RESOLUTION NO. qL - S9
RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO ANNE M. DONAHOE FOR AN OVERSIZED ACCESSORY
STRUCTURE ON LOTS 1 AND 2, BLOCK 1 THE BANTLE
FARM
WHEREAS, Anne M. Donahoe (Applicant) has applied for permission to
construct an oversized accessory structure at 2475 Bantle Farm Road, which
property is legally described as Lots 1 and 2, Block 1, The Bantle Farm; and
WHEREAS, the City's zoning ordinance requires a conditional use permit under
such circumstances; and
WHEREAS, the planning commission and city council have reviewed the
Applicant's request and have determined that granting a conditional use permit to
the Applicant will not adversely affect the development of adjacent properties .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina that a conditional use permit be granted for the stated purpose to the
Applicant, subject to the following conditions:
1. The accessory structure may not exceed a foot print of 4,000 square feet and
may not exceed a total of 5,500 square feet;
2. There shall be no exterior storage on the site;
3. Exterior lighting shall be designed and installed so that the globe is recessed
and enclosed on all sides except the bottom and no light is cast directly on any
other property;
4. There may be no more than eight horses maintained on the property at any one
time;
5. The accessory structure may be used for keeping horses and as a
garage/storage facility incidental to the horses. The use is solely accessory
to the use of the property for single family residential uses and no commercial
use may be made of the site, or structure;
6. There shall be no living facilities within the accessory structure;
7. The Applicant must maintain all fencing on the property in good repair;

8. Manure must be disposed of in accordance with the standards of the City and
of the Minnesota pollution control agency; and
9. The Applicant shall pay to the city an administration fee in an amount
sufficient to reimburse the city for its costs in reviewing this application.

The motion for the foregoing resolution was duly seconded by member
Ann Thies and upon vote being taken thereon, the following voted in favor
thereof: Councilmembers Mitchell, Thies, 7ietlow and Mayor Acromite.
and the following voted against same: None.
Absent: Councilmember Scherer.
Whereupon said resolution was declared duly passed and adopted.
