Meeting of the City Council to order at 7:31 p.m..on._Tuesday, June 30, 1981, in the Council Chamber of the City Hall. 2. ROLL CALL: Present: Councilman- Atkins, Dennis, Gillanders, Tyrell, Merritt Absent: Councilmen -None. Also Present: City Manager Koski, City Attorney Martin, Fire Chief Harold McCann, Roy Buchan., Building and Safety Department, Associate Planner Chris Peterson, and Julie Estrada, Temple City Times 3. UNFINISHED BUSINESS: Aa CONTINUED PUBLIC HEARING: APPEAL. OF PLANNING COMMISSION DECISION - MODIFICATION OF ZONE VARIANCE CASE NO. 79 -565, 9094 LAS TUNAS DRIVE City Manager. Koski. stated_ the. public. hearing was.continued.from the June 2, 1981, .. City' Council. meeting., .. to_ a Study.. Session.. on June 15 to discuss..certain issueswith: the..Fire..Department.and Department of Building..and_Safety.. Fire. Department ..personnel_were..unable to attend the June..15.Study Session_and_the=.public.hearing was.continued to an adjourned.: meeting ;June.30,_1981...Chief_.McCann has submitted a summary of -Fire Department requirements for the proposed use. Counc.ilman:Tyrell. stated ..his._concerns.are..resolved by conditions 1 through_.6 as_outlined:in.the.. summary ...of._Fire.Department.require - ments and•_inquiredwhether.Mr. Bender has had the opportunity to review the proposed requirements. Mr. Bernard Bender, 1114.Rancho.Road,,Arcadia, responded, stating he feels.. the. requirements.- are very_ stringent. possibly..making the project.economically unfeasible.._._He._felt_that if he had an opportunity.to work_with..the..fire_officials he could propose a s.tructure_which would. provide. a storage._ facility. that would satisfy. both. the.Building.Department.and Fire Department in meeting adequate safety standards. Counc.ilman.Tyrell stated_he_would..like..to.see.a condition requiring the tenants.sign.a.r.elease._to the_Fire Department for inspection of their.portion of the _building.to.safeguard_against the unsafe storage_of.materials.. Also_he.would.like_to.see security per - s.onnel.. have -_ master keys_to_each_.compartment.so that in the event of a fire, Fire Department can readily gain access, Councilman: Atkins expressed _.his_concern.about.public safety of surrounding areas, In his_opinion..any changes in_the Fire Depart - ment's recommendations should be equally strict. Councilman Gillanders stated he would want compliance with all six conditions.set forth in.the.Fire Department memo to satisy his concern with the safety of surrounding properties. Councilman.D.ennis.stated that..unless_ the Council..can.have some control_of..what_.can be.stored..in..an..industrial_ and /or.commercial storage facility, he would not be in favor of the project. Adjourned Meeting, June 30, 1981 — Page 2 Mayor Merritt stated there is a need for a structure of this type and if the applicant can meet the Fire Department require - ments set forth in their memo, he would approve the project. Mr. Bender stated the - Fire'Department -requirements would result in-a loss of'1,500 sq ft. of space and °inquired. whether it would be possible to go one-half story underground and maintain the same height. Chief McCann responded the storage: building in Rosemead is that type of building and there have been unique problems because of the underground portion of the building. Mr. Bender requested a continuance to September 15, 1981, to provide sufficient time for him °to meet with fire and building officials to review his plans and explore alternatives that would meet the provisions of the Uniform Building Code and Fire Code. Councilman Tyrell moved to continue the matter to September 15, 1981, seconded by Councilman Atkins and carried. Councilman Dennis requested staff to provide. Council with a list of those items which would be authorized for storage in the C -1 zone. 4. MATTERS FROM CITY OFFICIALS: A. Valuation.Report: 5839 and 5841 Camellia Avenue City Manager Koski presented a valuation report .for subject properties, which Council referred to .a Study Session. B. Councilman Dennis reported the League :of California.Cities has advised that any,proposed•resolutions,to..be considered at their annual meeting inn the fall : must : be: submitted to the Los Angeles Division of the League no later than July 17, 1981. RECESS: City Council recessedat.8:35 p..m...to a closed meeting for discussion of possible litigation with the City Attorney. RECONVENE: 1 Council reconvened at 8:47 p.m. Councilman Dennis moved to :approve the reappointment of Richard Abraham.: to -the Planning .Commission °for atwo -year term. effective July'l, 1981, seconded by Mayor Merritt and carried on a roll. call vote: Councilman. Atkins stated.: that on the basis Mrs..: Abraham was his campaign manager in his last: election to the Council, and al- though he thinks very highly of Mr. Abraham, he would abstain from voting. Councilman Tyrell requested the record show he has not partici- pated in any consideration by Council members in connection with this decision and would abstain on advice of Counsel. Councilman Dennis voted yes. Councilman Gillanders stated that by virtue of the Executive Session and reasons stated therein he would consider a no vote to be an exculpatory statement. He voted no. Mayor Merritt voted yes. Motion carried on a 2:1 vote (2 abstentions), Adjourned Meeting, June 30, 1981- Page 3 Councilman: Atkins moved to appoint Don Kelker to the Parking Commission for a two - year•. term:effective July 1, 1981, seconded by Councilman Gillanders -and carried. 5. ADJOURNMENT: On motion by Councilman Tyrell, seconded by Councilman Gillanders meeting adjourned at 8:59 to a: Study: Session with. the Parks and Recreation Commission, which meeting concluded at 9 :15 p.m. Next regular meeting_of. the -City Council will be held Tuesday, July 7, 1981, 7.30 p,m. in the Council Chamber of the City Hall.
