AWARD OF PRO~ESSIONAL SERVICF-q CONTRACT ~OR
LEI~AL SERVICES
WHEREAS, there exists a need for professional services to provide
legal services to Carteret Planning Board in connection with the
appropriatonm~s and conditions of the Board's approval of a One Hundred
Sixty (160) Unit garden appartment complex~ ; and
Wlt~IiEAS, pursuant to N.J.S.A. 40A:11-5(1)(a) professional services are
exempt from the requirements of competitive bidding; and
WHEREAS, the local Finance Officer has certified that funds are available.
NOW, TH~ILEFORE, BE IT RESOLVED, that the Mayor and Council of the Borough
of Carteret does hereby approve the appointment of JAMES F. CLARKIN
III~ Esq. at a maximin cost of not to exceed $1,500.00
billable per attached contract.
BE IT FURTHER RESOLVI~), that the Mayor and Municipal Clerk are hereby
authorized to execute said contract.
IT IS FURTH~/R RESOLVED, that the contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:ll-5(1)(a) due to the specialized
and professional nature of the services provided.
