HomeMy Public PortalAbout1982-08-31 MeetingMayor Attest: Village Clerk July 27, 1982 COUNCIL MINUTES August 31, 1982 The Council of Bal Harbour Village met Tuesday, August 31, 1982 at 9:30 A. M. in the Village Hall. Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of July 27, 1982, were approved as submitted. Mr. John Bruno, representing the owners of cooperative apartments on Lot 2, Block 4, Residential Section, said he had asked for time to speak today, inasmuch as he was not allowed to finish his testimony at the public hearing on residential street resurfacing held on July 23, 1982. He notified the village that his constitutional rights had been denied him. Mr. Bruno spoke at length protesting the unit method of assessment, stating that some lots are overassessed and some underassessed. He gave the Council a study he had done, which is a part of these minutes as follows: (1) plat showing the dinit System assessments againsteach of the 230 lots; (2) itemized statement of the 230 lots showing front feet, square feet of corners, and the Unit System assessments applied to each lot; (3) 1980 pamphlet relating to corner influences; (4) excerpts from Municipal Finance book used showing the 14 instances in which the front foot and area method was recommended to spread special assessments and only one paragraph pertaining to the Unit System; (5) He asked the Council to review four (4) letters received from M. A. I. Appraisers who all recommended the front foot and square footing method for irregulrrcorners to spread the Special Assessment. He asked for a reduction in the assessment on his building only. Mr. Gold recommended that the council reconsider Resolution No. 281 and, if they agreed with Mr. Bruno, they should reopen the public hearing. It was moved by Mr. Taplin, seconded by Miss Gray and voted to reconsider Resolution No. 281. The council dis- cussed Mr. Maley's method of unit assessment and determined that the assessments were fair. Mr. Bruno interrupted the discussion and stated he would withdraw his testi- mony so that the two extra meetings could be cancelled. He further stated he did not want the Village property owners to pay the added expense of two more meetings and expert witnesses, and did not wish to delay the resurfacing for 1 or 2 months. It was moved by Mr. Sherman, seconded by Miss Gray and voted that Resolution No. 281 be readopted confirming the assessment roll for the residential street resurfacing. August 31, 1982 Mr. Maley said that in his budget letter to the council he had explained some problems in the Water Department. The deficit in this year's operation was due to abnormal line losses during two months and the escalation cost of water. In his proposed budget he is asking for an increase in the water rate. Chief Staubesand said the number of complaints about beach users parking on private property has decreased, as the buildings have been putting a man there and drawing chains across their entrances. Mr. Gold said he had researched the law on police entering private property for the purpose of "booting" or having vehicles towed away and found there is no statutory authority for this. Mr. George Laiken said that more street lights on Collins Avenue were out and that it is dangerous to walk after dark. Mr. Maley explained that the village does not have replacement parts for the old lights and the new lighting system would be completed within 60 days. He said the median lights should be on in two weeks, which will help furnish light while the street light system is completely down to install new wiring for sidewalk and roadway lights. Mr. Gutenstein from the Sheraton Hotel said they would be glad to install spot lights on a temporary basis and perhaps some of the other buildings would do likewise while the street lights are out. Mr. Sherman said he would like to have an ordinance passed to have "Stop Signs" placed at hotel and apartment driveways on Collins Avenue and also signs saying not to block the sidewalk. Chief Staubesand said this is covered in the State Traffic Code. Mr. Maley said he will have the Chief survey the buildings on the east side of Collins Avenue and we will purchase and install the neces- sary signs and enforce the Code. Mr. Maley said that for the past three years an item of $100,000 for the future construction of a public works facility has been in the budget. These funds have gone into surplus funds. He said he now wishes the council's ap- proval for this project before he goes into extensive architectural plans. Mr. Neil Orange, of Ludovici and Orange, Village engineers, reviewed the meeting held with Mr. Maley and our Public Works Superintendent. Mr. Fraseur Knight, the architect selected to work with Ludovici and Orange on the design of the facility presented a rendering and explained the utilization of the tract. The Facility is estimated at approximately $400,000. Mr. Taplin questioned the cost and thought perhaps it could be scaled down. After discussion on the various needs of the maintenance department it was moved by Mr. Taplin, seconded by Mr. Sherman, and voted to go ahead with final plans so that it could be bid after the first of the year. Mr. Jerry Gutenstein of the Bal Harbour Resort Tax Advisory Committee ex- plained that they had requested beach lighting as part of the 1982 -83 proposed budget. Mr. Maley said that our electrical engineers had advised that lighting the beach from the top of the hotels and apartments would not be satisfactory due to various building heights and lot widths. The engineers have suggested lamps on 20 foot poles in the planting beds. It was suggested that as there was diverse opinions on the lighting of the beach, that the electrical engineers meet with members of the committee and council. The Village Clerk read Ordinance No. 240, by title only, raising the water rates to 95C/1,000 gallons. On motion of Miss Gray, seconded by Mr. Taplin, and voted the ordinance was passed on first reading. The Village Clerk read Ordinance No. 241, raising sewer rates to cover in- creased pumping charges, by title. On motion of Mr. Taplin, seconded by Mr. Beatty, and voted the ordinance was adopted on first reading. August 31, 1982 Mr. Gold read Ordinance No. 242, prohibiting underground garbage re- ceptacles, by title. On motion of Miss Gray, seconded by Mr. Beatty and voted the ordinance was adopted on first reading. Mr. Maley said that Bal Harbour Shops have presented a sketch showing elimination of the bus bay and taxi stand in front of the Shops on Collins Avenue. He said this poses two problems for the village. We need a safe bus -stop area in this location as the road curves at this point. Secondly, the pedestrian crossing should be moved south when this entrance to the Shops is replaced by parking. Mr. Steve Brody of the Bal Harbour Shops said they agree that a bus -stop should remain in the area. Mr. Maley said Dade County Traffic Department should be approached regarding the pedestrian crossing and the Metropolitan Transit Authority should be consulted about the bus stop. On motion of Mr. Taplin, seconded by Miss Gray and voted the meeting was adjourned at 12 :30 P.M. i Z�J Mayor Attest: Village Clerk August 31, 1982 BUDGET WORKSHOP MEETING August 31, 1982 The Council of Bal Harbour Village met to discuss the proposed 1982 -83 Budgets at 5:00 P.M. on Tuesday, August 31, 1982. Present: Miss Gray and Messrs Absent: Mr. Beatty Printup, Taplin and Sherman Also present were Fred Maley, Village Manager and Mary Wetterer, Village Clerk. Assistant Mayor Taplin called the meeting to order at 5 :10 P.M. Mr. Maley said he asked Mr. Martinez, our electrical engineer, to be present to explain the proposed beach lighting system to Mr. Gimel, repre- senting the Bal Harbour Resort Tax Advisory Committee and the Council. Mr. Martinez said his firm had surveyed the beach area and recommends the light- ing fixture he has with him, which would be mounted on a twenty foot fiber glass pole and be placed in the landscaped beds in front of the beachfront properties. This, in their opinion, would be more satisfactory than lights mounted on the various buildings to shine on the beach. (Mr. Printup arrived at 5:20 P.M.) It was decided that a sample light be installed in the landscape area in front of the Beau Rivage to study the effect. The council reviewed the proposed departmental budgets for FY 1982 -83. The budget for the police department was compared with the Town of Bay Harbor Islands. Mr. Maley said he would do a comparative study for the council. August 31, 1982
