Council finds that this Capital Project Authorizing Resolution is in
the best interest and welfare of the citizens of the Village.

Section 1. Recitals. That each of the above-stated recitals are hereby adopted, confirmed,
and incorporated herein.
Section 2. Approval. The Village Council hereby approves the purchase of the
Telehandler from the Vendor.
Section 3. Authorization. The Village Council hereby authorizes the Village Manager to
purchase the Telehandler consistent with the terms and conditions of the FSA Contract and the Quote
attached hereto as Exhibit "A" in an amount not to exceed $128,015.
Section 4. Declaration of Surplus Property. That the Surplus Telehandler has become
obsolete, has outlived its usefulness, has become inadequate for the public purposes for which it was
intended, or is no longer needed for public purposes. Accordingly, The Village Council declares the
Surplus Telehandler to be surplus property.
Section 5. Authorizing Sale or Disposition of Surplus Property. The Village Manager
is authorized to sell or dispose of the Surplus Telehandler by public auction or other procedure
determined by the Village Manager to be in the best interests of the Village. Any surplus property
items acquired by the Village pursuant to governmental grant programs shall only be disposed of in
accordance with procedures and criteria applicable to such grant programs.
Section 6. Implementation. The Village Council hereby authorizes the Village Manager
to execute any purchase order or required documentation for the purchase described in this
Resolution, subject to approval by the Village Attorney as to form and legality, and to take any action
which is reasonably necessary to implement the purpose of this Resolution.
Section 7.
