CONSENT AGENDA A. Approve 2019-2020 Liquor License Renewals – All renewal paperwork and fees have been submitted. Staff recommends approval. See attached memo. B. Approve Fireworks Display Contract Agreement with RES Pyro – The City received a proposal from RES Pyro for the Fireworks Display at Medina Celebration Day on Saturday, September 21st. RES Pyro has done an outstanding job on their fireworks displays at previous Medina Celebration Days and has matched the price from 2018 at $5,000. Staff recommends approval. See attached agreement. C. Change Start Time for the June 18, 2019 Work Session from 6 p.m. to 5:30 p.m. – Staff is recommending starting the work session at 5:30 p.m. to allow enough time to review WSB putting together a Chippewa Road concept plan and to begin 2020 budget discussions. No attachments for this item. D. Resolution Accepting Donation from Darlyne Whitman – Resident Darlyne Whitman has generously donated $100 to the Medina Police Department. Staff recommends accepting the donation and allocating it to the crime prevention fund. See attached resolution. E. Resolution Accepting Donations for the 2019 Bike Safety Rodeo – The City received $1,650 in donations from six area businesses/organizations to go towards the 2019 Bike Safety Rodeo. Staff recommends accepting the donations and thanking the donors. See attached resolution. VII. NEW BUSINESS A. Marshall and Schleeter Lot Line Rearrangement & Vacation – Public Hearing – The Marshall’s have requested approval of a lot line rearrangement of the property line between their property at 1495 Medina Road and the property immediately to the west, 1585 Medina Road. The applicants intend to convey approximately 4 acres of their land to the owners to the west. The applicants have also requested that the City 2 vacate drainage and utility easements adjacent to the property line being rearranged. The applicants propose replacement easements adjacent to the new lot line location. The subject properties are each approximately 20 acres in size, located south of Medina Road and west of Tamarack Drive. Both parcels are guided and zoned Rural Residential (RR). See attached report. Recommended Motion #1: Move to direct staff to prepare the resolution granting approval of a lot line rearrangement between 1495 Medina Road and 1585 Medina Road. Recommended Motion #2: Move to direct staff to present the resolution vacating drainage and utility easements 1495 Medina Road on the consent agenda in connection with the lot line rearrangement resolution. B. Peter & Laurie Maiser – Septic Wetland Setback Variance – PID #13-118-23-31- 0009 – Public Hearing – The Maiser’s have requested a variance to reduce the required 75-foot setback for an individual sewage treatment system (ISTS) from a wetland. The Maiser’s recently purchased the property to construct a new three- bedroom home. The applicant hired Rusty Olson’s soil testing to design a new system, but due to the periodically saturated soils, locations were extremely limited on the site. The proposed location (Septic Type A only), is on the highest ground on the property and the only area the designer will design a septic system on this lot. The Septic Type A site is less than 75 feet from an adjacent wetland. The groundwater is very high on the property and would not support a standard mound, even in this highest location. As a result, a Type III is proposed for the site. A Type III system is essentially an extra tall mound, providing more vertical distance above the underlying soils. The subject property is south of Medina Road and west of Hunter Drive. The property is zoned Rural Residential (RR) and is surrounded by other rural properties. The site is 9.57 acres in size. See attached report. Recommended Motion: Move to direct staff to prepare a resolution granting a variance from the 75-foot wetland setback for an ISTS subject to the conditions noted in the staff report. 3 X. INFORMATION PACKET: • Planning Department Update • Police Department Update • Public Works Department Update • Claims List Medina City Council Special Meeting Minutes 1 May 21, 2019 MEDINA CITY COUNCIL SPECIAL MEETING MINUTES OF MAY 21, 2019 The City Council of Medina, Minnesota met in special session on May 21, 2019 at 6:00 p.m. at the Medina Public Works/Police, 600 Clydesdale Trail, Medina, MN. I. Call to Order Members present: Martin, Anderson, Pederson, DesLauriers, Albers Members absent: Also present: City Administrator Scott Johnson, Public Works Director Steve Scherer, Sgt. Jason Nelson, and Public Safety Director Ed Belland II. Bob Mitchell Park Replacement Fund Gift Staff was recently notified by the Family of former Mayor Bob Mitchell that they would like to generously set up a Park Replacement/Trail Fund for the City of Medina. Staff provided an update on the proposed gift. Mayor Martin, Council Member Anderson, and City Administrator Scott Johnson had a conference call on May 9th with Eric Anderson from the Minneapolis Foundation to discuss options for the fund. Council directed staff to work with Mayor Martin and Council Member Anderson on a letter back to the Mitchell Family outlining possible plans for the fund. III. Tour of 600 Clydesdale Trail Public Works Director Steve Scherer and Public Safety Director Ed Belland provided the City Council with a tour of the facilities at 600 Clydesdale Trail. Approval of the May 7, 2019 Regular City Council Meeting Minutes 25 Martin noted that she provided comments that have been circulated from herself, 26 Anderson and DesLauriers. 27 28 Pederson noted on page five, line 25, it should state, “…incentivize intensified…” On 29 page seven, line 16, it should state, “Pederson recused himself abstained from the vote.” 30 31 Johnson noted that the minutes are meant to reflect what was said at the meeting and 32 believed that the statement included in the minutes is an accurate reflection. 33 34 Batty agreed that the minutes should reflect the statement that was made at the 35 meeting. He noted that the statement can be included in this set of minutes, as to the 36 intent at the previous meeting, rather than correcting the previous minutes. 37 38 Moved by Anderson, seconded by Albers, to approve the May 7, 2019 regular City 39 Council meeting minutes as amended. Motion 50 passed unanimously. 51 Medina City Council Meeting Minutes 2 May 21, 2019 1 VI. COMMENTS (7:04 p.m.) 2 3 A. Comments from Citizens on Items not on the Agenda 4 Fred Webber, 100 Clydesdale Trail, stated that a resident at his complex has asked if 5 CR 101 could be restriped, but noted that the County completed that action today. He 6 stated that one week ago there was a Cops and Coffee event hosted at his complex. He 7 stated that Belland and Nelson, along with other officers attended in addition to more 8 than 50 residents. He noted that there was a wonderful presentation from Belland, along 9 with a question and answer session. He stated that it was reassuring to think of what a 10 great police department Medina has and what a great leader Belland is for Medina. 11 12 Matthew Cole, 3375 Butternut Drive, stated that he has been working with Finke 13 regarding a variance for his property. He stated that he is working to build a deck on his 14 home and referenced the available space for a deck because of the setbacks on the 15 property. He commented that the planning staff has been great to work with and has 16 provided him with a wealth of knowledge on the topic. He stated that he has obtained 17 signatures in support of his variance from people within his Enclave neighborhood along 18 with those on Hunter Drive. He stated that the cost of the variance is $1,000 and that is 19 a lot of money. He stated that while they purchased the home knowing there was eight 20 feet available for the deck, he was uncertain as to the degree of difficulty that could exist 21 in obtaining a variance. He believed that the situation was created by Lennar. He stated 22 that he will continue to work with staff throughout the process. 23 24 B. Park Commission 25 Scherer reported that the Park Commission held the annual park tour the previous week 26 to complete a thorough review of the parks. He noted that the decision has been made 27 to complete a more comprehensive review of Hunter Lions Park. He stated that the tour 28 was a success and they are still reviewing comments. He noted that items that can be 29 resolved quickly, will be, and bigger items will continue to be discussed. 30 31 C. Planning Commission 32 Finke reported that the Planning Commission met the previous week to consider the 33 Uptown Hamel Report, which the Council previously received. He stated that ultimately 34 the Commission discussed next steps and future strategy. He stated that there are 35 some inconsistency issues related to the Comprehensive Plan that must be addressed 36 in the short-term, while the other elements can continue to be digested and engagement 37 can continue. 38 39 Martin stated that she began to put together a list of people that could be helpful in 40 continued engagement and noted that she would provide those names and contact 41 information to staff. 42 43 VII. PRESENTATIONS 44 45 A. Abdo, Eick, and Meyers – 2018 Annual Financial Report (7:16 p.m.) 46 Justin Nilson, Abdo, Eick, and Meyers, presented the 2018 Annual Financial Report. He 47 thanked staff for their help in preparing for the audit. He reported that the City received 48 a clean, or unmodified, opinion. He stated that regarding the Minnesota legal 49 compliance issue there were no findings. He reported that there was one minor finding 50 Medina City Council Meeting Minutes 3 May 21, 2019 related to an old consultant being listed on one of the investment accounts. He believed 1 that the issue has already been corrected. 2 3 Barnhart provided additional details. She noted that the mistake was not made by the 4 City but by the banking institution. 5 6 Martin asked if the report could be updated. 7 8 Nilson stated that proper procedures were taken and whether it was a mistake at the 9 bank or City, his firm could review that issue again. 10 11 Martin stated that she would appreciate an updated letter reflecting the information. 12 13 Nilson provided a summary of the different City funds and balances. He provided 14 comparisons of tax rate and taxes per capita of Medina to other similar cities. 15 16 Anderson referenced the comparison chart and noted that the Medina tax rates are very 17 favorable. He asked for details on interpreting the taxes per capita. 18 19 Nilson stated that the home values and industrial related activity would be factors. He 20 noted that he would have to research that a bit further. 21 22 Martin stated that it could also be helpful to have a similar graph showing tax value per 23 capita. 24 25 Pederson referenced the debt service funds for the bonds, which have low balances. He 26 asked if some cities choose to wipe those out. 27 28 Johnson confirmed that staff is in discussions with Ehlers to determine if some of the 29 lower balances could be paid off early. 30 31 Barnhart confirmed that Ehlers will verify call dates to determine if some of the bonds 32 could be paid off early and noted that the item will come back before the Council this fall. 33 34 DesLauriers referenced compensated absences and read aloud the text related to that 35 item. He asked if reserves should be created for employees with accumulated PTO. He 36 stated that he has been told that the time is accounted for when used rather than 37 accrued, which is different than in the private sector and asked for additional information. 38 39 Nilson stated that within the fund financial statements there is not an accrual for that but 40 that does show up in the long-term liabilities. 41 42 Barnhart stated that the City is currently fully funded for employees that are eligible for 43 retirement. She agreed that staff could work to assign funds for the rest of the staff that 44 has accumulated time. 45 46 Martin referenced the net position found in the financial highlights, noting that seems to 47 be the total assets rather than the net position. 48 49 DesLauriers provided clarification. He referenced the road improvement fund balance 50 and asked for additional information on any inconsistency. 51 Medina City Council Meeting Minutes 4 May 21, 2019 1 Nilson confirmed that one of the figures would be an error that could be updated. 2 3 Martin and the Council thanked Nilson for his report. 4 5 Moved by DesLauriers, seconded by Martin, to accept the 2018 Audit from Abdo, Eick, 6 and Meyers with the exception of the change related to road improvement on page 25 7 and to review page three on the authorized bank signatures to potentially remove that 8 based on information provided by the City. Motion passed unanimously. 9 10 VIII. NEW BUSINESS 11 12 A. Review Draft Ordinance Adding a New Section 360 and a New Section 365 13 to the Medina City Code Regarding Repeat Nuisance Calls and Disorderly 14 Houses (7:45 p.m.) 15 Johnson stated that adding nuisance houses to the Code would provide the police 16 department with another tool for enforcement. 17 18 Martin stated that she was having difficulty following the intent and how that tied into the 19 existing nuisance ordinance. She suggested a different type of redlining going forward. 20 21 Belland stated that this has come forward due to an issue that occurred the previous 22 year related to a problem property that caused issues for more than six months. He 23 stated that one of the departments that assisted with the search warrant suggested that 24 Medina look at a nuisance ordinance that would help when dealing with nuisance 25 properties that generate multiple police calls. He stated that this would allow the City to 26 go after these properties civilly for multiple generated police calls due to drugs, guns, 27 prostitution and other criminal activities. He explained that this would be an additional 28 tool for the department. He provided details on a nuisance house, which does not 29 address the specific criminal activities but would make the owner of the property 30 criminally liable. He stated that staff will continue to work on the draft with legal counsel 31 but wanted to bring this forward to the Council for input. 32 33 Anderson asked if most of these types of properties are absentee landlords and rentals. 34 35 Belland replied that not all the properties are rentals, some are owner occupied. 36 37 Anderson commented that he does not believe that the department can be tough 38 enough on these types of issues. 39 40 DesLauriers referenced the fees and asked if they would step up. 41 42 Belland noted that the fees have not yet been established. He confirmed that there 43 would be a step-up system. 44 45 Anderson agreed that the fees should be on a step-up basis. 46 47 Martin also agreed. She noted that language can be included in the draft ordinance that 48 would reference the fee schedule, so that the fee schedule could simply be updated as 49 needed rather than updating the fee schedule and ordinance. 50 51 Medina City Council Meeting Minutes 5 May 21, 2019 DesLauriers referenced the language stating that written notice will be provided to 1 property owners with more than two repeat service calls and suggested that the notice 2 be provided on every visit. 3 4 Belland stated that the department would not know if a property is a nuisance until there 5 is more than one call. 6 7 Batty stated that much of this was created based off an ordinance that he created for the 8 City of Maplewood. He explained that there are properties that suck up a 9 disproportionate amount of resources and this is an attempt to address that issue. He 10 stated that the idea would be to provide a warning after the second call and the fees 11 would be charged after the third call. 12 13 Martin stated that she would support sending the letter the first time to ensure property 14 owners are aware. 15 16 Batty stated that the letter could state that the property owner should be aware that the 17 City has a schedule and future issues could be addressed in such a manner. 18 19 Albers stated that there was nothing that jumped out at him. He stated that he did a lot 20 of cross referencing on language terms used, such as dangerous weapons. 21 22 Pederson stated that the step-up system for the fees could be like the alarm schedule. 23 24 Martin provided some grammatical suggestions. She confirmed the consensus of the 25 Council to direct staff to continue to move forward on this topic. 26 27 IX. OLD BUSINESS 28 29 A. Resolution No. 2019-34 Granting Site Plan Review Approval to Highway 55 30 Rental Portable Storage to Construct One Mini-Storage Building 4790 31 Rolling Hills Road (8:01 p.m.) 32 Johnson stated that Pederson is recusing himself from this vote and discussion. 33 34 Moved by DesLauriers, seconded by Anderson, to Adopt Resolution Granting Site Plan 35 Review Approval to Highway 55 Rental Portable Storage to Construct One Mini-Storage 36 Building at 4790 Rolling Hills Road. Motion passed unanimously (Pederson 37 recused). 38 39 X. MAYOR & CITY COUNCIL REPORTS (8:03 p.m.) 48 Martin reported that she and DesLauriers attend the Long Lake Fire Department 49 meeting. 50 51 Medina City Council Meeting Minutes 6 May 21, 2019 DesLauriers stated that it was nice to see how aggressive the organization is on 1 gambling (pull-tabs) and other sources of revenue to fund equipment purchases. 2 3 Martin stated that she, Anderson and Johnson held a conference call with Eric Anderson 4 to discuss how the City can work with Lucy Mitchell and her siblings to establish a fund 5 in Bob Mitchell’s name. She reported that she also attended the mayors’ dinner where 6 Dean Phillips, Chief of Staff, attended and provided an update on infrastructure. She 7 stated that she, Finke and Johnson met with the owners of the westerly parcel that 8 borders Town Line, to discuss the intended use of their property. 9 10 Pederson stated that he attended the park tour, which was a fun night. He noted that 11 there were a lot of residents in Hamel Legion Park that were not Medina residents. He 12 stated that Liz Weir did a great job obtaining signatures for the park maintenance fund 13 increase. He noted that it was incredible to see the high amount of use of Hamel Legion 14 Park. He noted that he also attended the bike rodeo and commented that the police 15 department did a great job with the event. He stated that he also attended an Uptown 16 Hamel meeting where Finke did a great job presenting information. He noted that 17 parking will be a challenge in Uptown Hamel. 18 19 DesLauriers asked if there is an update on the conduit bond funding. 20 21 Barnhart stated that Kennedy and Graven is in the process of obtaining the additional 22 conduit bond issuers, as four are needed. She stated that once that is complete, more 23 information will be available. 24 25 XIII. However, if before the date of the scheduled performance, the BUYER has not performed fully its obligations under the terms of this agreement or that the financial credit of the BUYER has been impaired, the SELLER may cancel this agreement at any time. In the event the BUYER does not perform fully all of its obligations herein, the SELLER shall have the option to perform or refuse to perform hereunder, and in either event the BUYER shall be liable to the SELLER for any damages, compensation or costs incurred including but not limited to attorney and court fees in addition to the compensation herein. The applicants intend to convey approximately 4 acres of their land to the owners to the west. The applicants have also requested that the City vacate drainage and utility easements adjacent to the property line being rearranged. The applicants propose replacement easements adjacent to the new lot line location. The subject properties are each approximately 20 acres in size, located south of Medina Road and west of Tamarack Drive. Both parcels are guided and zoned Rural Residential (RR). Most surrounding property is also RR, except Woodridge Church to the south, which is guided Institutional and zoned Rural Public/Semi-Public. The northeastern quadrant of the property is wetland, and there are also smaller wetlands in other locations on the property. 1585 Medina Road includes a single-family home in the northern portion of the lot, a barn in the center of the lot and small wetlands on the lot. Much of the property is pasture land. Lot Line Rearrangement As noted above, each subject property is currently approximately 20 acres in size, and the applicants propose to convey approximately 4.2 acres from 1495 Medina Road to 1585 Medina Road. The property proposed to be rearranged does not include any suitable soils, so will not cause either lot to be more nonconforming. The applicant has submitted soil borings for two septic locations on 1495 Medina Road which have been reviewed by the Building Official. As a result, staff does not have concerns with the proposed rearrangement. The proposed lots would meet other dimensional standards of the RR zoning district. The City’s subdivision ordinance establishes the following criteria: “the City shall deny approval of a preliminary or final plat if one or a combination of the following finding are made: (a) That the proposed subdivision is in conflict with the general and specific plans of the city, or that the proposed subdivision is premature, as defined in Section 820.28. (b) That the physical characteristics of this site, including but not limited to topography, vegetation, soils, susceptibility to flooding, water storage, drainage and retention, are such that the site is not suitable for the type of development or use contemplated. (c) That the site is not physically suitable for the proposed density of development or does not meet minimum lot size standards. (d) That the design of the subdivision or the proposed improvements are likely to cause substantial environmental damage. (e) That the design of the subdivision or the type of improvements are likely to cause serious public health problems. (f) That the design of the subdivision or the type of improvements will conflict with public or private streets, easements or right-of-way.” Marshall/Schleeter Page 3 of 4 June 4, 2019 Lot Rearrangement/Easement Vacation City Council Meeting As noted above, the proposed rearrangement does not affect the minimum lot size (contiguous suitable soils) of either lot, and all other dimensional standards are met. The rearrangement does not appear to meet any of the remaining criteria for denial. As such, staff recommends approval of the lot line rearrangement, subject to the following conditions: 1) The Applicant shall grant 5-foot drainage and utility easements adjacent to the new proposed lot line. 2) The Applicant shall abide by the requirements of the City Attorney related to title documentation and recording procedures. 3) The Applicant shall file necessary documents with Hennepin County to effectuate the lot line rearrangement within 180 days or the approval granted herein shall become null and void, unless an extension is granted by the City Council. 4) The Applicant shall pay to the City a fee in the amount sufficient to pay for all costs associated with the review of the lot line rearrangement and associated documents. Easement Vacation According to Minnesota Statute 462.358 subd. 7: “The governing body of a municipality may vacate any publicly owned utility easement…which are not being used for sewer, drainage, electric, telegraph, telephone, gas and steam purposes or for boulevard reserve purposes, in the same manner as vacation proceedings are conducted for streets…” According to Minnesota Statutes 412.851, “The council may by resolution vacate any street, alley, public grounds, public way, or any part thereof, on its own motion or on petition of a majority of the owners of land abutting on the street, alley, public grounds, public way, or part thereof to be vacated. When there has been no petition, the resolution may be adopted only by a vote of four-fifths of all members of the council. No vacation shall be made unless it appears in the interest of the public to do so after a hearing preceded by two weeks' published and posted notice.” The easement proposed to be vacated is the standard perimeter easement along the eastern property line of 1495 Medina Road. There are no utilities in the portion of the easement proposed to be vacated and replacement easements are proposed around the perimeter of the new property line. Staff believes it is in the public interest for the easements to be located along the perimeter rather than bisecting the lot. Staff, therefore, recommends approval of the vacation contingent upon the granting replacement easements. Potential Action Staff published notice for a public hearing on the proposed vacation for the June 4 meeting. The City Council should hold the hearing prior to consider the request. If the Council does not make any of the findings noted for denial above and meets City requirements, staff would recommend the following action: Move to direct staff to prepare the resolution granting approval of a lot line rearrangement between 1495 Medina Road and 1585 Medina Road. The Maiser’s recently purchased the property to construct a new three-bedroom home. The applicant hired Rusty Olson’s soil testing to design a new system, but due to the periodically saturated soils, locations were extremely limited on the site. The proposed location (Septic Type A only), is on the highest ground on the property and the only area the designer will design a septic system on this lot. The Septic Type A site is less than 75 feet from an adjacent wetland. The groundwater is very high on the property and would not support a standard mound, even in this highest location. As a result, a Type III is proposed for the site. A Type III system is essentially an extra tall mound, providing more vertical distance above the underlying soils. The subject property is south of Medina Road and west of Hunter Drive. The property is zoned Rural Residential (RR) and is surrounded by other rural properties. The site is 9.57 acres in size. An aerial of the site can be found at the top of the following page. Analysis City Code Section 720.09, Subd. 5 requires that ISTS “tanks and soil treatment and dispersal areas shall be setback a minimum of 75 feet from wetlands.” This requirement is a more restrictive standard which has been in place since at least 1999. State rules do not include a required wetland setback, although the required vertical separation from saturated soils acts as a practical setback. State rules do include a setback from lakes, streams, and public water wetlands (50-150 feet). The ISTS ordinance provides that a variance “may be granted provided that: 1. The granting of the variance is in harmony with the general purposes and intent of this Section, and is in in accordance with Minnesota Rules, Chapters 7080, 7081, and 7082. 2. The City Council determines that the applicant has established that there are practical difficulties in meeting the strict letter of this Section. 3. The condition causing the demonstrated difficulty is unique to the property and was not caused by the actions of applicant. The granting of the variance will not be contrary to the public interest or damaging to the rights of other persons in the vicinity.” In granting a request for a variance, the City may attach such conditions as it deems necessary to conform to the purpose and intent of this Section and to protect the health, safety, and welfare. The applicants have submitted a septic design from a septic designer who stated that a Type III system is required because there is less than 12 inches of periodically saturated soils. The designer has indicated that there may be a viable secondary septic location slightly downslope from Septic Site A, which is shown as Septic Site B on the site plan. Staff recommends that this variance request address Septic Site A only and that no approval be granted to a secondary site at this time. Circumstances may change, requirements may change, or there may be technological improvements which would affect an analysis for Septic Site B. The proposed location is approximately 55-feet from the wetland at the corner of the treatment area. Approximately two-thirds of the treatment area would be more than 75 feet from the wetland. The adjacent wetland is a small basin, which sits higher than the remaining wetlands on Peter and Laurie Maiser Page 3 of 4 June 4, 2019 Septic Wetland Setback Variance City Council Meeting the site. The septic designer has indicated that the proposed location is the best for an ISTS because it is the highest elevation. The City’s building official reviewed the information and stated that, in their opinion, a Type III system located 55 feet from a wetland would be acceptable since the State does not have a setback requirement from a wetland. It was suggested that a condition of the Variance be included to require a certified MPCA septic designer annually inspect the system for the first 5 years to verify the system is functioning properly. The City’s wetland protection ordinance is triggered by a variance application including disturbance within 100 feet of a wetland. An upland buffer is required with the construction of a new home. The applicants have shown an upland buffer near the Septic Site, however the buffer could be averaged to lessen width of the buffer nearest to Septic Site A. This has been placed as a condition of approval. Staff Recommendation Staff has reviewed the criteria described above for ISTS variances and has provided the following potential findings: 1. The granting of the variance is in harmony with the general purposes and intent of this Section, and is in in accordance with Minnesota Rules, Chapters 7080, 7081, and 7082. The 75-foot wetland setback is an additional standard beyond Minnesota Rules. Installing a type III system is in harmony with the purpose and intent of the ISTS ordinance. 2. The City Council determines that the applicant has established that there are practical difficulties in meeting the strict letter of this Section. No other location on the site can accommodate a septic system, which would appear to be practical difficulty. 3. The condition causing the demonstrated difficulty is unique to the property and was not caused by the actions of applicant. Staff believes it is fairly unique for an existing site with this much upland to have such limited locations for an ISTS. 4. The granting of the variance will not be contrary to the public interest or damaging to the rights of other persons in the vicinity.” Based on existing circumstances, it would appear that the variance is not contrary to the public interest because the location is expected to be more reliable because it is the highest point, even if closer to the wetland. The City Council should hold a public hearing on the proposed variance and consider testimony received. Following the hearing, if the City Council concurs with the potential findings described above, staff would recommend approval subject to the following conditions: Peter and Laurie Maiser Page 4 of 4 June 4, 2019 Septic Wetland Setback Variance City Council Meeting 1) The applicant shall establish an upland buffer with an average width of 20-feet from the wetland, with the area nearest Septic Site A to be reduced to 20-feet and wider in areas not near septic location. The buffer shall include appropriate vegetation, signage and documentation to be approved by City staff. 2) The septic system shall be inspected annually by a certified MPCA septic designer for the first five years to verify it is functioning properly. The applicant shall implement any recommendations made by the designer to improve functioning and longevity. 3) The variance shall be valid for a period of one year following approval. Following such time, the approval shall expire and be considered null and void unless the City Council grants an extension. 4) The Applicant shall pay to the City a fee in an amount sufficient to pay for the costs associated with reviewing the variance and other relevant documents. Potential Council Action If the Council finds the variance criteria are met, the following motion would be in order: Move to direct staff to prepare a resolution granting a variance from the 75-foot wetland setback for an ISTS subject to the conditions noted in the staff report. This site was purchased in September of 2018 by current Medina residents, Pete and Laurie Maiser, with the intent that they would build a new custom home there. The Maisers hired Sambatek to complete a wetland delineation of site (attached) after they purchased the land, and the prior owners, Dundee Farms, had hired Rusty Olson to complete a septic design prior to the sale of the parcel (attached). Mr. Olson's septic design cover letter says that the two sites he identified are the only places on the entire parcel where the septic sites will work, and he is recommending a type III design be used. The drain field for site A is approximately 55' from the nearby wetland at its closest point and cannot be moved according to Mr. Olson. The alternate site B is drain field is approximately 10' from the wetland boundary. Since this lot was platted prior to 1996 only one septic site is required by the state, so this variance request is specific to site A which will be the primary site in use. Norton Homes has designed a new, custom home for the Maisers, and its footprint and approximate location are shown on the attached existing conditions survey. In order for a designer to design a type HI system the designer must have reasonable assurance the system will function. The sites shown for the septic sites are on the highest ground on the Property. There is no guarantee that any septic system will function but the area shown is the best and only area this designer will design septic systems on this lot. The system is a type 111 because There is less than 12 inches to the periodically saturated soils. The city requires an operating permit to be in place for all type III systems. The city will set the requirements for the operating permit. Once the house size, location and septic primary and future sites are chosen this design can be completed. The periodically saturated soils were located at 0 Inches (mottled soil). Due to the periodically saturated soils, a pressurized mound system will need to he installed to trcat the septic effluent. The bottom of the treatment area must be located at least 3' above the saturated soils. The soils at a depth of 12" have a percolation rate averaging 11 MPI. All new tanks need to be insulated if there is less than two feet of cover over the top of the tanks. Clean outs must be installed on the end of the laterals for maintenance. A pumping chamber will need to be installed to lift the effluent to the treatment area. The power supply and switches must be located outside the manhole and pumping chamber in a weatherproof enclosure. A warning device must be installed with a light and sound device: this is in case of a pump failure. Use 7/32 -inch perforations on the laterals. Keep all heavy equipment off of the proposed treatment areas before and after construction. The treatment area must be fenced off before construction begins. This Design is not valid & the System will need to be relocated if failure to protect the areas proposed for the On -Site Sewage Treatment systems occurs. With proper installation and maintenance. this system should have no problem in treating septic effluent effectively. Nothing other than gray water. (laundry, showers, eta) Human water and toilet tissue should be disposed of into the septic tanks. Iron filters cannot go into the septic system. Garbage disposals are not recommended. The Marshalls want to convey approximately 4.2 acres to the Schleeters. The applicant has also requested the vacation of the easements along the rearranged lot line, which will be replaced along the new line. A public hearing is scheduled for the June 4 City Council meeting. B) Maiser Septic Variance – south of Medina Road, west of Hunter Drive – Norton Homes, on behalf of Pete Maiser, has requested a variance from the minimum 75’ setback for a septic system from a wetland. The septic designer stated that the only location for a septic is located approximately 55 feet from a small wetland on the lot. A public hearing is scheduled for the June 4 City Council meeting. C) Charlie’s Restaurant PUD Concept – 172 Hamel Road – Steve Andres has requested review of a Planned Unit Development (PUD) Concept Plan for construction of a restaurant at the corner of Hamel Road and Sioux Drive. The applicant seeks a PUD to provide flexibility to use cargo shipping containers for the building structure. The applicant has updated the concept following comments from the Planning Commission and City Council. A hearing on the updated concept plan will be at the June 11 Planning Commission meeting. D) Ditter Concept Plan – Jim Ditter, Tom Ditter, and Ditter Properties have requested review of a concept plan related to the potential subdivision of four existing parcels totaling approximately 25 acres into five lots. The Planning Commission and Council has previously provided comments on a six-lot concept. A hearing on the updated concept plan will be at the June 11 Planning Commission meeting. E) Munsell Wetland Buffer Vacation – 3157 Wild Flower Trail – Daniel Munsell has requested that the City vacate a portion of the wetland buffer easement in the back of their property in The Enclave. The applicant argues that the developer could have “averaged” the width of the buffer into adjacent open space owned by the City and proposes to narrow it upon their property. Staff is conducting a preliminary review and a hearing may be held at the July 2 City Council meeting. F) Cates Ranch Comp Plan Amendment and Rezoning – 2575 and 2590 Cates Ranch Drive – Robert Atkinson has requested a change of the future land use from Future Development Area to Business, a staging plan amendment to 2020, and a rezoning to Business Park. Staff is conducting a preliminary review and will schedule when complete for review, potentially at the July 9 meeting. G) Cavanaughs Meadowwoods Park Third Addition/OSI Expansion – Arrowhead Drive, north of Highway 55 – Arrowhead Holdings (real estate company for OSI) has requested approval of a site plan review, preliminary plat and rezoning to construct a 2nd building north of their existing facility. The applicant proposes to construct the building on a separate lot and to rezone the property to Business, in line with the updated Comprehensive Plan. The Council adopted approval documents on November 7. The applicant has now requested final plat approval. The applicant has also proposed some slight adjustments to the site plan, which were presented at the Planning Commission Planning Department Update Page 2 of 2 June 4, 2019 City Council Meeting on March 12. The Planning Commission recommended approval of the amended site plan. Staff will present to the City Council when the final plat is prepared. H) Richardson Lot Combination – PIDs 18-118-23-24-0116 and 18-118-23-24-0117 – Big Island Land LLC (Dale Richardson) has requested a lot combination of two vacant parcels along Ardmore Avenue, just west of County Road 19. The parcels do not meet relevant lot standards and the applicant desires to combine them to construct a single home. The application is currently incomplete, and staff has requested additional information. Staff will schedule when complete for review. I) Raskob Elm Creek Addition – 500 Hamel Road – The John W Raskob Trust has requested to subdivide the 8 acres (approximately 4 net acres) of property into two separate parcels so that the family could market the two separately. The Planning Commission held a public hearing at the April 9 meeting and recommended approval. The City Council adopted a resolution of approval at the May 21 meeting. Staff will await final plat application. J) Medina Mini-Storage Site Plan Review – 4790 Rolling Hills Road – Highway 55 Rental Portable Storable LLC (Jeff Pederson) has requested a Site Plan Review for construction of a 5,140 square foot mini-storage building within the existing paved area. The Planning Commission held a public hearing at the April 9 meeting and recommended approval. The City Council adopted a resolution of approval at the May 21 meeting. K) School Lake 2nd Final Plat, School Lake 2nd Easement Vacation, Johnson ADU CUP, Maxxon, Hamel Brewery, St. Peter and Paul Cemetery – The City Council has adopted resolutions approving these projects, and staff is assisting the applicants with the conditions of approval in order to complete the projects. L) Woods of Medina, Hamel Haven subdivisions – These subdivisions have received final approval. Staff is working with the applicants on the conditions of approval before the plats are recorded. Other Projects A) Uptown Hamel – Staff met with the Uptown Hamel Business Group and discussed the student project and continued the outreach on what the City can do to support activities in Uptown Hamel. Staff has also drafted an ordinance to update the density requirements for residential development in Uptown Hamel consistent with the updated Comp Plan. The ordinance also deletes the two “subdistricts” in Uptown Hamel and replaces with a single district. Public hearings are scheduled for the ordinance amendment and rezoning at the June 11 Planning Commission meeting and are tentatively scheduled to be presented to the City Council on July 2. B) County Road 19 sewer – staff prepared a draft of the “Quad-City Agreement” between Medina, Independence, Greenfield, and Loretto related to Loretto’s connection to the Tri-City sewer system. The agreement is being reviewed by staff, including the City Attorney before distribution. C) Zoning Enforcement – staff has issued two correction notices for zoning violations. If additional action is necessary, it will be presented to Council. D) Chippewa Road/Arrowhead Drive Concept – staff met to discuss a process to establish a concept for the construction of Chippewa Road from Mohawk Drive to Arrowhead Drive. Staff believes it is important to have this concept in place before adjacent properties develop. The action plan is scheduled to be discussed with Council at the June 18th 5:30 PM work session. Belland, Director of Public Safety, Through City Administrator Scott Johnson DATE: May 30, 2019 RE: Police Department Updates Cops and Coffee On May 16th we held a “Cops and Coffee” event at the Medina Ridges Senior Facility. There was a great turn out of over 40 people. Officer Gregory, Officer Hall, Investigator McKinley, Sgt. Nelson and I were present to talk to the residents and address their concerns. It was a great event. The next Cops and Coffee is in the planning stage, I will let you know when we have the location and date. Special Events We have several special event permit applications moving forward. Two are for the AutoMotorPlex with a “Cars and Coffee” event being planned for June 8th during the morning hours and a fundraiser on June 21st in the evening. I will be requiring them to hire extra officers for the events due to the expected large attendances. The third event is the 4th of July fireworks display planned for the Medina Country Club, and the fourth is the Hamel VFW is planning an event to coincide with our Medina Celebration Day recognizing Minnesota Veterans with a thank the Vets block party. It will bring in a flyover by F-16s and Navy seals parachuting into the Hamel ballfields. There will be a 5k race starting at 3:30 p.m. It will be a full day of activities. Budgets We are currently working through the budget process with the finance department. I believe we have the majority of numbers to Erin. All the fire departments have submitted preliminary numbers. Hamel Fire is working on a facility plan. The Fire Advisory Board will be meeting to discuss the details and the plan to move forward. Patrol Updates: For the dates of May 15 to May 29, 2019, our officers issued 52 citations and 157 warnings for various traffic infractions. There was a total of 2 traffic accidents, 7 medicals, 10 alarms and 3 DWI’s. Training On 5-21-19 we held a department meeting where we covered POST mandated policies. MEMORANDUM On 05-17-19, Officers Gregory and Scharf were dispatched to a suspicious vehicle in the southern part of the city. It was determined that the vehicle belonged to an active burglar that has been hitting several cities around Lake Minnetonka. The suspect had attempted to break into a residence in Medina off County Road 6 but was not successful. The suspect fled on foot and was not located. The case is still currently being investigated. On 05-20-19, Officer Scharf stopped a vehicle for speeding at 4:50 am. There was an odor of marijuana inside the vehicle and a subsequence search revealed felony levels of liquid THC. The case was forwarded to the West Metro Drug Task Force for charging. On 05-21-19, Officer Boecker was dispatched to a vehicle that had a flat front tire. A female had walked away from the vehicle and a male stayed behind. Corcoran Police were able to locate the female who ended up giving a false name to the officer. This was discovered by Officer Scharf when she was brought back to the vehicle. The female had outstanding felony warrants for fleeing police and was arrested and booked into jail. On 05-21-19, Officer Scharf was called to assist Corcoran Police with a female that had been involved with hitting mailboxes with her vehicle. Upon arrival, Officer Scharf determined that the female was intoxicated and was subsequently arrested. The final test result was .18. The female was booked into jail. On 05-22-19, Officers Hall and Gregory were dispatched to a shoplifting incident at Target. Upon arrival, Loss Prevention had a juvenile male in custody. The male admitted to making poor choices and was cited and released to his mother. On 05-24-19, Officer Gregory responded to a suspicious male knocking on a door call. Upon arrival, it was learned that the male was soliciting business but that the caller had also just been the victim of a separate scam where he was on his computer and a Microsoft virus pop up came on his computer. He ended up sending over $3500 in Best Buy gift cards to the scammers and then was asked for another $4000 but was stopped by his bank trying to take out more money. The caller was advised that he had been indeed scammed. On 05-28-19, Officer Converse took a call of unauthorized use of EBT cards at Aldi. Caller stated that he believed his ex-boyfriend had used an EBT card of his that he had left over three years prior. Case information was taken and will be forwarded to investigations. Investigation Updates: Assisted with the Bike Rodeo on May 18th. I provided tours of the detention area of the police department. I also discussed current crime trends in the city of Medina. Signed a criminal complaint for the stolen trailers from the Hamel Business area. Interviewed a juvenile with an employee from Hennepin County Child protection. The juvenile made allegations of possible domestic abuse in the household. After an investigation, there will be no charges. The family will be receiving services through Hennepin County. Reviewed a report of a hit-and-run at Target. I reviewed the video surveillance and determined the accident did not occur at Target. Investigating another hit-and-run in a housing development. The suspect vehicle has been identified. Will be making attempts to interview the suspect. MEMORANDUM TO: City Council, through City Administrator Scott Johnson FROM: Steve Scherer, Public Works Director DATE: May 30, 2019 MEETING: June 4, 2019 SUBJECT: Public Works Update STREETS • The railroad tracks have been realigned and new pavement has been installed by the city on Sioux Dr. There was a lot of coordination taking place to get this project completed and Public Works spent most of the week ensuring it was done correctly and on time. • WSB and Public Works have been working together to get punch list items done on several projects including Lennar, Toll/Pulte, Wealshire, and Fields of Medina. The city will be taking over the streets in these developments soon. • Public Works has been patching potholes throughout the city. WATER/SEWER/STORMWATER • Public Works is working closely with Toll Bros to get the inflow and infiltration (I/I) under control in the sanitary manholes throughout the development. We are negotiating with Toll to complete their portion of the project with a warranty guarantee as Pulte takes over. • The Brockton Lane project is underway. Storm sewer will be put in place this week. Unfortunately, the rain has been causing some delays with the project. • Public Works repaired a water service in the Elm Creek development. This repair was on the city side of the service, so we are responsible for the repairs. • We have had many drainage complaints in the past few weeks. We have been unplugging culverts, replacing bad culverts, and trapping beavers to address some of the issues. This is an ongoing process as drainage patterns change and rooftops are added. • We are working on the annual MS4 report which is due June 30th. PARKS/TRAILS • Our seasonal Public Works employee is on board and has been very busy with a long list of items within the parks. • Public Works has replaced several pavers in the Uptown Hamel area that were damaged by salt. We have had some conversations with the church to return the portion in front of the church back to concrete if the pavers keep deteriorating.
