HomeMy Public PortalAbout13-8570 Wastewater Infrastructure Projects Sponsored by: Mayor Taylor RESOLUTION NO. 13-8570 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA OPPOSING THE FREEZING OF GRANT FUNDS FOR OPA-LOCKA WASTEWATER INFRASTRUCTURE PROJECTS, INCLUDING REHABILITATION OF LIFT STATION 11C, BY THE UNITED STATES EPA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the United States Environmental Protection Agency (EPA) has previously indicated that it would be awarding the City of Opa-locka grant funds in the amount of $970,000.00, to assist with wastewater infrastructure improvements, including the rehabilitation of Sewer Pump Stations 11B and 11C; and WHEREAS, final environmental clearance for the project was received in February 2013; and WHEREAS, due to Federal Budget Sequestration, the EPA has frozen all grant funds, which may ultimately cause the City to lose $970,000.00 for rehabilitation of Sewer Pump Stations 11B and 11C; and WHEREAS, the City Commission of the City of Opa-locka believes that the loss of the funds will jeopardize the health, safety, and welfare of the residents of Opa-locka; and WHEREAS, the City Commission of the City of Opa-locka strongly opposes the actions of the EPA in freezing the funds, and requests that our Congresswoman, Senators and lobbyist assist the City in securing the release of the grant funds. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Resolution No. 13-8570 Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka hereby strongly opposes the action of the EPA in freezing these grant funds, which will impact the rehabilitation of Lift Stations 11B and 11C. Section 3. The City Clerk is directed to forward a copy of this Resolution to all State Legislators representing the City of Opa-locka and to all members of the Florida Congressional Delegation. Section 4. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this 27th day of March, 2013. Finance Dir/Grant Coordinator Mohammad Nasir, PE, City Engineer/CIP Director DATE: March 27, 2013 RE: EPA Grant Funding for Station 11C On Tuesday, March 26, 2013 at 9:00am, Mohammad Nasir, City Engineer and CIP Director and Charmaine Parchment, Grant Coordinator had a teleconference with Ms. Renea Hall, EPA Project Manager. Ms. Hall stated that at this time all grant funds are frozen due to the Federal Budget Sequestration and that she is not sure when the freeze will be lifted. The City was awarded grant funded totaling $970,000.00 which will be used to rehabilitate Lift Station 11C and 11B. The rehabilitation of the station 11C has been awarded to C&I Construction and Design, Inc. through a competitive bidding process and the contractor is waiting for the notice to proceed (NTP). We were waiting on EPA contract approval for Wastewater Infrastructure Improvements Project in order to issue the NTP to the contractor for the commencement of the construction of Lift Station 11C. At this point it is uncertain if or when the City will receive a contract. It is a possibility that the City could lose these funds. We have submitted all documentation which included a post application package, the environmental clearance which was received in February 2013, the RFI package and the contractor's contract. It has been more than a year that we have been working on securing this grant contract. We were expecting the contract agreement this month in order to commence the construction of the lift stations in particular lift station 11 C which is in operation with an emergency bypass system for more than three (3) months now. EPA's last minute decision to put the contract on hold is now putting the construction of 11C on indefinite hold. It also will impact the other funding source - the Miami Dade County Public Housing and Economic Development CDBG award - which already has an executed contract for$300,000.00. Given the urgency that the City is facing should Lift Station 11C fail, we are requesting the City Commission involvement to get our Congresswoman, Senators and lobbyist to aid the City in securing the release of these funds ASAP.
