CITY OF MEDINA
RESOLUTION NO. 92-117
RESOLUTION ACCEPTING BID FOR IMPROVEMENT
PROJECT NO. 19053-B
WHEREAS, pursuant to an advertisement for bids for Improvement Project No.
19053-B for construction of a trunk sanitary sewer from the junction west of Tower
Drive westward along T . H . 55 to Willow Drive, bids were received, opened and
tabulated according to law, and the complying bids are summarized on Exhibit A
attachere hereto; and
WHEREAS, it appears that LaTour Construction, Inc. of Maple Lake,
Minnesota is the lowest responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota as follows:
1. The mayor and clerk -treasurer are hereby authorized and directed to
enter into a contract with LaTour Construction, Inc. of Maple Lake,
Minnesota in the name of the City of Medina for Improvement Project
19053-B, according to the plans and specifications therefor approved
by the city council and on file in the office of the clerk -treasurer.
2. The clerk -treasurer is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids, except that
the deposits of the successful bidder and the next lowest bidder shall
be retained until a contract has been signed.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the
City of Medina, Minnesota that acceptance of the bid of LaTour Construction, Inc.
and authorization to enter into a contract for performance of Improvement Project
No. 19053-B is contingent upon the following:
1. Receipt on or before January 15, 1993 of an Order from Judge Catherine
Anderson in the matter of City of Medina v . W.W. Farm sufficient to
allow the City to construct Improvement Project 19053-B; and

2. Receipt of a Petition and Waiver Agreement on or before January 15,
1993 from Wright -Hennepin Co-op.

The motion for the adoption of the foregoing resolution was duly seconded by member
Thies.
and upon vote being taken thereon, the following voted in favor thereof:
Mitchell, Thies, Zietlow and Mayor Acromite.
and the following voted against same: None.
Absent: Councilmember Scherer.
Whereupon said resolution was declared duly passed and adopted.
