meeting of the City Council at the request of the applicant.
Recommendation.
Staff respectfully requests that, in view of the distance requirements for the zonirig

The City Council of the City of Lynwood met in a Regular Session
in the_City Hall, 11330 Bullis Road on the above date at 7:30
p.m.
Mayor Byrd presiding.
Councilmembers He.ine, Henning, Rea, Richards and Byrd answered
the roll call.
Also present were City Manager Gonzales, Interim City Attorney
Rudell, City Clerk Hooper and City Treasurer Pygatt.
City Clerk Hooper announced the Agenda had been duly posted in
accordance with The Brown Act.
It was moved by Councilmember Rea, seconded by Councilmember
Heine, and carried to approve th.e following minutes, with
corrections by Councilmember Henning.
It was then moved by Councilmember Rea, seconded by Councilmember
Henning, and carried tb approve the following
Proclamations/Presentations:
a) Apartment Association, California Southern Cities
b) National League of Cities Urban Enrichment Award
Councilmember Richards presented an award from the National
League of Cities to Pastor Harris for his Tree of Life Pre-
Employment Training Project.
Steve wright, Representative for Habitat for Humanity invited
Council to the opening ceremonies of two new homes on Louise and
Gertrude, and presented them with T-Shirts.
City Manager Gonzales announced the distribution of new recycling
bins from Western Waste. Also discussed upcoming press
conferences with regard to decisions on the Empowerment Zone.
It was moved by Councilmember Richards, seconded by Councilmember
Rea, and carried to recess to the Lynwood Redevelopment Agency at
7:48 p.m.
City Council reconvened at 8:02 p.m.
It was moved by Councilmember Richards, seconded by Councilmember
Heine, to add as a subsequent item, by a 4/5 vote, Ordinances
pertaining to the Redevelopment Agency Implementation Plan.

Councilmember Richards questioned the type of program involved in
the School Districts' use of Ham House.
Councilmember Heine discussed the usage of the location as an Art
Center.
Project Manager Givens stated there is availability for multiple
programs.
Councilmember Rea stated concerns with liability obligatians
involved. Also stated the House is a Historical landmark,
suggested seeking an alternate site.
Councilmember Henning discussed current usage of the House and
stated the City should maintain a cooperative effort with the
School District.
After further discussion, it was moved by Councilmember Richards,
seconded by Councilmember Henning to approve a 90 day trial use
of the facility with the possibility of extension for six months
depending on the circumstances at that time.
Interim City Attorney Rudell recommended a redrafted agreement to
include Councils stipulations.

Councilmember Henning then discussed the need for the creation of
a position, possibly a Lynwood Resident to monitor ADA
requirements and mandates.
After further discussion, no action taken on item.
Councilmember Henning then discussed the City Treasurers
Investment Policy item. Requested documentation containing the
County's Investment Policy and Profiles of Investments before
taking any action on this item. Recommended bringing the item
back pending the reports.
Councilmember Richards suggested a workshop, geared towards
investment policies.
City Treasurer Pygatt agreed with Council regarding a workshop.
However, lack of any staff person in the City Treasurers Office
would place all organization of a workshop solely on the City
Treasurer.
Coun.cilmember Henning discussed the importance of a Deputy City
Treasurer.
City Manager Gonzales stated a deputy could be appointed from
existing city staff by the City Treasurer on a part-time basis.
City Treasurer Pygatt stated she does not feel a part-time Deputy
would be sufficient. Stated the need for someone that can supply
proper reporting, also stated the salary is not sufficient.
Item continued pending reports of Investment Policies from the
County.
Councilmember Henning stated he had removed item #22., Warrant
Run, for voting purposes.

Heine to adopt:

Cityo Stated complaints with current street sweeping services,
and addressed the new recycling program.
Al Roache discussed the new recycling program and the importance
of viable investment policies for the City. Wished everyone a
Merry Christmas.

Also discussed the necessity for street repairs at Fernwood &

Councilmember Rea commended Western Waste on the curbside

year in decorating their homes. Also discussed the recycling

Appellant: Ernesto Vides
PURPOSE
To request that the City Council consider an appeal by th.e
applicant of an action by the Planning Commission on November 8,
1994, denying Conditional Use Permit No 151 to sell beer and
wine for off-site consumption at 4363 East Imperial Highway, in
the C-3 (Heavy Commercial) Zone. This item was continued from the
December 20, 1994 meeting of the City Council at the request of
the applicant
BACKGROUND
Sections 25-16..20c of the Lynwoad Zoning Ordinance requires that
a Conditional Use Permit be approved to allow establishments to
sell alcoholic beverages and Section 25-16 20e requires a minimum
distance of 500 feet from other such establishments and schools,
churches, parks and playgrounds, and other similar uses.
In addition, Section 25-16.20 g of the Ordinance provides that
existing establishments that sell alcoholic beverages must secure
a Conditional Use Permit when they have been abandoned or ceased
operations for more then three months.
The applicant has filed for a Conditional Use Permit to sell
beer and wine in an existing market. The subject property was
originally a Gircle K Market with a license to sell beer and
wine The Corporation did not renew their license in 1991, thus
the license ex~pired On December 10, 1991 the Planning
Commission denied an application from a prospective lessee
requesting a Conditional Use Permit (Case No. 97) to sell beer
and wine at this address, in part because the store did not meet
the distance requiremen~s of the Zoning Ordinance.
PLANN.ING COMMISSION ACTION.
The Planning Commission conducted a.public hearing on CUP No.
151 on November 8, 1994 and denied the Conditional Use Permit
because the proposal does not meet the distance requirements of
the Zoning Ordinance It is within 500 feet of three other
establishments selling or serving alcoholic beverages. The
Commission .determined that such uses create policing problems
and that there are too many such uses currently existing in the
City
ANALYSIS
The proposed land use is consistent with the existing zoning
classification C-3 and the General Plan designation of
Commercial The property is adequate in size to accommodate the
proposed development The lot is standard and meets current
development standards relative to structures, parking, walls
fences, landscaping, driveways and other features required by the.
Zoning Ordinance However, the proposal does not meet the
distance requirements of 500 feet between establishments selling
alcoholic beverages as required under Section 25-.16 20e of the
Zoning Ordnance

The applicant's IaZS"yer has submitted a brief ~ which he argues ,
in part, that in his interpretation, Section 25-16 20e of the
Zoning Ordinance.means that an off-sale liquor establishment only
has to be 500 ft away from another establishment that sells both
on-sale and off-sale at the same location. Staff has always
maintained that the section means that the establishment must be
500 ft away from another establishment that is either an off-
site or an on-site establishment. This interpretation is
supported by the American Heritage College Dictionary (3rd
Edition) definition of "both" as "one and the other" The
example given is "Both are mad" In a usage note, the Dictiona.ry
explains that "Both is used to indicate that the action or state
denoted by the verb applies individuallv to each of the two
entities. Bo.th books weigh more than five pounds means that each
book weighs more than five pounds, not that the two books
toctether total more that five pounds."
This interpretation is supported by the June 7, 1988 staff report
submitted to the City Council in support of adoption of the
ordinance It states that.
This is staff's "compromise" ordit~ance wh,ich includes the
following provisions•
Requires a Conditional Use Permit for both on and off-
sale li.quor establishments.
2. Proposes a five-hundred (500') foot distance requirement
between on-sale liquor establishments, between off-sale
liquor establishments, between on-sale and off-sale
liquor establishments, fro residential uses and other
consideration points
If the Council wishes to consider approval of the sale of beer
and wine at this location, the proper procedure would be to grant
the appeal conditional upon the applicant filing for a variance.
The Conditional Use Permit then would not become operative until
~ variance was granted and conditions were established for the
Conditional Use Permit However, staff believes that it would be
very difficult to make the findings required for the granting of
a variance for this property
ENVIRONMENTAL ASSESSMENT
The Director of Community Development has determined that the
project is categorically exempt pursuant to Section 15061b (3) of
the State CEQA Guidelines as amended
RECOMMENDATION
Staff respectfully requests that, in view of the distance
requirements for the Zoning Ordinance regulating establishments
selling or serving alcoholic beverages, the City Council uphold
the Planning Commission denial of Conditional Use. Permit
Application No 151

Proposal•
The applicant is requesting approval of a Conditional Use Permit
to sell beer and wine for off-site consumption in an existing
market at 4363 Imperial Highway in the C-3 (Heavy Commercial)
Zone. This case was continued from the October 11, 1994 Planning
Commission meeting in order to allow staff to investigate the
permit history of nearby stores and restaurants also selling
alcoholic beverage.
Facts
1 Source of Authority:
Sections 25-16.20c of the Lynwood Zoning Ordinance requires
that a Conditional Use Permit be approved to allow
establishments to sell alcoholic beverages.
2. Property Location and Size
The subject site is located on the northwest corner of
Imperial Highway and Atlantic Avenue (see the attached
location map). The subject property is an irregular lot,
approximately 16,875 square feet (135'x 125') in size.
3 Existing Land Use
The subject property is developed with a mini mall consisting
of a market and approximately 6,b00 square foot of other
retail stores (5 rental spaces). The existing 2,800 square
foot market, subject of the request for a permit for the sale
of beer and wine, is located within the mini mall. The
surrounding land uses are as follows:
North - Commercial
South - Commercial
East - Commercial
West - Commercial
4 Land Use Designation
The General Plan designation for the subject property is
Commercial, while the Zoning Classification is C-3 (Heavy
Commercial. The surrounding land use designations and zoning
are as follows

5 Pro~ect Characteristics
The applicant proposes to sell beer and wine only at an
existing food and groceries market. The site is developed as
a mini mall with five (5) retail spaces currently occupied
by Daily Donuts, La Pizza Loca, Auto Parts, and Video 5000

as well as Vides Market There are 22 parking spaces
provided. The subject site meets the development standards of
the Code.
6 Pro~ect Historv
The subject property was originally a Circle K Market with a
license to sell beer and wine. The Corporation did not renew
their license in 1991, thus the license expired. On December
1.0, 1991 the Planning Commission denied an application from a
prospective lessee requesting a Conditional Use Permit (Case
No 97) to sell alcoholic beverage at this address, in part
because the store did not meet the distance requirements of
~he Zoning Ordinance
The market was closed from 1991 through 1992. The current
applicant reopened the market on February 24, 1993 and
submitted an application for a Conditional Use Permit to sell
beer and wine on September 19, 1994. The applicant was
informed as to the problems regarding the site not meeting
the distance requirements establ'ished by the City Code
(Ordinance 1306), in that there are three other
establishments selling alcoholic beverages within 500 feet of
this market
7 Site Plan Review
At its_ regular meeting on September 28, 1994, the Site Plan
Review Committee evaluated the proposed development and
recommended denial to the Planning Commission. The Committee
determined that the proposal does not meet the distance
requirements established by City Code (Ordinance 1306).
Section 25-16.20 requires that all off-sale liquor
establishment shall maintain a distance of five hundred feet
from any other establishment where alcoholic beverages are
sold for both off-sale and on-sale consumption.
8 Zoning Enforcement Historv
None of record at the time this report was prepared.
Neiqhborhood Response
At the Planning Commission hearing of October 11, 1994, one
person spo.ke in opposition to this application and one in
favor (in addition to the applicant)
ANALYSIS AND CONCLUSION:
Consistencv with General Plan and Zonincl Ordinance
The proposed land use is consistent with the existing zoning
classification C-3 and the General Plan designation of
Commercial. The proposal does not meet the distance
requirements of 500 feet be.tween establishments selling
alcoholic beverages as required under Section 3 25-16 20 of
the Zoning Ordinance There are three (3) alcoholic beverage
establishments closer than 500 feet to this market A) off-
sale at 11022 Atlantic Avenue, B) on-sale at 11004 Atlantic
Avenue, C) on-sale at 11020 Atlantic Avenue.
Site Suitabilitv
The property is adequate in size to accommodate the proposed
development. The lot/site meets current development standards
relative to structures, parking, walls, fences, landscaping,
driveways and otYier feature required by the Zoning Ordinance
except for the distance requirements per Section 25-16.20.

3 Coinpatibilit_y
~
The proposed development is surrounded by commercial and
other uses Permitting the sale of alcoholic beverages at
this s~ite would not be, incompatible with the adjacent
commercial uses, but may have a negative effect on nearby
residential uses.
4 Compliance with Development Standards
Section 25-16 20e Off-Sale Liquor Establishments of
the Zoning Ordinance requires that a distance of 500 feet be
maintained between an off-sale alcoholic.beverage store and
other liquor establishments, as we~l as churches, schools,
hospitals, parks and playgrounds, and other similar
consideration points. The subject site is within 500 feet
of three of the listed consideration points. Approval of this
application would be in violation of these requirements.
5. Permit Historv of Nearby Stores and Restaurants
Atlantic Liquor, 11022 Atlantic Avenue
A liquor store has existed at this location since at least
1972. No Conditional Use Permit has been granted. In January
1985, staff determined that a Conditional Use Permit was not
required for a transfer or a renewal of an ABC License since
it was a legal non conforming use. According to Business
License records, this store has been in continuous operation
since 1985
Viva Mexican, 11020 Atlantic Avenue
A restaurant and bar has existed at this location since at
least 1974. Business License records show a business license
since 1985, except for the year TJ87. In 1981 the Zoning
Ordinance was amended to exempt bonefide restaurants from the
distance requirements in the Ordinance providing that they
get a Conditional Use Permit
In 1986 the Planning Commission approved a CUP for "the
continuati.on of operation of a restaurant and cocktail lounge
serving alcoholic beverages" at this location.
Pescado Mojado, 11004 Atlantic Avenue
On September 26, 1989 the Planning Commission approved
Conditional Use Permit No 22 for a restaurant serving beer
and wine at this location
Staff determined that this use was a bonefide restaurant and
therefore was exempt from the 500 feet distance restrictions
in the Zoning Ordinance.
ENVIRONMENTAL ASSESSMENT
The Community Development Director •has determined that the
project is categorically exempt pursuant to Section 15061b (3) of
the State CEQA Guidelines as amended
RECOMMENDATION
Staff respectfully requests that the Commission, after ~
consideration, deny Conditional Use Permit No. 151 because the
proposal does not meet the distance requirements of the zoning
Ordinance, since it is for an off sale alcoholic beverage store
and is within 500 feet of three other establishments selling or
serving al-coholic beverages

Pescado Mojado Restaurant, 11004 Atlantic Avenue
A building permit was issued on July 29, 1985 for a Wendy's
restaurant at this location. The Planning Commission granted a
Conditional Use Permit (Case N~ 22) for the sale of beer and
wine only for a new restaurant on September 2G, 1989
Prior to that hearing staff determined that the Pescado Mojado
qualifies as a bona fide restaurant in accordance with Section
25-16 40, of the Zoning Ordinance and the Bus. & Prof. Code,
Sec. 23038, and therefore could be closer than 500 feet from
other businesses selling alcoholic beverages.
Atlantic Liquor, 11022 Atlantic Avenue
A liquor store has existed at this location since before 1972
(building permit on file dated 7/12/72 for the expansion and
remodel of the existing liquo.r store). On January 2, 1985
Planning staff informed the alcoholic beverages control board
that no Conditional Use Permit would be required for a transfer
of license since there was to be no "change in use".
Viva Mexicana, 11020 Atlantic Avenue
A restaurant and bar has existed at this location since at least
1974 (electrical permit on file dated 12/23/74 for electrical
work on existing building described as "restaurant and bar")
On April 8, 1986, the Planning Commission approved CUP No 86030
for "the continuation of operation of a restaurant and cocktail
lounge serving alcoholic beverages" at this location One of the
findings was "the site will be utilized pursuant to the current
zoning regulations...."

is not supported by the findings and the findings are not supported
by substantial evidence in this record.
More particularly, the Planninq Commission did find, premised
upon an uncontroverted record, that the proposed land use is indeed
consistent with the existinq zoninq classification C-3 and is
indeed consistent with the qeneral plan designation of "commercial"
for the area. The Planninq Commission also found that the proposed
site is adequate in size to accommodate the proposed development,
~he lot meets current development standards relative to structures,
parking, walls, fences, landscaping, driveways and other features
required by the zoninq ordinance. The Planning Commission also
found that the proposed development is surrounded by commercial
uses in all compass directions and permitting the sale of alcoholic
beverages at the site would not be incompatible with the adjacent
commercial uses. The Planning Commission also found that the
project is categorically exempt from environmental issues pursuant
to Section 15061b(3) of the state CEQA guidelines as amended.
There is no substantial community opDOSition to the Droposedl
use, there_is no adverse zone enforcement history with regard tol
the site and the apolicant is qualified.
Historically, the subject property was oriqinally a Circle K~
market holdinq a license to sell beer and wine as is requested by
appellant herein. Appellant is informed and believes that Circle
K acquired such license authority after 1988 and thus after the
operative affect of Lynwood ordinance number 1306. However, Circle
I{ did not renew its license in 1991 and the license expired.

Hence, appellant has made application now to relicense a location
previously licensed by this city.
Notwithstanding all of the above-referenced, uncontroverted
and substantial evidence in favor of this application, the Plannina
Commission denied same premised upon a sinqle ground. The
Commission found that the grant of this conditional use permit
would contravene Lynwood ordinance number 1306, Section 25-16.50
because the proposal does not meet the distance requirements of the
zoning ordinance since it is for an off-sale alcoholic beverage
store and "is within 500 fee~ of 3 other establishments selling or
serving alcoholic beverages." See November 8. memorandum of
Planning Commission attached herein, page 3, last paragraph.
It is respectfully submitted that this determination is
erroneous as a matter of law and is factually unsupportable.
Of necessity, we beqin our analysis with a careful scrutiny of
Section 25-16.50 and find that it provides, in pertinent part, asl
follows:
"No off-sale liquor establishment shall be maintained
within 500 feet of any other establishment wherein
alcoholic beverages are sold for both off-site and on

site consumption . . . ~~
We thus see an express legislative mandate that to disqualify
this applicant, it must be located within 500 feet of another ABC
licensed establishment which has authority for both off sale and on
sale privileges! However, no such ABC licensed premises actually
exists within 500 feet of applicant site.

The Planninq Commission erroneously referred to and relied
upon 3 other establishments which do not meet this criterion.
First, the Planning Commission relied on ~tlantic Lictuor at
11022 Atlantic Avenue. This location is licensed with a type 21
license from the Department of Alcoholic Beverage Control allowina~l
onlv off sale qeneral privi eqes. It is not authorized to engaqe
in on sale privileges at all. Therefore, this establishment is not
ABC licensed "for both off site and on site consumption." It is
thus not a disqualifying site under Section~25-16.50.
The Planning Commission further relied upon Pescado Maiado at
11004 Atlantic Avenue. This is licensed by the Department of
Alcoholic Beverage Control with a Type 41 on sale beer and wine
eating place. However, the Department has specifically conditioned
this license to preclude anv off-sale privileqes. Critically, the
City of Lynwood has also so conditioned this site to preclude any
off-sale privileges by way of City of Lynwood Ordinance No. 2291
granting a conditional use permit to Pescado Majado only on
condition that it not exercise off-site consumption privileges.
See resolution number 2291 which is attached hereto as Exhibit "8", I
page 2, condition number 12. Therefore, this site does not ha
"both off site and on site consumption" privileges and it is thu
not a disqualifying site under Section 25-16.60.
Finally, the Planning Department relied upon Viva Mexican
11020 Atlantic Avenue. This is licensed by the Department of
Alcoholic Beverage Control with a type 47 on sale general eatin
place license.
Appellant is informed and believes and thereon

alleges that the on sale license authorizes o~lv the sale
alcoholic beveraaes for consumntion on the premises per ~aliforn
Business and Professions Code Section 23996 and this is thus not
disqua~ifying site under Section 25-16.50 since it does not ha
privileqes for both off-site and on-site consumption. A copy
California Business and Professi ons C ode Sections 23314 and 23396
are attached hereto as Exhibit "C" and incorporated herein bv
r.eference as thouqh set forth hereat in full.
Therefore, it is respectfully submitted that these three othe
locations do not disqualify this application.
Notwithstanding that factual insufficiency, it is als
respectfully submitted that Ordinance No. 1306 is unconstitutiona
and void as not providinq for an exemption procedure.
Notwithstanding the above cited bases for reversal of
decisiori of the Planning Commission and the grant of thi
conditional use permit herein, applicant wishes to provide the cit
council with absolute assurance that if granted the authorit
prayed for herein, he will conduct his premises in a manner that
will not be detrimental to the public health, safety or welfare and
will not in any manner be injurious to adjacent community uses or
occupants. Toward that end, applicant respectfully submits that he
~rould be willing to have the grant of conditional use permit
authority expressly conditioned as follows:
VOLUNTARILY SUGGESTED CONDITIONS OF OPERATION
1. That the alcoholic beverages to be sold shall be limi
to beer and wine only with no hard liquor sold.

2• That the premises shall engage in such sales of alcoholic
beverages only until 10:00 p.m. on Sunday through Thursday and only
until midnight on Friday and Saturday.
3. The applicant shall post siqnage precluding consumption
of alcoholic beverages on site and precluding loitering.
4. The applicant shall post siqns outside the premises
notifyinq the public that it is a violation to possess any bottle,
can or other receptacle contafning any alcoholic beverage which has
been opened or a seal broken or the contents of which have been
partially removed on or adjacent to the premises and that
violations of such will not be tolerated and violators will
reported to law enforcement authorities.
5. The applicant will be responsible for maintaining
property free of litter at all times.
6. The applicant shall maintain no coin operated amuseme
devices or video games in the premises.
7. The applicant shall make all reasonable efforts
preclude the accumulation of graffiti and any graffiti which does
appear on the applicant site shall be removed by applicant within
72 hours of the discovery thereof.
8. No single cigarettes shall be sold.
9. No fortified wine shall be sold.
10. All exterior advertising shall be limited to compl.iance
with all local sign ordinances..
11. The compliance of applicant with all reasonably imposed
conditions shall be reviewed at a reasonable interval by the City.

Procertv Location and Size
The subject site is located on the northweat corner of
Imperial Highway and Atlantic Avenue (see the attached
location map) The aubject property is an irregular lot,
approximately 16,875 squate leet (135'x 125') in size
Existina Land Use
The subject property is developed with a mini mall consisting
of a market and approximately 6,600 square foot of other
retail stores (5 rental spaces) The existinq 2,800 square
foot market, subject of the request for a permit for the sale
of beer and wine, is located within the mini mall The
surroundinq land uses are as follows:
North - Commercial
South - Commercial
East - commercial
west - Commarcial
The General Plan designation for the subject property is
Commercial, vhile the Zoning Classification is C-3 (Heavy

The subject property was originally a Circle K Market with a
license to sell beer and wine The Corporation did not renew
their license in 1991, thus the license expired On December
10, 1991. the Planning Commission denied an application from a
prospective lessee requesting a Conditional Use Permit (Case
No 97) to sell alcoholic beverage at this address, in part
because the store did not meet the distance requirements of
the~Zoning Ordinance
The market was closed from 1991 through 1992 The current
applicant reopened the market on February 24, 1993 and
submitted an application for a Conditional Use Permit to sell
beer and wine on September 19, 1994 The applicant was
informed as to the problems regar~ing the site not meeting
the distance requirements esta611shed by the City Code
(Ordinance 1306), in that there are three other
establishments selling alcoholic beverages within 500 feet of
this market. •

least 1974 Business License records show a business license
since 1985, except for the year 1987 In 1991 the Zoning
Ordinance was amended to exempt bonefide restaurants from the

get a Conditional Use permit

On September 26, 1989 the Planninq Commiseion approved

and wine at this location
Staff determined that this nse was a bonefide restaurant and
therefore vas exempt from the 500 teet distance restrictions
in the Zoninq Ordinance.
The Community Development Director has determined that the
project is categorically exempt pursuant to Section 15061b (3) of
the State CEQA Guidelines as amended
RBCOMMENDATION
Staff respectfully requests that the Commission, after
consideration, deny Conditional Use Permit No 151 because the
proposal does not meet the distance requirements of the zoning
Ordinance, since it is for an off sale alcoholic beverage store
and is within 500 feet of three other establishments selling or
serving alcoholic beverages

A liquor store has existed at this location since before 1972
(buildinq permit on file dated 7/12/72 tor the expansion and
remodel of the existing liquor store) On January 2, 1985
Planninq staff informed the alcoholic beverages control board

the violation becomes a matter of investigation, hearing, or decision by the
department with relation to the license of the licensee, the department

To review and approve a proposed Code Enforcement Policy which
wouTd set goals and objectives for Code Enforcement.
BACKGROUND:
On December 6, 1994, City Council directed the Communi,ty
Development.Director to prepare a Code Enforcement Policy in order
to set up meaningful goals .and objectives for staff. Also to be
developed was an overall Mission statement which would give broad
guidance on the direction of Code Enforcement.
ANALYSIS•
Attached for City Council's review is a proposed Code Enforcement
Policy. The Policy is set up with a Mission-Statement, Goals and
Objectives and various actions which would implement the Mission
Statement and goals and objectives.
Also included is a"Priority List" of the most common type of
complaints which Code Enforcement encounters. Staff has ranked
each violation by order of importance. It should be noted that any
number of factors can influence the ranking of the priority list.
~nd therefore, the ranking could change or items be added or
deleted based on the needs of the community.
It is hoped that the attached policy will provide guidance to the
Code Enforcement staff, and provide reasonable expectations to the
City Council on issues relating to Code Enforcement.
RECOMMENDATION•
Staff recommends the City Council review and make comment regarding
the proposed Code Enforcement Plan.

I. INTRODUCTION '
The enforcement of the municipal code is to protect pubhc health and safety, and
enhance the quahty of l~fe while assuring a clean, attract~ve and safe residential and
business environment. Code enforcement is a governmental funchon used to enforce
municipal and other government codes with regards to property ma.intenance, zoning,
public nuisance, and business hcense.
Code enforcement may be active (proactive) or passive (reactive) Passive code
enforcement is limited to complaint responses and correchon of violahons related to
health, safety, or aesthet~cs. In an active enforcement process, a Code Enforcement
Officer ("CEO") not only respond to comglaints, but seek out violators. Active
enforcement is a dynamic tool to address problems because it allows the City to pursue
preventative programs to mimmize code violat~ons that are percerved as severe based on
the number of complaints from the public ar direction from City Council. Often when
problems are no longer perceived as cntical or as a pnonty as a result of act~ve
enforcement, then the enforcement mode appropnately shifts from active to passive.
Because a significant portion of investigations are imtiated as a response to complaints
from the public, code enforcement in Lynwooci can be considered generally passive with
penods of act~ve enforcement. Development of proact~ve and reactive policies and
actions ensures that the City is aware of and acting on potent~al problems throughout the
City
Code enforcement policies established by City Council is carned out under the direct~on
of the City's Commuruty Development Director The field work is performed by the Code
Enforcement Manager and Code Enforcement Officers who attempt to work
cooperatively with residents and businesses to maintain community standards, preserve
property values and ensure that Lynwood remauls a desirable living environment.
II. GOALS, POLICIES~ AND ACTIONS
he goal statements express the general, long range condit~on toward which code
Tenforcement effort is being d~rected. Each goal is reinforced by a senes of pohcies
which provide guidance for decision makmg that will advance the goal. Implementulg
actions are the most prominent result of establishing pol~cy Ttus exercise, the
formulat~on of goals, policies and act~ons, is an attempt to affect positive change in the
community through the improvement of the way the City enforces the various codes and
requirements that all residents are required to meet.

When appropriate, the City utilizes a notice approach which provides
opportunity for the owner to'be advised that the current situation involves
a violation of municipal or related code and establishes a dme frame for bringing
the property into compliance without regulation. However in certain violadons
where feasible into the code enforcement process.
Intent There are several ways in which a Code Enforcement Officer is made
aware of a violation. Complaints received over the telephone or in-person
from neighboring property owners constitute a significant portion of inspection
requests received by a Code Enforcement Officer ("CEO") Other City staff
members who have observed violations may also request a CEO to perform an
inspection. Also, through observation in the field or during site
inspections the CEO may inidate action. This type of code enforcement is
passive in nature. In addition, cases may result from acdve enforcement
involving neighborhood canvassing by the CEOs.

such as illegal vending, operating a business without a permit, or operating a
lunch or ice cream truck during restricted hours, a CEO may issue a"nodce to
appear" with specific financial penalties but do not require that the violadon~be
corrected.
If a nuisance is not properly abated within the period established for voluntary
compliance, another letter is sent. 'Ihe letter establishes a time frame for bringing
the property into compliance and advises the property owner that the City•may
have to take legal action to resolve the situation if action is not taken.
Effective code enforcement program needs community involvement and
cooperation. CEOs should endeavor not only to respond to complaints of code
violations but also assist neighborhoods to solve problems.

Intent Code Enforcement will continue to play a key lead and support roles in
maintaining the integrity of neighborhoods and ensuring the quality of life
throughout the City CEOs will condnue to coordinate with City and County
departments to assure public health, safety, and aesthetic integrity of the
community is maintained and enhanced.
It is the golicy of the City to encourage voluntary compliance, however, in order
achieve and assure compliance, penalties and/or fines may be necessary to curb
recurring or profound violations. It is the role of the CEO .to notify the owner of
the property to abate~the violation, then, through a series of reinspecdons and
follow-up letters, ensure that the municipal or related code violation is abated.
If a subsequent inspections of the property reveals that the property
owner/tenant has failed to abate the violation, a succession of notices is
sent. The process continues until abatement or prosecutor
referral occurs. PropeRy owners who do not take action to resolve the situation
following the final notice are referred to the City Prosecutor 'IYie City Prosecutor
is one of the most effective means for achieving.compliance with zoning and
propeRy maintenance regulations. Referrals to the City Prosecutor
are made when it is apparent that compliance cannot be achieved with voluntary
compliance, normal code enforcement procedures and notices of violations. 'The
City Prosecutor may file criminal charges if the property owner is not cooperative
and refuses to take any action or fails to take acflon to resolve the situation.

and notwithstanding any other pro~rision in the Redevelopment P].ar-
~or the Alameda Rsdeve].opment ~roject Area, the City Council
hereby e~taLbi~2~~sa the following 1 imitatiqns for tile A182neda
Project Arsa, subjeat to all of the provisivns of this Ordinance
and further subject to Health and Safety Cade Section 33333.6 (g}

A, In accordance with Health and Safety Code Section
33333.6{a), the time for establishing lo~ns, advances and
indebtedness to be pa~.d with rhe proceeds of property ~axes
received pursuant to Health and Safety Code Section 33670, to
finance, in whole or in part, the Alameda Redevelopment Projeat
Area, shall not exceed January 1, 200~. As provided in Health and
Safety Code Section 33336.(a), this limit, however, shall not
prevent the Lynwaad Redevelopmant Aqency (~~Agency~~) fro~ incurring
debt te be paid from th~ Low and NloderatQ Income Housing Fund or
establishing marP ~3~ht in nrclc~r to fulfill the Agancy's houslnA
obligatians under Health and Safety Cods Sec~ion 33413, nor shall
this limit ~revent the Aqency from refinancing, rAfunding, or
restructuring indebtean~ss aL'ter the tim~ limit if the indebtednsss
is nat increas~d and the time during which the indebtedness is to
be re~aid does not exceed the date on which ~he indebtedness wou~d
have been paid. This time limit may alsa be extended by amendment
of the Redevelopment Plan for the Alameda Redeve].opmerit Proj~ct
Arss, after tha Agonay make~ tho findinge r~gu3.rQd by aubdiviaion$
(a-)(z)(A) and (a)(2){B) of Nealth and SaPety Code Section 33333.6.
However, this amended time limit may not exceed January 1, 2014.
B. In accordanc~ with Health and Safety Code Section
33333.6(b), tha effectxveness of the Redevelopment Plan far the
AlamQda Redevelopment Project Area shall terminate November 18,
2015, after which time tha Ag~ncy shall have no authority ta act
pur~uant to the Redevclapmont Plan ~cr the 1~lameda RQdw~rclopma~t
Project Area, excep~ to pay previously i~curred ~ndebtedness and to
enfvrce ex~sting cov~nants, contracts or otk~er obligations.
C. In accordance with Health and Safety Code Section
33333.8(c), excep~ as provided in subdivisions (q) and (h) o~
Health and Safety Code Section 33333.6, the Agency shall not pay
indebtedness or receive property taxes puzsuant to Health and
Satety Cafle 5ection 3367o with respect tv tha Alameda Redevelopment
Project Area aftiex November 18, 2025.
Section 2. ~pplicatian_ The limitations established in this
ordinance shall apply te the Redevelvpm~nt Plan for the Alameda
Red~velopment Projeat Ar~a and may only be am~ndad in ~he manner
required and to the sxtent permitted by law.
Section s. The Mayor or trie Lity Shall sign and the city
Ctez-k shall attest to the passage of this ordinance. The Effective
Dat~ ~f this ordinance shall be thirty (30) days frem the date of
its adoption. Prior to the expiration of fifteer~ (15) days from
the adoption hereof, the City Clerk, pursuant ta Government Code
Section 36933(c)(l), ~h~ll oauce a ~umma=y of this ardinance to hQ.
published in some daily newspaper printed and published in the Gity
af Lynwood along with the record oP the vote for approval and
