HomeMy Public PortalAbout1992-105Member Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO . g2-105 RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR G. L. CONTRACTING, INC. WHEREAS, G. L. Contracting, Inc. (Applicant) has applied for permission to operate a contracting business at 4300 Willow Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the planning commission has reviewed the Applicant's proposal and has determined that use of the property as proposed will not adversely affect development of adjacent sites. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit is hereby granted to the Applicant for the stated purpose, subject to the following conditions: 1. The hours of operation shall be limited to 6 a.m. to 8 p.m. , Monday through Saturday; 2. The number of persons employed on the site shall not exceed 16; 3. Any exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or right-of-way; 4. Site drainage must be accomplished in accordance with the plan submitted by the Applicant or as permitted by the city engineer or staff; 5. There shall be no exterior loudspeakers on the site; 6. The fire department shall review the site and proposed development for compliance with relevant codes and regulations; 7. No crushing may take place on the site except during the hours of 8 a.m. to 5 p.m. , Monday through Friday and only in compliance with the noise regulations of the Minnesota pollution control agency; RF1B44655 ME230-175 8. The height of the material piles shall not exceed 20 feet and the area dedicated to their use shall not exceed 25% of the usable portion of the site. The usable portion of the site is defined as that area within the berms, which contains eight acres; 9. Any signs must meet city code requirements; 10. The Applicant shall convey to the City the drainage and utility easements required by the city engineer; 11. The location of the hydrant on the property shall be determined by the city staff; 12. There shall be no hazardous or toxic materials brought onto the site; 13. The Applicant acknowledges that sanitary sewer will not be available to the site within the foreseeable future and that until sewer is available, holding tanks are the only practical method of sewage disposal for this site. When sanitary sewer becomes available to the site, the Applicant must connect and remove the holding tanks within one year; 14. The outside storage area shall not exceed 35 percent of the usable portion of the site; 15. The Applicant must install low flush toilets and low water use fixtures on the site; 16. The Applicant must post a surety bond with the City to be used in the event the holding tanks are not periodically flushed in accordance with city staff's recommendation; 17. The Applicant must provide a detailed landscaping and screening plan which shows the location of trees on the berms in accordance with staff's recommendation; 18. The Applicant must enter into a development agreement with the City designed to ensure development of the site to the extent and within the time frame outlined by the Applicant; 19. The Applicant must enter into a development agreement with the City regarding the height of material piles and the percentage of property used for outside storage; and 20. The Applicant must pay to the City an administrative fee in the amount necessary to reimburse the City for its costs in reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant be granted variances to permit holding tanks on the site and to exceed the percentage of the site dedicated to outdoor storage. The grounds for granting the hold tank variance is that the soils on the RRS44655 ME230-175 property are disturbed and cannot be used for on -site septic system. The grounds for granting a variance to exceed the allowable percentage of the site used for outdoor storage is that the usable portion of the site is surrounded by an earth berm which will mitigate the visual impact of the outdoor storage on adjacent properties and because soil compaction on the site makes construction of buildings difficult .
