Those in- dividuals listed as being officers were really just employees of the restaurant, not the principal owners. Legal fees to collect $7,500 in unpaid Resort taxes from this out-of-state organization will exceed the taxes due. It was his recom- mendation that the suit be dismissed. The motion to dismiss the suit was made by Mr. Beatty, seconded by Miss Gray, and voted. On motion of Mr. Taplin, seconded by Miss Gray, and voted the meeting was adjourned at 11:05 A.M. Allig,.{(.- Mayor Attest: Village Clerk May 25, 1982 COUNCIL MINUTES June 29, 1982 The Council of Bal Harbour Village met Tuesday June 29, 1982, at 9:30 A.M., in the Village Hall. Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of May 25, 1982 were approved as submitted. The Village Clerk read Ordinance No. 239 regarding balconies and porch enclosures in the Ocean Front District in full for final reading On motion of Mr. Taplin, seconded by Mr. Sherman and voted the ordinance was adopted. Mr. Maley referred to the letter he had sent to the council explaining the residential street resurfacing project. He said 231 lots will be assessed to cover the estimated $220,000 cost. The curb and gutter work will be paid by the village due to the Village's ownership of the storm sewer system. He said he had examined four separate methods of assessment as they relate to size of lots, front footage, land value and single and multiple family zoning use. A unit value method was chosen due to the diverse sizes, frontages, property values and use of the properties. He has a commitment for a $220,000 unsecured loan from the Sun Bank of Miami at 10% interest, to cover the contract. Mr. Maley read Resolution No. 279, setting for the nature of the work, lots to be assessed and payment schedule. On motion of Mr. Taplin, seconded by Miss Gray, and voted Resolution No. 279 was adopted. Jute 29, 1982 Mr. Gold read Resolution No. 280 setting a Public Hearing at 11:00 A. M. July 27, 1982 to consider conuients on the proposed assessment roll for residential street resurfacing On Motion of Mr. Taplin, seconded by Mr. Beatty and voted the Resolution was adopted. On motion of Miss Gray, seconded by Mr. Beatty, and voted Mr. Maley was authorized to advertise for bids for the curb and gutter and street resurfacing work. Mr. Herb Kaplan of the Sheraton Bal Harbour explained the Department of Tourism's progian; "We're Glad you're Here". This program allows visitors to give employees of Bal Harbour hotels, restaurants and businesses "Courtesy Checks" to be used in a drawing each month for prizes. On motion of Mr. Beatty, seconded by Mr. Taplin and voted the program was appiuved for our Department of Tourism. The Council and representatives from the Resort Tax Committee briefly discussed the concept of a unified Tourism Board for all of Dade County. Their concensus was that we should retain control of our municipal resort tax but cooperate with the other agencies, as appropriate. Mr. Maley said he expected to have our engineer's ideas for regulating Satellite Disk Receivers ready for the next meeting. Mr. Maley requested that the Council amend the garbage and trash of inance regulating garbage cans in the residential district, to prohibit underground re- ceptacles, due to injuries caused to the workmen by lifting the heavy, sometimes water -filled cans out of the ground. Only a few homes have them. The Council agreed to prohibit this type receptacle, the ordinance to be submitted next month. Mr. Maley said thgt the report of our traffic engineers, David Plummer and Associated, Inc., hac,/ g'to the Council and to Mr. Paul, attorney for the Bal Harbour Shops. The report stated that the proposed new entrance and exit drives for the Bal Harbour Shops would generate commercial traffic on Bal Cross Drive, in conflict with the Village's Comprehensive Master Plan. Mr. Gold said that inasmuch as this item was not on the agenda, it should not be discussed further. On motion of Mr. Taplin, seconded by Miss Gray and voted the meeting was adjourned at 11:05 A. M.
