HomeMy Public PortalAbout1992-074Member .Z) °Pi 10 Nl introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 9d-�9 RESOLUTION GRANTING A SEPTIC SYSTEM VARIANCE TO ROBERT RYAN WHEREAS, Robert Ryan (Applicant) has requested a variance to reduce the required setback from 3 feet to 0 feet for the construction of an innovative septic system replacement at 1762 Tamarack Drive; and WHEREAS, Section 721.03 of the Medina Code of Ordinances requires that variances from the strict interpretation of the Individual Sewage Treatment and Disposal Systems Code be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request and has recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and has concurred with the Planning Commission's recommendation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant be granted a variance to reduce the required setback from mottled soils from 3 feet to 0 feet for construction of an innovative septic system replacement, subject to the following conditions: 1. The Applicant must monitor the system monthly for at least one year and report the findings to the City . The reports shall be reviewed and tabulated at the end of one year. The City retains the right to require monthly reporting for an additional year. If any additional on -site inspections are required, the Applicant must reimburse the City for the cost thereof; 2. The Applicant must install and use low water appliances and water softener in the house; 3. The Applicant must meter the water usage of the house so that water entering the septic system does not exceed the design standards; 4.
