The site plan documents were reviewed with the Applicant's assigned personnel and provided comment. On February 1, 2013 the applicant resubmitted a complete and revised site plan package. This request was presented to the Planning Council on February 12, 2012. Date of Application Pre-Application Procedures Prior to formal application for approval of any site plan, the applicant shall request and attend a mandatory pre-application conference with the appropriate City official(s) in order to become familiar with the City's development regulations and the subdivision process. At the pre-application conference, the applicant may be represented by his or her land planner, engineer and/or surveyor. Zoning Requirements A property within the City's corporate limits that is being proposed for development must be properly zoned by the City prior to submission of an application for approval of any site plan. In addition, the proposed development layout or design shown on the proposed site plan must be in conformance with all standards and requirements prescribed in the City's Land Development Code City Ordinance No. 86-8 and Miami-Dade County Subdivision Regulations adopted by City Ordinance No. 85-5 Completeness of Application Site Plan applications which do not include all required information and materials, as outlined below and per other City policies which may change from time to time, will be considered incomplete, shall not be accepted for official submission by the City, and shall not be scheduled on a Planning Council agenda until the proper information is provided to City officials. Effect of Approval The approval of a site plan shall be effective for a period of twelve (12) months beyond the date that the plan was approved by the City Commission. If this is not accomplished, then the approved site plan shall be deemed to have expired and shall become null and void. Revisions to Approved Site Plan Minor Revisions/Amendments— It is recognized that final architectural and engineering design may necessitate minor changes in the approved site plan. In such cases, the City Manager, or his/her designee, shall have the authority to approve minor modifications to an approved site plan and which shall be submitted as an "amended site plan,"which substantially conforms to the previously approved site plan, provided that such modifications do not significantly change traffic circulation, building location(s)on the site, proximity of building(s)to nearby residential areas, increase the size or height of building(s), or any other conditions specifically attached as part of the City Council's approval of the site plan. Submission materials and requirements for approval of an amended site plan shall be as determined by the City Manager or his/her designee. If the City Manager, or his/her designee, refuses to approve an amended site plan, then the applicant shall re-submit the amended site plan as a "revised site plan", whereupon the revised site plan shall be scheduled for consideration by the Planning Council and City Commission Major Revisions— In the event of revisions that are more extensive in nature and do not conform to the description for minor amendments above, a "revised site plan" must be resubmitted, reviewed by the City Manager, or his/her designee, and reconsidered by the Planning Council and City Commission. Developer's Agreement—A Developer's agreement may be required for all development except for single-family homes or duplexes pursuant to Section 4.16 of City Ordinance No. 86-8. 3 Site plan review shall not be required for single-family residential developments, unless the proposed subdivision will include a private amenity, facility or a golf course. In these instances, site plan submission and approval will be required for the private amenity or facility, or the golf course clubhouse/hospitality area. NW 37th Avenue Truck Traffic Projections Traffic Analysis for Room 2 Bloom Daycare February 2013 Narrative Summary Current Traffic Data: The attached FDOT Florida Online Daily Traffic and Truck Traffic Maps show that SR9 and NW 37th Avenue are the nearest roads to the proposed new 44-Child Daycare at the old Historic Opa-Locka Train Station located at 490 All Baba Avenue Opa-Locka, FL and that sufficient traffic for FDOT to track the traffic data. Traffic data for smaller roads is not currently available. 10-Year Traffic Projections: SR9: The FDOT Florida Traffic trend for the past ten years was examined to calculate traffic projections using the FDOT traffic projection template that incorporates the formulas used by FDOT to calculate traffic volumes and projections. The attached ten year traffic history for Passenger Vehicles on SR9 shows slight increases and decreases over the past ten-year period resulting in overall passenger traffic declining at an annual rate of a negative 1.32%. The projections for the next ten and twenty years show a continued passenger traffic decline. Truck traffic projections, however, show traffic remaining relatively stable over the past ten years with a modest average annual increase of 1.05%. The projections result in a projected modest increase in truck traffic on SR9 over the next ten and twenty-year periods. NW 37th Avenue: Again, the FDOT Florida Traffic trend for the past ten years was examined to calculate traffic projections using the FDOT traffic projection template that incorporates the formulas used by FDOT to calculate traffic volumes and projections. The attached ten year traffic history for Passenger Vehicles on NW 37nd Avenue shows stable to gradual decline in traffic over the past ten-year period resulting in overall passenger traffic declining at an annual rate of a negative 0.71%. The projections for the next ten and twenty years show a slight, but continued passenger traffic decline. Truck traffic projections, however, show traffic remaining stable over the past ten years with no average annual increase. Truck traffic is projected to remain the same along NW 37th Avenue over the next ten and twenty-year periods. Conclusion: With current year passenger traffic of 20,500 on SR9 and 11,700 on NW 37th Avenue and decreases projected over the next 10 and 20-year periods, the traffic Traffic Analysis for Room 2 Bloom Daycare February 2013 from the proposed 44-Child Daycare is not expected to have a significant or adverse impact. It is our estimation that the facility will have approximately 94 visits a day. This figure includes 5 staff members, 1 potential new client and parents of the 44 children visiting the facility twice a day (once in the morning and once in the evening). He stated that they wanted to open up a child care facility and have already received the necessary approvals from DCF. He hoped that the Planning Council approved the plans tonight and announced that he would answer questions regarding Room 2 Bloom. Steven Barrett called others to speak on behalf of Room 2 Bloom. Shelia Dudley presented herself as a joint partner for Room 2 Bloom. She said they have been trying to get this facility open for quite some time. They came before the Commissioners and the Commissioner had a list of requirements they had to meet. Since then,they have worked with Mr. Brown and Mr. Lee. She said she hopes that the council is able to approve the site plan tonight. Public hearing closed. Lee said that we want to give you some highlights concerning this particular site plan. (Through a power point presentation) There have been regulations already passed by the commission to allow for a TOD in the area where this site plan alludes to. Without the TOD in this zoning district,this use would not be allowed at this site. With those changes in mind,this application is a valid one. When we reviewed the site plan, we've determined that all the requirements have been met according to our land development code and the requirements of the TOD. This is the location of the TOD area and it is within this district. This is the actual site of the property. When we reviewed it, we find that everything that is required has been adhered to. Staff recommends approval with the condition that they comply with all the state and county regulations. That is the end of our presentation. Elio Guerrero gave a motion on the floor to approve staff recommendations,plus the five items the city attorney read into record. Alvin Burke seconded the motion. Upon roll call,the item passed 4-0. Address 780 Fisherman Street, 4th Floor, and Opa-locka,Florida 33054 Request: An Amendment to the City Ordinance 86-8, (Land Development Code) concerning fence heights in certain zoning districts. Attorney Calhoun announced the second item on the agenda. Brown said that the city has been struggling with the issue of fence heights city wide. He said that staff went around the city looking at all the types of fences allowed in the front yard. Brown stated that the Community Development&Planning department has had residents come to them requesting permits to erect fences. He replied that they have been telling residence that they cannot have a fence that exceeds 4 feet in height due to the fact that our code doesn't allow for that. Two years ago, staff brought a recommendation. Planning council recommended approval but the commission deferred it. We'll address the issue at hand. The issue at hand is that we are okay with fence heights for residential properties, if it is decorative. They are fences that are already up, Those fences are those that are not in compliance with the current zoning board ordinance. Our recommendation is to be consistent with what other boards are doing, what other communities are doing. We have an analysis that we prepared of what Dade County does and other cities in the surrounding area. It's our recommendation is that we increase the height to 6 feet,provided that the height is in provide that it is decorative in nature. Member Burke asked if we dealing with chain link and decorative fences, and if so what about wood fences? Brown replied that decorative fences which would include a wood fence. Brown asked Lee if the types were listed. Lee said that any fence that was not chain link would be decorative. Those plywood panel ones, rod iron or wood,particularly the ones that are ornamental top of the crest is the top of the height on the fence not the lower part. Burke said what he's speaking of is the wood fence they put in the back of the property so you can't see what's going on. Brown said that we didn't look at those opague wood fences in the front yard. You could have a decorative fence like a rod iron or metal picked fence, something you can see in the front of the building,without obstruction. Maybe we can tailor the language to only apply to decorative fences you could see throughout the building. Right now we're trying to fix the issue to allow folks to have decorative fences. Possibly add to the language that would allow a wooden privacy fence at 6 feet in height in the front yard. Guerrero replied that this survey was only the front of the property. Lee replied yes, on the street side of the property. Guerrero said because six foot wood fences would not be right. He said he could see the rod iron but 4 feet would be too small. He believed the change would be necessary. Brown asked if there was any draft language yet. Lee said no and there were no recommendations as of yet. Our tasks was to signature put in that fences,higher fences, as opposed to right now, in the front yard. Sometimes people are talking about keeping their pets in, or keep people out of their yard or whatever else. The recommendation is for safety sake, we are looking to the council for guidance on how you'd like to approach it. Brown said that we're just discussing this issue. We recommend that the height of the fences in the front yard be allowed to go up to 6 feet in height, as long as they are decorative.NO fence shall be erected that will obscure the view of the public right away,you can't see through the fence Planning Council Minutes 2/12/2013 Page 3 of 5 clearly the front of the building. It wouldn't be one that we could allow. Attorney Calhoun said that the purpose of this item tonight is just for discussion. I'm assuming we are going to draft something and bring it back to this board for them to consider and vote on. So we are capturing what they are suggesting, and that recommendation is made clearly to the commission. Brown said that we actually want the height increased to 5 feet as long as its decorative fence, 6 feet in height in the back yard. Burke said that if we did it tonight,then I wanted to put a wooden fence, we've already agreed on it and we haven't included the changes yet. He noted that it would still have to go before the Commission. Lee said that with your recommendation we are going to work with the City Attorney's office to make the changes exactly how you'd like. We want clearance for that height. Height is the issue what people are concerned about. You are the experts on that,to tell us if their other things that need to be considered. Our suggestion is 6 foot rod iron, decorative something in sort. We work on the language and it will reflect your suggestions will reflect that. Burke said the last time it came before us,we were dealing with chain link fences. We're not there anymore are we? Brown said I think you are talking about when we proposed the stuff for the barbed wire for the chain link fence. Remember a while back. The last time this came before us,we were talking about doing away with chain link and discussed about decorative fences in the front. Lee said that what is was. They wanted to do more than 4 foot. Burke said could you bring back what they requested before for the board,because they did it before my time. They already a recormendation before. Let's bring that back and look at that. Let's table it for the next planning council meeting. Guerrero said the language has changes. Because a chain link you can see through it. Brown said we'll work the City attorney's office and get specific language we need to adopt, which will include the height maximum for front yard fences, and the type of materials we will and not allow which will be the wooden opaque fence, or anything that obscures the vision. We will come with draft language so the council may review and make its recommendation. Attorney Calhoun said,just to be clear,your recommendation is for the R1 and R2 district? Brown said yes its for single family homes. Attorney Calhoun said we're just talking about amending those two sections of the code. Brown replied yes.
