CITY OF MEDINA
RESOLUTION NO. Z=.?,z/J
RESOLUTION GRANTING CONDITIONAL USE
PERMIT TO WOODLAKE SANITARY SERVICE,
INC. FOR A METHANE GAS COLLECTION SYSTEM
WHEREAS, Woodlake Sanitary Service, Inc. (WSS) is the owner and operator
of a sanitary landfill accepting mixed municipal solid waste (the Landfill) ; and
WHEREAS, the Landfill is located within Medina on property described as
follows:
That part of the west one-half of the northeast quarter of
Section 8, Township 118 North, Range 23 west of the 5th
principal meridian in Hennepin County which lies of the
north and west of the center line of Tomahawk Trail, a
township road and
That part of the northwest quarter of Section 8, Township
118 North, Range 23 west of the 5th principal meridian in
Hennepin County lying north and west of the center line
of Tomahawk Trail, a township road.
; and
WHEREAS, WSS operates the Landfill pursuant to Conditional Use Permit
between the City of Medina and WSS dated February 7, 1984 ( the C . U . P .) and
pursuant to § § 827.09 et seq. of the Medina Code of City Ordinances; and
WHEREAS, WSS has petitioned for approval to install a system to collect and
burn methane gas generated by the mixed municipal solid waste within the Landfill
(the System); and
WHEREAS, the System has been reviewed by the City's environmental
engineering consultant for compliance with relevant standards of the Minnesota

Pollution Control Agency (MPCA) and for conformance with current engineering
standards; and
WHEREAS, the planning commission has reviewed the plans submitted by WSS
regarding the System and has recommended that the city council grant permission
for the installation of the System, with certain conditions; and
WHEREAS, the city council has reviewed the plans for the System and has
relied on the opinions of the City's environmental engineering consultant and the
planning commission in reaching the conclusion that WSS's proposed System is a
positive approach to the collection of methane gas generated by the Landfill and is
superior to venting methane into the atmosphere .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that a conditional use permit be granted to WSS for the installation
and operation of a methane gas collection system, subject to the following conditions:
1. WSS must install and operate the System in accordance with the plans
and specifications submitted to and approved by the City, which plans and
specifications are attached hereto as Exhibit A;
2. All portions of the Landfill and of the System must be open for
inspection by representatives of the City at all reasonable times;
3. Emissions from the System may not exceed MPCA standards at any time;
4. The flame of the gas burner must be designed and installed so as not to
be visible at any time;

5. WSS must employ persons trained and capable of maintaining all
components of the System. Such personnel must be on -site at the Landfill during
hours of operation Monday through Friday and available on an on -call basis at other
times;
6. WSS must ensure that noise levels of the System do not exceed 65
decibels at the perimeter of the Landfill, as determined in accordance with OSHA
sampling techniques;
7. WSS must obtain the necessary approvals from the MPCA before
beginning construction of the System;
8. This conditional use permit allows WSS to install the System in all areas
of the Landfill but WSS must inform the City of changes in technology as the System
is extended to other areas of the Landfill;
9. WSS must reimburse the City for all administrative costs and expenses
incurred by the City in reviewing this matter;
10. WSS acknowledges and agrees that the City retains the right to review
conditions at the Landfill or regarding the System and to amend the terms and
conditions of this conditional use permit as the City, in its sole discretion, may
determine to be necessary to preserve the public health, safety or welfare;

11. It is expressly understood and agreed that this conditional use permit
is in addition to and supplements the C . U . P . and that all terms and conditions of the
C . U . P . remain full force and effect; and
12. It is expressly understood and that agreed this conditional use permit
shall survive the closing of the Landfill on or before February 7, 1996 and shall
remain in effect for such period of time as the System is in operation.
NOW THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City
of Medina, Minnesota that a variance be granted to WSS to increase the height of the
stack of the methane gas collection system building from 30' to 40' on the grounds
that a height of 40' is necessary for the safe, efficient and inconspicuous operation
of the System.
