ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL SUBDIVISION PLAT OF CHERRY CREEK SUBDIVISION, SECTION THREE, A
SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, PDIL, LLC, owner of the real estate hereinafter described, having submitted to the City
Council a plat of said real estate, being located in Jefferson City, Cole County, Missouri, and being
part of Lot 5 and all of Lot 3 of Cherry Creek Subdivision Section One, in the City of Jefferson,
Cole County, Missouri, more particularly described as follows: Part of LOT 5 of CHERRY CREEK -
SECTION 1, as per plat of record in Plat Book 12, page 497, Cole County Recorder's Office, also
being part of CHERRY CREEK CONDOMINIUMS, as recorded in Plat Book 12, page 572, Cole
County Recorder's Office, and all of LOT 3 of said CHERRY CREEK - SECTION 1, City of
Jefferson, Cole County, Missouri, being more particularly described as follows: From the Northeast
Corner of said LOT 5; thence S84 039'02"W, along the northerly line of said LOT 5, 324.80 feet to
the POINT OF BEGINNING for this description; thence S6 006'21"E, 185.47 feet; thence
S4°58'52"W, 137.39 feet; thence S83 053'39"W, 139.66 feet; thence S6 006'21"E, 50.00 feet; thence
S83°53'39"W, 65.50 feet to the boundary of said LOT 5, also being the right-of-way line of Cherry
Creek Court; thence along the boundary of said LOT 5 also being the right-of-way line of Cherry
Creek Court, westerly on a curve to the left having a radius of 65.00 feet, an arc distance of 141.84
feet (Ch=S83 053'39"W, 115.33 feet) to the southeasterly corner of said LOT 3; thence along the
boundary of said LOT 3 the following courses: S83°53'40"W, 208.92 feet; thence N44 045'55"W,
97.65 feet; thence N6°06'20"W, 82.09 feet; thence N15 029'01"E, 48.23 feet; thence N84 039'02"E,
252.20 feet to the westerly line of said LOT 5; thence leaving the boundary of LOT 3 and along the
boundary of said LOT 5 the following courses: N6°06'21"W, 175.01 feet; thence S84°39'02"W,
346.94 feet to the point of beginning. Containing 3.86 acres.
WHEREAS, it appearing that said plat has been fully and properly signed and accepted by
the owner of said subdivision, known and referred to as the Final Subdivision Plat of Cherry Creek
Subdivision, Section Three, that all taxes have been paid, that in all respects the requirements of
Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said
subdivision, and that in all respects the requirements of the Planning and Zoning Commission of
the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Cherry Creek Subdivision, Section Three,
lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by
the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted
by the City Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and app/r_oval.
