CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the M ayor at 9: 10 a.m. Present were Councilmembers Franklin H. Caplan, Edward London, Brett G . M oss, Oscar Sardinas, Fernando A. Vazquez, Vice M ayor Allison McCormick, and M ayor Jo e I. Rasco. A lso present were Village M anager Steven C. Williamson, Village Clerk Jocelyn B. K och, and Village A ttorn ey Chad Friedman. 2. PLEDGE OF ALLEGIANCE: M ayor Rasco led the Pledge of Allegiance. At this time an invocation w as given by Rabbi Avremel Caroline with Chabad of Key Biscayne. At this tim e M ayor Rasco addressed the public sending condolences to Frank Andrews and family fo r the loss of M egan W elsh A ndrews. Mayor Rasco sent prayers fo r the other family involved in this tragic accident and for those who are suffering. M ayor Rasco stated the reasons for calling the Special Council M eeting and reviewed the recent legislation, enforcement, and education regarding m otorized scooters and electric bikes in the Village. 3. EMERGENCY ORDINANCE: The Clerk read the fo llowing emergency ordinance, by title: AN EMERGENCY ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, FINDING A PUBLIC EMERGENCY AND PROHIBITING ELECTRIC BICYCLES, MOTORIZED SCOOTERS, AND OTHER MOTORIZED MOBILITY DEVICES ON ALL STREETS AND SIDEWALKS UNDER THE VILLAGE'S JURISDICTION; PROVIDING FOR ENFORCEMENT; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. M ayor Rasco m ade a m otion to adopt the emergency ordinance. The motion was seconded by February 16, 2024 Councilmember Caplan. The Attorney addressed the Council regarding the requirements for adoption, enforcement, and current regulations for Crandon Boulevard. The Mayor opened the public hearing. The following speakers addressed the Council: Miami-Dade County Commissioner Raquel Regalado, Stephen P. Clark Center, 111 NW l " Street, 220; Michelle Estevez, 425 Grapetree Boulevard; Andy Herrera, 250 Fernwood Road; Mike Davey, 50 Ocean Lane Drive; Francoise Dreuil, 799 Crandon Boulevard; Gene Stearns, 250 Cape Florida Drive; Patricia Romano, 361 Beechwood Drive; Rose Haney, 472 Glemidge Road; Luis de la Cruz, 640 Allendale Road; David Rocker, 791 Crandon Boulevard; Jennifer Buttrick, 180 Cape Florida Drive; Allene Nicholson, 769 Allendale Road; Toby Roher, 791 Crandon Boulevard; JoAnn Young, 600 Harbor Drive; Alan Fein, 525 Allendale Road; Maria Ines Torres, 791 Crandon Boulevard; Richard Heise, 781 Crandon Boulevard; Mark Fried, 525 Warren Lane; Karla Vigil-Berger, 250 Galen Drive; Anna Palm, 199 Ocean Lane Drive; Nisim Kaneti, 150 Ocean Lane Drive; Mauricio Gomez, 200 Ocean Lane Drive; Maria Gomez, 799 Curtiswood Road; Kathy King, protected address; Barry Glovsky, 251 Crandon Boulevard; Steve Simon, 335 Harbor Lane, and Armando Nunez, 320 Romano Avenue, Coral Gables. The Mayor closed the public hearing. There was discussion from Council regarding the above emergency ordinance and sending condolences to the families affected. There was additional discussion from Council and the Attorney regarding Crandon Boulevard, grace periods for fines, the amount of fines which are capped by state law, possible future impoundment, communications, and next steps. Councilmember Caplan made a motion to amend the ordinance to include electric skateboards, hoverboards, and one wheels that are motorized. The motion was seconded by Vice Mayor McCormick and approved by a 7-0 voice vote. The vote was as follows: Councilmembers Caplan, London, Moss, Sardinas, Vazquez, Vice Mayor McCormick, and Mayor Rasco voting Yes. Councilmember Caplan made a motion to eliminate the warning violation. The motion was seconded by Vice Mayor McCormick and approved by a 7-0 voice vote. The vote was as follows: Councilmembers Caplan, London, Moss, Sardinas, Vazquez, Vice Mayor McCormick, and Mayor Rasco voting Yes. There was discussion from Council and the Attorney regarding Crandon Boulevard being mentioned in the language of the ordinance. Vice Mayor McCormick addressed the administration regarding sending notifications to the public, the local schools and their PT A's, What's App chats and via the entry block sign. Councilmember Sardinas addressed the public regarding parent involvement and self-policing. 2 of3 February 16, 2024 The Attorney will bring back an ordinance at the next Regular Council Meeting regarding impoundment. The emergency ordinance was adopted, as amended, by a 7-0 roll call vote. The vote was as follows: Councilmembers Caplan, London, Moss, Sardinas, Vazquez, Vice Mayor McCormick, and Mayor Rasco voting Yes. 4. SCHEDULE OF FUTURE MEETINGS/EVENTS: A schedule of future meetings and events was presented to the Council. 5.
