CITY COUNCIL
MINUTES
AUGUST 18, 1981
Mayor Merritt called the regular meeting of the City Council to
order at 7:32 p.m. on Tuesday, August 18, 1981, in the Council
Chamber of the City Hall.
2. The invocation was given by Rabbi Alan Lachtman, Temple Beth David,
9677 Longden Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. ROLL CALL:
Present: Councilmen - Atkins, Dennis, Gillanders, Tyrell, Merritt.
Absent: Councilmen -None
Also Present: Assistant City Manager. Kimbrough, City Attorney Martin,
Planning Director Shaw, Parks and Recreation Director
Kobett, and Julie Estrada, Temple City Times.
5. CONSENT CALENDAR:
Councilman Atkins requested the minutes of the regular meeting held
August 4, 1981,- reflect the fact that Chief McCann was in the
audience and concurred with the City's endorsement of the Women's
Club project to donate blue reflective hydrant spotters.
Councilman Atkins moved to approve Consent Calendar Items A through
K, with minutes as corrected, seconded by Councilman Dennis and
carried, Councilman Gillanders noting his objection to Item H and
Councilman Tyrell abstaining on Item G.
A. APPROVAL OF MINUTES - Regular Meeting of August 4, 1981
Approved as corrected.
B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of August 11, 1981
(1) ZONE VARIANCE CASE NO. 81 -634 - 9661 LAS TUNAS DRIVE
Set public hearing September 1., 1981,--to consider request to
waive requirements regarding dividing a building for office
use pursuant to.Section 9371.
(2) PLANNING COMMISSION ACTION
Received and filed memo relating to action taken by the
Planning,Commission at their regular meeting held August 11, 1981.
C. APPROVAL OF FINAL TRACT MAP 38313 - 5122 -5124 ROSEMEAD BOULEVARD
Approved CC &R's.and final map; approved agreement to construct a
water system and appropriate bonds; found the project will not
violate any of the provisions of the Subdivision Map Act; and
instructed the City Clerk to endorse approval on the face of the map,
D. ACCEPTANCE OF WORK: RESURFACING OF LONGDEN AVENUE/OLIVE STREET
Accepted the work performed and authorized payment to Vernon Paving
Company; filing of Notice of Completion and payment of the ten
percent retention at the end of the 34 -day lien period,

E. AWARD BID: SLURRY SEAL PROJECT - MAINTENANCE AREAS #1 and #6
Accept low bid and' awarded .contract.to.Pavement.Coatings Company
in the amount of.$48,793.36 and authorized Mayor and City Clerk
to sign.
F, CLAIM FOR DAMAGES: LISA WILTON, 5016 GOLDEN WEST AVENUE
Denied and referred to JPIA.
G. REQUEST FOR ENCROACHMENT PERMIT `,912 ENCINITA AVENUE
Approved permit:: to encroach three inches into the public right -
of -way for the .purpose .of adding redwood siding to the face of
the building: at 5912 Encinita Avenue,' subject to applicant
obtaining building permit and inspection of the work.
H. APPROVAL.:: OF ATTENDANCE: LEAGUE OF CALIFORNIA CITIES CONFERENCE
SAN FRANCISCO, OCTOBER 17 -20, 1981
Approved :. attendance :for :those city officials wishing to attend
subject to Council's.adopted_policy re :.. conference participation,
and authorized conference expenses as budgeted.

Robert Pitts, 5312 Degas Avenue, thanked.the members of the Council
who attended the—Japanese/Temple City.All Stars Pony game held
August 15 and the presentation of the plaque to the visiting team.
RECESS TO CRA:
Council recessed.at 7:40 p.m_ to as the Community Redevelopment
Agency, all members being_present; approved.the minutes of the August. 4,
1981,.meeting and approved Planning Commission resolution modifying
Resolution No. 80 -910PC to increase hours of operation for restaurant
located at 8841 -8841k E. Las Tunas Drive. The minutes are set forth in
full in the records of the Agency.

11. MATTERS FROM CITY OFFICIALS:
A. APPROVAL FOR ADDITIONAL SICK LEAVE FOR CAROLYN ZIRBEL
On Motion :by. - Councilman:_: Tyreii.,.:.. seconded '.by. Councilman Gillanders,
-. Council authorized. :.additional sickleave- .in..the.amount of 6 days,
5 hours =pursuant'to Municipal-Code-Section 2351(c).
B. REQUEST FOR-APPROPRIATION OF FUNDS - ANIMAL CONTROL STUDY
Councilman Dennis stated :.the -Executive :.Board of the San Gabriel
Valley Animal: Control. Authority approved selection of a consultant
to assist in the selection of . :a site, the design, and operational
alternatives, for a...new.. shelter, _ pending final approval by the
member_cities Cost_ of the study. -will be $13,500 with each of
the seven member cities contributing equally.
Councilman..Tyrell moved to ratify the action of the Executive
Board. :relative:to hiring ..�a. consultant .in the amount of $13,500;
approve - expenditure :of. :1,929.as. Temple__ City's share of the costs;
and amend..: the-adopted- budget accordingly, subject to final approval
of the : delegates, :seconded_by : Councilman . Atkins, and carried,
Councilman Gillanders noting his opposition.
C. Councilman Dennis directed:Council's_attention to the Southern
California JPIA Newsletter_regarding_special events insurance which
may be appropriate for .use_by: cities engaged in any activities of
clubs within their :. cities, .. and requested . a_ staff report with
recommendations as soon as information is available from JPIA.
D. Councilman ..: Atkins :.stated .there ..is.a -bill, AB 893, introduced
by Assemblyman _.Roos . -to :establish a_ State. Commission empowered to
approve.: self - sustaining :.communities which_=would be exempt from all
local_planning::controls. The Commission,, .. if approved, would have
on its Board developer :.Nathan :Shapell. Councilman Atkins requested
a letter :go..out.to_.our representatives on the Senate and Assembly
opposing AB 893.
E. Councilman . Gillanders . :directed:Counc.il.'s attention to letter
received. from. Mrs. :Rderregardingt.the. impounding of her two dogs
which .. :he..: felt _was_harsh action, -Councilman Tyrrell_responded that
_the dogs: were_unlicensed and requested a staff report of the
_incident.
F. Councilman:Gillanders_ directed . -Council's.attention_to the
.Samari. Helmet : presented : to.the City.by.the.Japanese.Pony League
_ :team .visiting .. here, : and requested an appropriate letter of
_appreciation be sent.
G. Mayor Merritt expressed.:. appreciation .:.to.Councilman Gillanders
for attending .the :Japanese /Temple_City All_Stars game. and
presenting the plaque_ as well as accepting their. presentation
on behalf of the City.

On motion. by. Councilman Tyrell. seconded by Councilman Dennis,
