CALL TO ORDER: Dr. Straus called the meeting to order at 7:40 PM.
PRESENT: Dr. John Straus, Dr. Barbara Beck, Steven Ward, Kristel Bennett, and Mark
Waksmonski.
District 2 Presentation: Sanitarian, Mark Waksmonski presented the July 2009
Environmental and Community Health Report to the Board. Mr. Waksmonski
highlighted the environmental inspections and the tobacco compliance checks. Mr.
Waksmonski spoke about the mosquito control program including larvaciding
Watertown's catch basins and the geese management program.
Mosquito Control: The Eastern Middlesex Mosquito Control Project Superintendant,
David Henley presented information to the Board, about Watertown's Mosquito Control
program. Mr. Henley said as part of the Mosquito Control program that there were 2,809
catch basins treated in Watertown between July 1st and July 6th. The Board thanked Mr.
Henley and asked to continue to provide updates.
Target Food Avenue: Kristel Bennett present the plan review documentation for Target
Food Avenue located at 550 Arsenal Street. Mrs. Bennett informed the Board the Mr.
Greg Schattert was representing Target Food Avenue and was requesting a Food Service
Establishment Permit. Mrs. Bennett informed the Board that the applicant has received
the in-service training regarding the requirements of the Food Code and had been
instructed as to their responsibility concerning the inspection process. After a brief
discussion Barbara Beck made a motion to approve the issuance of a 2009 Food Service
Establishment to Target Food Avenue. Dr. Straus seconded the motion. All were in
favor.

Gordon's Liquors: Mark Waksmonski informed the Board that Gordon's Liquors was
before the Board for a show cause hearing for a second violation of the Regulations of the
Watertown Board of Health Sale of Tobacco Products to Minors. Joseph Camm and
Rich Ricci, managers of Gordon's Liquors discussed the violation that occurred with the
Board of Health. Mark Waksmonski presented the findings of the July 29, 2009 tobacco
compliance check. After much discussion thereof, the Dr. Beck made a motion that
acting under the authority of the "Regulations of the Watertown Board of Health Sales of
Tobacco Products to Minors" regulations J (1)(b) "Violations", the Board of Health
suspend the Tobacco Sales and Location permit for Gordon's Liquors located at 51
Watertown Street, Watertown, for seven (7) consecutive business days commencing on
Monday, August 31, 2009. Furthermore, all employees associated with the sales of
tobacco products shall attend a mandatory Tobacco Retailer Training provided by the
Watertown Health Department. For the duration of the suspension, all tobacco products
shall be locked, secured, and covered not accessible to the public, only to employees. Dr.
Straus seconded the motion. All were in favor.
Mt Auburn Market: Kristel Bennett informed the Board that Mt Auburn Market was
before the Board for a show cause hearing for a second violation of the Regulations of the
Watertown Board of Health Sale of Tobacco Products to Minors. The Board took note
that the owner and/or representative were present at the hearing. Kristel Bennett
presented the findings of the July 28, 2009 tobacco compliance check. After much
discussion thereof, the Dr. Beck made a motion that acting under the authority of the
"Regulations of the Watertown Board of Health Sales of Tobacco Products to Minors"
regulations J (1)(b) "Violations", the Board of Health suspend the Tobacco Sales and
Location peunit for Mt Auburn Market located at 133 Mt Auburn Street, Watertown, for
seven (7) consecutive business days commencing on Thursday, September 3, 2009.
Furtheimore, all employees associated with the sales of tobacco products shall attend a
mandatory Tobacco Retailer Training provided by the Watertown Health Department.
For the duration of the suspension, all tobacco products shall be locked, secured, and
covered not accessible to the public, only to employees. Dr. Straus seconded the motion.
All were in favor.

77 Fayette Street: Kristel Bennett outlined the sanitary code history at 77 Fayette
Street and the outstanding sanitary code violations against, Ms. Madeline Jay, owner of
77 Fayette Street. Steven Ward provided an update based upon the August 26, 2009
inspection. After a brief discussion, Dr. Beck made a motion, to sustain the
condemnation order of the May 27, 2009 hearing, comply with the order to correct letter
dated May 15, 2009, and the subsequent letter dated July 30, 2009. In addition, the
recommendation that the Health Department would confer with counsel as to the liability
of filing the case in court. Dr. Straus seconded the motion. All were in favor.
Regulation — Keeping of Animals: After a brief discussion and review of the
"Regulations Governing the Keeping of Animals and Fowls", Dr. Beck made a motion to
adopt the "Regulations Governing the Keeping of Animals and Fowls". Dr. Straus
seconded the motion. All were in favor.
