CALL TO ORDER: Mayor Merritt called the regular meeting of the City Council to order at 7:33 p.m. on Tuesday, July 21, 1981, in the Council Chamber of the City Hall. 2. The invocation was given by Mr. John Hall, Temple City Christian Church, 9723 Garibaldi Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: Present: Councilmen - Atkins, Dennis, Gillanders, Tyrell, Merritt Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Parks and Recreation Director Kobett, Senior Planner Peterson 5. CONSENT CALENDAR: Councilman Dennis questioned the City Attorney as to whether an Environmental Impact Report is required if just one person feels a project will create an impact. City Attorney Martin responded that one person objecting to a project would not be a substantial reason for requiring a full impact report. Councilman Atkins stated he has observed Channel 7 News promoting the WeTip program and wanted to know their connection. City Manager Koski stated Channel 7 "Eyewitness Anonymous" began on June 1 giving more support to WeTip. Councilman Atkins moved to approve Items 'A through E on the Consent Calendar, seconded by Councilman Gillanders and carried, Councilmen Dennis and Tyrell abstaining as to the approval of minutes for July 7, 1981. A. APPROVAL OF MINUTES: Regular Meeting of July 7, 1981 Approved as written. B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of July 14, 1981 (1) TENTATIVE TRACT NO. 39848 AND CONDITIONAL USE PERMIT CASE NO. 81 -616 - 10159 -10167 LOWER AZUSA ROAD Set public hearing to consider Planning Commission recommendation for approval on August 4, 1981. (2) ZONE CHANGE CASE NO. 81 -629 - 9031 E. ACASO DRIVE Set public hearing August 4, 1981 to consider Planning Com- mission recommendation for approval. (3) PLANNING COMMISSION ACTION Received and filed memo relating to action taken by the Plan- ning Commission at their regular meeting held July 14, 1981. C. ACCEPTANCE OF BID: IMPROVEMENTS AT LIVE OAK PARK Accepted low bid from Electric Supplier Distributing in the amount of $6,527.65 to provide light fixtures for installation on three tennis courts at Live Oak Park. RESOLUTION NO. 81 -2006: APPROVING INTENT TO AMEND PERS CONTRACT Adopted Resolution No. 81 -2006 A RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF TEMPLE CITY and set public hearing August 4, 1981. E. RESOLUTION NO. 81 -2007: WARRANTS AND DEMANDS Adopted Resolution No. 81 -2007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $152,754.13, DEMAND NOS. 2233.THRU 2314. 6. UNFINISHED BUSINESS: A. APPEAL TO PLANNING COMMISSION DECISION RE: PROPERTY NUISANCE CASE NO. 81 -67, 6012 N. IVAR City Manager Koski gave background information, stating staff has inspected the property in question and observed the property owner has fenced in the lumber with view - obscuring fence as a method of abating the nuisance set forth in Planning Commission reso- lution. Councilman Atkins moved to terminate proceedings, seconded by Councilman Gillanders and carried. B. QUIMBY ACT - PARKS DEVELOPMENT /ACQUISITION FEE City Attorney Martin introduced Ordinance No. 81 -506 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY ZONING CODE BY ADDING TO ARTICLE IX A NEW CHAPTER 3 PROVIDING FOR PARK DEVELOPMENT FEES IN CONNECTION WITH NEW CONSTRUCTION. Councilman Tyrell moved to waive further reading and set public hearing August 4, 1981, seconded by Councilman Dennis and carried. 7. NEW BUSINESS: A. APPROVE SLURRY SEAL PROJECT - MAINTENANCE AREA # #1 AND #6 City Manager Koski presented plans and specifications for annual slurry seal budgeted in fiscal year 1981 -82 with a calendar of events. Councilman Dennis moved to approve plans and specification and calendar of events, and authorize the advertising and receiving of bids, seconded by Councilman Atkins and carried. 8. COMMUNICATIONS: There were no communications. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: City Council recessed at 8:42 p.m. to meet as the Community Redevelopment Agency, all members being present; approved the minutes of the July 7, 1981 meeting and approved and adopted fiscal year 1981 -82 budget. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11 Council Minutes, July 21, 19 11. MATTERS FROM CITY OFFICIALS: A. CLARIFICATION OF NEED FOR ENCROACHMENT PERMITS City Manager Koski presented a mead ` from Public Works explaining the rationale for the requirement of certain encroachment permits which were a part of the resolution adopted by City Council at their regular meeting held July 7, 1981. City Attorney Martin stated the City could incur liability if the permit system is abandoned; that the encroachment permit provides some control of uses within the right -of -way. On motion by Councilman Atkins, seconded by Councilman Gillanders, Council received and filed memo. B. City Council received and filed a memo from staff advising all fireworks stand sites have been cleared of debris and all organizations eligible for refund of deposit. C. Amendment to Lease with Dayton Interiors City Council authorized payment of $4,000 to contractor for air conditioning of Dayton Interiors and approved amendment to lease agreement to amortize the $4,000 over a 36 -month period. D. Councilman Dennis inquired about the proposal from Little League for additional lighting which the Parks and Recreation Commission has set aside. City Manager Koski stated the Parks and Recreation Commission had discussed the matter at an adjourned meeting on July 20th and their recommendation will go to Council at their regular meeting to be held August 4, 1981. E. Councilman Gillanders stated he had attended the first meeting of the Select Committee on transportation problems. He stated that one of Senator Carpenter's concerns is that 60% of the gas tax money is collected in Southern California, with 40% being collected in the northern part of the state, but that 60% is spent in the north and 40% in the south. There will be a series of public hearings, three of which he will attend. F. Councilman Tyrell stated he felt it is time Council seriously consider a ban on the sale and use of safe and sane fireworks in Temple City, expressing concern that too many children are being injured and too many fires being started, either by the legal or illegal type. Councilman Dennis stated if Council is going to consider a change it should be done now rather than wait until the organizations have made their plans for funding future projects. G. Mayor Merritt stated that Gordon Browning spoke to the Kiwanis Club regarding some of the ways the federal government is spending the citizens money, one of which is subsidizing housing projects. 12. ADJOURNMENT: On motion by Councilman Gillanders, seconded by Councilman Atkins, meeting adjourned at 8:07 p.m. Next regular meeting of the City Council will be held Tuesday, August 4, 1981, 7:30 p.m. in the Council Chamber of the City Hall.
