Member Mitchell introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.92-109
RESOLUTION GRANTING A CONDITIONAL
USE PERMIT TO KATE GARWOOD AND BOB GARWOOD FOR
AN AMATEUR RADIO FACILITY AT 2200 TAMARACK DRIVE
WHEREAS, Kate Garwood and Bob Garwood (Applicants) have applied for a
conditional use permit for an amateur radio facility at 2200 Tamarack Drive; and
WHEREAS, the City's zoning ordinance requires a conditional use permit under
such circumstances; and
WHEREAS, the planning commission and city council have reviewed the
Applicants' request and have determined that granting a conditional use permit to
the Applicants will not adversely affect the development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina that a conditional use permit be granted for the stated purpose to the
Applicants, subject to the following conditions:
1. The height of the radio tower and antenna shall not exceed 80 feet;
2. Operation of the amateur radio facility shall not cause any interference with
radio, television or telephone communications in the area;
3. The tower and antenna shall not contain any lighting;
4. The base of the tower shall be constructed in such a manner as to discourage
climbing;
5. The tower and antenna shall be located a distance from the property lines at
least equal to their combined height;
6. The Applicants must comply with all regulations of the Federal Communications
Commission.
7. The tower and antenna shall be placed on the property in a location consistent
with the plans and drawings submitted by the Applicants and which minimizes
the impact of the facility on adjacent properties; and

8. The Applicants shall pay to the city an administrative fee in an amount
sufficient to reimburse the city for its costs in reviewing this application.

The motion for the foregoing resolution was duly seconded by member
Zietlow and upon vote being taken thereon, the following voted in favor
thereof: Councilmembers Mitchell, Thies, Zietlow and Mayor Acromite.
and the following voted against same:
Absent: Councilmember Scherer.
None.
Whereupon said resolution was declared duly passed and adopted.
