HomeMy Public PortalAbout1992-104i Member Zietlow adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 92-104 RESOLUTION GRANTING PRELIMINARY APPROVAL FOR A LOT COMBINATION FOR REBECCA DUERR WHEREAS, Rebecca Duerr (Applicant) is the fee owner of certain property located in the Southwest quadrant of Willow Drive and Deer Hill Road; and WHEREAS, the Applicant has requested that two parcels be combined for all purposes, including compliance with the Medina zoning ordinance and subdivision regulations; and WHEREAS, the legal description of such property after combination will be as follows: That part of the west 429 feet of the 892 feet of the Northeast Quarter of the Northeast Quarter lying North of the South 725 feet thereof, Section 28, Township 118 North, Range 23 West of the 5th Principal Meridian. Also, That part of the Northeast Quarter of the Northeast Quarter of Section 28, Township 118 North Range 23, West of the 5th Principal Meridian lying North of the South 725.00 feet thereof and West of the East 892.00 feet thereof . WHEREAS, the matter has been reviewed by the Medina planning commission for compliance with city standards and procedures. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that preliminary approval is hereby granted to the Applicant for the above described lot combination, subject to the following conditions: 1. The Applicant shall execute such easements for drainage and utility purposes around the perimeter of the parcel and for drainage over low or wet areas on the property as the city engineer may require; RFID44562 ME230-160 2. The Applicant shall execute an easement for driveway purposes benefitting the combined lots over the property to the east and providing access from the combined property to Willow Drive; 3. The Applicant shall convey an easement for roadway purposes over such portion of Deer Hill Road as may be required by the city engineer; 4. The Applicant's survey must be modified to show the access point from the combined lots to Deer Hill Road as a farm road and not as a driveway; 5 . The combined lot shall not hereafter be divided without approval of the Medina city council. 6. The Applicant must submit a current abstract of title or Registered Property Abstract covering all of the combined property for review by the city attorney; and 7. The Applicant must pay to the City an administrative fee in an amount sufficient to reimburse the City for its costs and expenses in reviewing this application. Dated: November 17 , 1992.
