HomeMy Public PortalAbout08-20-2019 City Council MinutesMedina City Council Meeting Minutes 1 August 20, 2019 MEDINA CITY COUNCIL MEETING MINUTES OF AUGUST 20, 2019 The City Council of Medina, Minnesota met in regular session on August 20, 2019 at 7:00 p.m. in the City Hall Chambers. Mayor Martin presided. I. ROLL CALL Members present: Albers, Anderson, DesLauriers, Martin, and Pederson. Members absent: None. Also present: City Administrator Scott Johnson, City Attorney Ron Batty, City Engineer Jim Stremel, City Planning Director Dusty Finke, City Finance Director Erin Barnhart, Assistant City Administrator Jodi Gallup, Public Works Director Steve Scherer, and Chief of Police Ed Belland. II. PLEDGE OF ALLEGIANCE (7:00 p.m.) III. ADDITIONS TO THE AGENDA (7:00 p.m.) The agenda was approved as presented. IV. APPROVAL OF MINUTES (7:00 p.m.) A. Approval of the August 7, 2019 Regular City Council Meeting Minutes Martin noted that comments and proposed revisions were submitted from Anderson and herself for incorporation. Moved by Anderson, seconded by DesLauriers, to approve the August 7, 2019 regular City Council meeting minutes as amended. Motion passed unanimously. V. CONSENT AGENDA (7:01 p.m.) A. Approve Brush Grinding and Compost Removal Services Agreement with S & S Tree and Horticultural Specialists B. Approve Medina/Independence/Greenfield/Loretto Quad-City Agreement C. Approve Hamel Fire Department Acknowledgement of Financing and Written Agreement D. Resolution No. 2019-47 Accepting Donation from Robert Belzer and Family Albers asked if the mulch generated could be used by the City for other projects. Scherer explained that the material is very coarse and was previously being burned. He stated that the market has become saturated because of the change to solar energy. He noted that some material has been kept on hand for residents in the past but often became unusable before there was a desire for it. Moved by Pederson, seconded by Anderson, to approve the consent agenda. Motion passed unanimously. VI. COMMENTS (7:04 p.m.) Medina City Council Meeting Minutes 2 August 20, 2019 A. Comments from Citizens on Items not on the Agenda There were none. B. Park Commission Scherer reported that the Commission will meet the following night to discuss Walnut Park, which is a drainage and filtration area, noting that perhaps a better name/signage could be developed explaining the purpose as the area will most likely become a stormwater pond in the future. C. Planning Commission Planning Commissioner Galzki reported that the Planning Commission met the previous week to hold two public hearings. He reported that two Conditional Use Permits and a Variance were recommended for approval for the property at 1528 Homestead Trail to construct an accessory dwelling unit. He stated that the Commission also considered an Ordinance amendment related to residential setbacks and encroachments and recommended approval of the changes. VII. PRESENTATIONS A. Resolution No. 2019-48 Recognizing Jennifer Altendorf for Five Years of Service to the City of Medina (7:07 p.m.) Martin read aloud the proposed resolution recognizing Jennifer Altendorf for her five years of service to the City of Medina. Moved by Martin, seconded by Albers, to Adopt Resolution No. 2019-48 Recognizing Jennifer Altendorf for Five Years of Service to the City of Medina. Motion passed unanimously. Martin presented the resolution to Jennifer Altendorf. Barnhart commended Altendorf for the hard work she contributes to the finance department, noting that she pays extreme attention to detail and provides wonderful customer service. VIII. OLD BUSINESS A. Presbyterian Homes Conduit Bonds – Public Hearing Continued (7:11 p.m.) Martin continued the public hearing at 7:11 p.m. No comments. Martin closed the public hearing at 7:11 p.m. 1. Resolution No. 2019-49 Authorizing the Issuance of Revenue Obligations for the Benefit of PHS Founders Ridge, Inc.; Approving the Execution of the Revenue Obligations and Related Documents; and Taking Other Actions with Respect Thereto Moved by DesLauriers, seconded by Anderson, to Adopt Resolution No. 2019-49 Authorizing the Issuance of Revenue Obligations for the Benefit of PHS Founders Ridge Inc.; Approving the Execution of the Revenue Obligations and Related Documents; and Taking Other Actions with Respect Thereto. Motion passed unanimously. Medina City Council Meeting Minutes 3 August 20, 2019 B. Hamel Fire Department Transition Group Study Request (7:13 p.m.) Batty stated that there was discussion at the last meeting regarding whether the fire department is subject to the open meeting law. He stated that the relief associations of the fire departments are subject to open meeting law but the Board of the fire department, which is the group the Council has been invited to meet with, is not subject to the open meeting law. He explained that the purpose of his last memorandum was to address whether allowing more than two Council members to attend the meetings, even on a rotating basis, would trigger the open meeting law with regard to the city. He stated that he believes that allowing more than two Council members to attend the meeting, even on a rotating basis, could be considered a serial meeting of the city council and a violation of the open meeting law. Martin stated that if there is rotating attendance by the Council, each of the meetings then would need to be noticed as a meeting of the City Council, whereas if two Council members are chosen to attend in representation of the Council, the meeting would not be required to be noticed. Anderson stated that he believes that all Council members and members of the public should be welcome to attend if desired. Martin asked for discussion on option one, which would open the meetings to all members of the Council and public, or option two, which would have two members of the Council appointed to participate on behalf of the Council. Albers stated that he supports option two, as that makes the most sense. He noted that the Public Safety Liaison has been appointed by the Council and should attend the meetings along with the Mayor. Pederson noted that he would also support option two. Moved by DesLauriers, seconded by Albers, to adopt option two, to appoint DesLauriers and Martin to participate in the discussions with the Hamel Fire Department as outlined in the “Fire Department Transition Study Group” request letter from the Hamel Volunteer Fire Department, dated July 1, 2019. Further discussion: Anderson stated that if the motion is passed this will make the City appear to not be transparent or inclusive in this process. Motion passed 4 – 1 (Anderson opposed). IX. CITY ADMINISTRATOR REPORT (7:20 p.m.) Johnson had nothing further to report. X. MAYOR & CITY COUNCIL REPORTS (7:21 p.m.) Pederson noted that he and Johnson attended the Highway 55 Coalition meeting the previous week and provided a brief update. DesLauriers stated that he attended the annual picnic at the Mayor’s house and commented that it was a great night and opportunity to converse with City staff. APPROVAL TO PAY THE BILLS (7:22 p.m.) Moved by Anderson, seconded by Pederson, to approve the bills, EFT 005183E- 005201E for $81,940.65 and order check numbers 049161-049219 for $256,860.43 and payroll EFT 0509619-0509652 for $53,412.43. Motion passed unanimously. XII.
