'?id y,6 RESOLUTION GRANTING PRELIMINARY APPROVAL FOR A PLAT TO DAVID KELM WHEREAS, David Kelm (Applicant) has requested preliminary approval of a plat of his property at 3175 Co. Rd. 24; and WHEREAS, the planning commission and city council have reviewed the preliminary plat submitted by Applicant. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota that preliminary approval is granted to the Applicant for his plat, subject to the following conditions: 1. The final plat must dedicate to the public the drainage and utility easements and road right-of-ways required by the city engineer; 2. The lot line from the previous division must be removed from the final plat; 3. The Applicant must dedicate an easement 33' in width along the entire west side of the property to accommodate a future road in that location; 4. The Applicant acknowledges that he has shared responsibility to build +I the road along the west side of the property when the road is needed in the future; 5. The Applicant must pay a park dedication fee for Lot 1; 6. The driveway for Lot 1 must be constructed and maintained as shown on the preliminary plat; 7. The Applicant acknowledges that the lots in this plat cannot be further subdivided under the city's current zoning ordinance or subdivision regulations RHB36282 ME230-154 because of the lack of adequate soils to support preliminary and secondary septic sites on additional parcels; 8. The Applicant must stake and preserve from disturbance a preliminary and secondary septic site on both lots; 9. It is acknowledged that the right-of-way to be obtained along the west side of this property is for use for a future city street and not for a realignment of Co. Rd. 201; 10. The Applicant must pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing this application; 11. The Applicant must submit a current abstract of title or registered property abstract covering all the land within the plat for review by the city attorney; and 12. The Applicant must submit the final plat to the city for approval within 180 days of the date of adoption of this resolution, which final plat must in all material respects conform to the preliminary plat, except that it must incorporate all changes and modifications required by this resolution.
