HomeMy Public PortalAbout1992-102Member Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 92-102 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ROBERT BRADLEY FOR ACCESSORY STRUCTURES EXCEEDING THE NUMBER AND SIZE PERMITTED WHEREAS, Robert Bradley (Applicant) has applied for permission to construct a third accessory structure containing 3360 square feet on his property at 3000 Hamel Road; and WHEREAS, there are already existing on the property two accessory structures containing a total of 19,316 square feet; and WHEREAS, the City's zoning ordinance requires a conditional use permit when the number of accessory structures exceeds two or when they exceed 3,000 square feet; and WHEREAS, the planning commission and city council have reviewed the Applicant's request and have determined that granting the requested conditional use permit to the Applicant will not adversely affect the development of adjacent properties . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that a conditional use permit be granted for the stated purpose to the Applicant, subject to the following conditions: 1. The three accessory structures may not exceed an aggregate foot print of 16,500 square feet and may not exceed a total of 23,000 square feet. The new hay and equipment building may not exceed 3,500 square feet; 2. The accessory structure may be used for keeping horses and as a garage/storage facility incidental to the horses. The use is solely accessory to the use of the property for single family residential uses and no commercial use may be made of the site or structure; 3. The apartment located in barn is for the use of the Applicant's family or hired help only; 4. The kennel and storage building are for personal use only. No commercial use of the structures or site is permitted; and RHB44560 ME230-176 5. The Applicant shall pay to the city an administrative fee in an amount sufficient to reimburse the city for its costs in reviewing this application. BE IT FURTHER RESOLVED by the City of Medina, Minnesota that the City's willingness to grant this permit for three accessory structures containing almost 23,000 square feet is solely due to the size of the Applicant's property (approximately 188 acres) and that the City reserves the right to review this conditional use permit upon subdivision of the Applicant's property. The right to review this conditional use permit includes the right to modify the conditions under which it is issued or to revoke it if warranted in the opinion of the City.
