A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AFFILIATING
AGREEMENT FOR EDUCATIONAL SERVICES WITH THE
SCHOOL BOARD OF MIAMI-DADE COUNTY
DISTRICT/SCHOOL OPERATION, FOR FUNDING THE
YOUTH CRIME PREVENTION PROGRAM; PROVIDING
FOR INCORPORATION OF RECITALS; PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, the City Commission of the City of Opa-locka has previously voted to
accept Youth Crime Prevention Grant funds from the Miami-Dade County School Board, by
Resolutions 13-8529 and 12-8322; and
WHEREAS, the City will continue to use funds from the grant to prevent at-risk youth
between the ages of eight (8) and eighteen (18) from becoming involved in or returning to
criminal or deviant activity; and
WHEREAS, the City Commission of the City of Opa-locka desires the City Manager to
enter into an Affiliating Agreement for Educational Services with the School Board of Miami-
Dade County District/School Operation, to facilitate the program.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
Session 1. The recitals to the preamble herein are incorporated by reference.
Session 2. The City Commission of the City of Opa-locka, Florida, hereby authorizes
and directs the City Manager to enter into an Affiliating Agreement for Educational Services,
with the School Board of Miami-Dade County District/School Operation, for funding of the
Youth Crime Prevention Program.

Session 3. This resolution shall take effect immediately upon adoption.

Short Title:

Staff Summary:
The execution of the affiliating agreement will enhance the Crime Prevention Program by providing an
Alternative to Suspension program whereby students are supervised and receive academic assistance
and behavioral counseling during their suspension. This service is provided on campus.

Request: APPROVAL OF RESOLUTION AUTHORIZING THE CITY MANAGER
TO ENTER INTO AFFILIATING AGREEMENT WITH SCHOOL
BOARD OF MIAMI-DADE COUNTY DISTRICT/SCHOOL
OPERATION FOR EDUCATIONAL SERVICES FOR THE CRIME
PREVENTION PROGRAM.
Description: An Alternative to Suspension Program offers students in grades 6th — 12th,
enrolled in Dade County Schools a supervised environment, behavioral
counseling, academic assistance, and curriculum study based on their reason(s)
for suspension.
This agreement gives the City of Opa-locka Crime Prevention Program the
authority to accept students suspended from Miami-Dade County Public Schools.

WHEREAS,the City applied for,and has been awarded a Crime Prevention Grant from
Miami-Dade County; and
WHEREAS,the proceeds from the Miami-Dade County Grant will be used to prevent at-
risk youth,ages 8 through 18, from becoming involved in or returning to criminal activities; and
WHEREAS,the City Commission desires to accept the Miami-Dade County Grant for the
City of Opa-locka Crime Prevention Program,in the amount of Forty-One Thousand Six Hundred

CANCELLATION
This agreement may be terminated by either party by giving thirty (30) days written notice to the other party.
INDEMNIFICATION
Subject to the limitations of Florida Statute 768.28, the School Board of Miami-Dade County, Florida,
hereinafter referred to as the School Board, agrees to indemnify and hold harmless the Organization from
and against any and all claims, suits, actions, damages, or causes of action arising out of the negligent acts
of the School Board arising out of or in connection with the provisions of this agreement.
The Organization agrees to indemnify, hold harmless and defend the School Board from and against any
and all claims, suits, actions, damages, or causes of action arising out of the negligent acts of the
Organization arising out of or in connection with the provisions of this agreement. If the Organization is a
state agency or subdivision as defined in section 768.28, Florida Statutes, nothing herein shall be construed
to extend the Organization's liability beyond that provided in section 768.28, Florida Statutes.
GOVERNING LAW& VENUE
This agreement shall be construed in accordance with the laws of the State of Florida. Any dispute with
respect to this agreement is subject to the laws of Florida, venue in Miami-Dade County. Each party shall
be responsible for its own attorney's fees and costs incurred as a result of any action or proceeding under
this agreement.
CONFIDENTIALITY OF STUDENT RECORDS
Organization understands and agrees that it is subject to all School Board policies relating to the
confidentiality of student information. Organization acknowledges and agrees to comply with the Family
Educational Rights and Privacy Act("FERPA") and all state and federal laws relating to the confidentiality
of student records.

INSURANCE
Prior to commencing the on-campus location services under this agreement, the Organization shall obtain
and maintain without interruption Commercial General Liability Insurance with limits of no less than
$300,000 per occurrence. If the Organization provides transportation services of students under this
agreement, the Organization shall obtain and maintain without interruption Automobile Liability Insurance
with limits of no less than $300,000 combined single limit. "The School Board of Miami-Dade County,
Florida" shall be shown as additional insured with regard to the liability insurance. As evidence of the
insurance coverage, the Organization shall furnish a fully completed certificate of insurance signed by an
authorized representative of the insurance company providing such coverage. If the Organization is a state
agency or subdivision as defined by section 768.28, Florida Statutes, the Organization shall furnish, upon
request, written verification of the liability protection in accordance with section 768.28, Florida Statutes.

Alternative to Suspension Program
The City of Opa Locka Alternative to Suspension Program was derived from the overwhelming
number of students who are suspended from school within the Opa Locka/Miami Gardens
communities.
The program is located at: Sherbondy Village

Program hours are from 8:00-4:00 following Dade County School's calendar and dress code.
Because the program places emphasis on academics, students must be willing to cooperate and
focus on academics as assigned.
Help Goals:
• Provide a supervised alternative to juveniles suspended from Dade County Schools.
• Help juveniles understand the consequences of their behavior by providing behavioral
counseling and curriculum based on their reason(s) for suspension.
• Handle infractions in a non-judicial manner.
Eligibility:
• Dade County juveniles that are between the ages 13 -18.
$ Juveniles whose parent(s) is willing to be supportive.
e Juveniles whose school infraction(s) have progressed to school suspension
Program Services:
Certain infractions or incidents of school rules can result in a student being suspended.The
Alternative to Suspension Program has been designed to offer a supervised environment, which
helps the juveniles learn the consequences of their behavior while offering a non-judicial
resolution. Each juvenile is eligible to participate in the program 2 times during each school
year,depending on space availability and the discretion of the program director.
Minor infractions such as tardiness and truancy are not considered to be appropriate referrals.
Appropriate referrals would be minor drug and alcohol offenses on school grounds, minor
weapon offenses, attempted theft, repeated personal conduct violations, battery between
sll,dents,gang affiliated behavior (signs, colors,graffiti ),gross disobedient, inappropriate use
of school property (school phones, school computers) and other incidents as deemed
appropriate by the home school and the reporting program officials.Acceptance into the
program will reduce initial suspension by half. (A 10 day suspension would be reduced to 5
days at the Alternative to Suspension Program.)
While the juvenile is participating in the Alternative to Suspension program he/she may riot
attend or participate in any school activity or event and is prohibited from being on school
district property. In attendance days at the Alternative Program will be counted.
The student will receive full credit for all work completed that is handed in on the first day the
juvenile returns to home school. All participants must meet with the vice principal or
designated school official upon returning from the Alternative to Suspension Program and turn
in the notice of successful completion. If the program is not completed successfully, school
officials will be immediately notified and the original suspension will be enforced by the
school, and the school is allowed to pursue any additional options. Special Education students
will follow home school guidelines.
Upon successful completion of the suspension program,juveniles, at the discretion of the
program director may be invited to be involved in ongoing activities within the Youth Crime
Prevention Program which is also located at Sherbondy Village.

OF OPA-LOCKA, FLORIDA, TO AUTHORIZE THE CITY
MANAGER TO ACCEPT A MIAMI-DADE COUNTY GRANT
FOR THE CITY OF OPA-LOCKA YOUTH CRIME

WHEREAS, Miami -Dade County has now approved a continuation of the
Grant Funding for FY 20011-2012 in the amount of$41,650.00.
WHEREAS,the proceeds from the Miami-Dade Grant will be used to prevent
at-risk youth, ages 8 through 18, from returning or being involved in criminal and/or
deviant activities; and
WHEREAS,the Miami-Dade Grant is 100%grant dollars,with no City match required;and
WHEREAS,the City Commission desires to accept the Miami-Dade Grant for the city of
Opa-locka Youth Crime Prevention Program in the amount of Forty-One Thousand Six Hundred and
Fifty Dollars ($41,650.00).
NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA,FLORIDA:
