He thinks the wording should be changed to include all buildings. Mr. Gold said he would prepare the amendment to include existing buildings that do not already have shutters. The council took no action on a request of the City of North Miami Beach to mandate that smoke detectors be placed in all multi -family buildings. The council discussed the proposed relocation of the main entrance of the Bat Harbour Shops. Mr. Gold said he believed the village should hire a traffic expert to review the material that was submitted by Bal Harbour Shops and look at the area for impact and access. It was moved by Mr. Taplin, seconded by Miss Gray and voted that the village hire an expert as recommended by Mr. Gold. On motion of Mr. Taplin, seconded by Miss Gray the meeting was adjourned at 11:15 A.M. Mayor Attest: C Village Clerk April 27, 1982 COUNCIL MINUTES MAY 25, 1982 The Council of Bat Harbour Village met Tuesday, May 25, 1982 at 9:30 A.M. in the Village Hall. Present: Messrs: Beatty, Printup, Sherman, Taplin and Miss Gray Absent: None Also present were Fred W. Maley, Village Manager; Betty Carver, Deputy Village Clerk; and Clifford A. Schulman, Esq., representiif.Flan Gold, Village Attorney. On motion of Mr. Beatty, seconded by Miss Gray and voted, the minutes of April 27, 1982, were approved as submitted. Mr. Printup explained that Ordinance No. 228, regulating the installation of storm shutters and balcony enclosures in the Oceanfront District applied only to future buildings. Proposed Ordinance No. 239 amends Ordinance No. 228 to cover existing buildings. The first reading, by title only, was moved by Mr. Taplin, seconded by Mr. Beatty, and unanimously voted. After discussion fxvm the audience, Resolution No. 278 was passed, authori- zing retention of the professional services of David Plummer & Associates, traffic engineers, for a fee not to exceed $5,000.00, for the purpose of pre- paring a technical response to the application of the Bal Harbour Shops for a new entrance drive permit. May 25, 1982 Mr. Maley explained that we have no regulations regarding satellite disk antennas. He is to report to the next Council meeting his findings as to what the Village might require as to zoning, engineers, etc., after checking with the Village engineers. Mr. Maley explained that since the streets in the Residential Section were dedicated to the abutting property owners, in order to accomplish the proposed street resurfacing work, the cost must be assessed against the abutting property owners. The work is estimated at approximately $250,000, with $30,000 of this amount being for curb and gutter alignment within the Residential Section. This $30,000 will be paid by the Village, as the storm drainage system is owned by the Village. The remaining $220.000 would be assessed against the 231 residential lots benefitted, in a manner to be determined at public hearing. He further ex- plained that the 'procedure is spelled out in Florida State Law, and the Code of Bal Harbour Village, as to the public hearing and the notice of assessment. The proposed assessment roll should be ready within two weeks. The requirement is that there be two sets of hearings, one for passing a resolution formally estab- lishing and ordering the pLuject, and one for review and affirmation of the assessment roll. At the second hearing, the assessment roll will be discussed and the Council will sit as a board of equalization for the assessments. The resolution should be passed at the June 29, 1982, meeting, in order that the work can be completed by late fall. A motion was made by Mr. Beatty, seconded by Mr. Sherman, and passed, that the resolution be presented at the June 29th meeting of the Village Council. Mfrs. Maley reported that he, Mr. Taplin and Mr. Sherman met with Mr. David Wind of the Sun Bank of Bal Harbour regarding the investment of Village funds. Mr. Maley stated that currently there is in excess of $2 million in Certificates of Deposit of varying amounts and varying terms with the Sun Banks. It is Mr. Taplin's concern that these funds be diversified for security reasons. Mr. Maley explained that under a 1982 State law, all public deposits are centrally collat- eralized with the State Treasurer at the rate of 50% of the bank's public hold- ings. Should any bank run into difficulty, that pledge will be increased to 100%, as monitored by the State of Florida. Should any bank fail to honor a demand withdrawal of public funds, or not be able to repay public funds, the other banks collectively must guarantee that loss. Mr. Taplin feels the funds should be diversified to other strong lending institutions. Mr. Sherman feels that we can improve our interest rates significantly by competitive bidding. The Sun Bank has done a survey of four major banking institutions in the area, and find that they are first and second respectively in the 30 and 90 day CD's over the last five months, in amounts of $100,000 and over. It is the committees recommenda- tion that the funds be diversified into several strong lending institutions, based upon bids. The Sun Bank states they would have no objection, or loss of service to the city, if one-half of the coney is withdrawn. At the present time, the bank is furnishing all of its services without charge to the Village, as well as a repurchase agreement wherein our demand funds are invested overnight. As long as our funds remain around the $1 million level, there will be no loss of service with Sun Bank. On motion of Mr. Beatty, seconded by Miss Gray, the Mayor, Assistant Mayor and the Village Manager are authorized to sign new sig- nature cards for banks or savings institutions which are to receive our funds. Mr. Maley explained that the new light poles on Collins Avenue would have outlets on them for the use of Christmas decorations. There will be 65 poles on Collins Avenue and 96th Street. It will cost approximately $400 per pole, or up to $25,000, for high quality decorations. This money would be expended out of Resort Tax funds. It was Mr. Taplin's suggestion to expend one-half of that amount. Mr. Maley is receiving proposals from various Christmas decoration manufacturers, and will have all proposala to present to the Council at the July meeting. May 25, 1982 Mr. Schulman stated that their investigation of the former Saucy Crepe Restaurant has shown that the company was a "paper corporation". Those in- dividuals listed as being officers were really just employees of the restaurant, not the principal owners. Legal fees to collect $7,500 in unpaid Resort taxes from this out-of-state organization will exceed the taxes due. It was his recom- mendation that the suit be dismissed. The motion to dismiss the suit was made by Mr. Beatty, seconded by Miss Gray, and voted. On motion of Mr. Taplin, seconded by Miss Gray, and voted the meeting was adjourned at 11:05 A.M. kr( ( Mayor Attest: Village Clerk May 25, 1982 COUNCIL MINUTES June 29, 1982 The Council of Bal Harbour Village met Tuesday June 29, 1982, at 9:30 A.M., in the Village Hall. Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of May 25, 1982 were approved as submitted. The Village Clerk read Ordinance No. 239 regarding balconies and porch enclosures in the Ocean Front District in full for final reading. On motion of Mr. Taplin, seconded by Mr. Sherman and voted the ordinance was adopted. Mr. Maley referred to the letter he had sent to the council explaining the residential street resurfacing pruject. He said 231 lots will be assessed to cover the estimated $220,000 cost. The curb and gutter work will be paid by the village due to the Village's ownership of the storm sewer system. He said he had examined four separate methods of assessment as they relate to size of lots, front footage, land value and single and multiple family zoning use. A unit value method was chosen due to the diverse sizes, frontages, pruperty values and use of the properties. He has a commitment for a $220,000 unsecured loan from the Sun Bank of Miami at 10% interest, to cover the contract. Mr. Maley read Resolution No. 279, setting for the nature of the work, lots to be assessed and payment schedule.
