HomeMy Public PortalAbout1992-086Member Th ie 5 introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 470.•.84, RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO H.E. ANDERSON & SONS FOR A SUBWAY SANDWICH STORE AT 712 T . H.55 WHEREAS, H . E. Anderson & Sons (Applicant) has applied for a conditional use permit to convert a portion of an existing liquor store into a subway sandwich store at 712 T . H . 55 ; and WHEREAS , the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the planning commission and city council have reviewed the Applicant's request and have determined that granting a conditional use permit to the Applicant will not adversely affect the development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that a conditional use permit be granted for the stated purpose to the Applicant, subject to the following conditions: 1. There shall be no exterior storage allowed on the site; 2. All exterior signs on site must comply with city code requirements; 3. All exterior building materials shall meet city code requirements; 4. All rooftop mechanical equipment must be screened from view from adjacent properties and streets; 5. Six units of landscaping must be added to the site, including three units of trees; 6. Parking shall be worked out to the satisfaction of the city engineer and city staff; 7. Hard cover on the site shall not exceed 60 percent and paving and curbing shall be accomplished as required by the city engineer; 8. Hours of operation for the subway sandwich store shall be 24 hours per day, seven days per week. The liquor store hours of operation shall be as required by state law; RHBa1277 11E230-165 9. The number of employees shall not exceed seven for both the liquor store and sandwich store; 10. Exterior lighting shall be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; 11. A11 site drainage shall be accomplished as required by the city engineer; 12. There shall be no loudspeakers or outside telephone bells on site; 13. The fire department shall review the site for compliance with all fire code regulations; 14. The building and site shall meet all state and city building and health code requirements; 15 . There shall be no internal access between the liquor store and sandwich store; 16. The Applicant shall be charged for one additional SAC unit as required by the Metropolitan Waste Control Commission; and 17. The Applicant shall pay to the city an administration fee in an amount sufficient to reimburse the city for its costs in reviewing this application. DATED : ,A 1992 . Robert G. Mitchell, J .
