HomeMy Public PortalAbout013-1995 Vacations1995002548 95MAR 13 PM 3: 41 WAYNE COUNTY RECORDER 4 ORDINANCE NO. 13-1995 A SPECIAL ORDINANCE VACATING NORTH 13TH STREET BETWEEN NORTH E AND NORTH F STREETS, NORTH 3RD STREET NORTH OF RICHMOND AVENUE, NORTH 4TH STREET NORTH OF THE SOUTH 'LINE OF RICHMOND AVENUE, AN ALLEY IN MENDENHALL & COFFIN'S ADDITION LOCATED BETWEEN SOUTH 14TH AND SOUTH 15TH STREETS IN THE FIRST BLOCK SOUTH OF EAST MAIN STREET, AND 30 FEET OF RIGHT-OF-WAY OFF THE SOUTH SIDE OF WOODSIDE DRIVE BETWEEN GRAVEL PIT ROAD AND U.S. 40 EAST. WHEREAS Mosey Real Estate, Inc., Norfolk & Western Railroad Company, Devon Realty Corp., and Primex Plastics Corp. have petitioned Common Council of Richmond, Indiana, requesting the vacation of North 13th Street between North E and North F Streets, and WHEREAS the City of Richmond, Indiana, and Purina Mills, Inc. have petitioned said Council requesting the vacation of North 3rd Street north of Richmond Avenue and North 4th Street north of the south line of Richmond Avenue, and WHEREAS Central United Methodist Church, Mary M. Taylor and William S. Starr have petitioned said Council requesting the vacation of an alley in Mendenhall & Coffin's Addition located between South 14th and South 15th Streets in the first block south of East Main Street, and WHEREAS Atlas Alchem Plastics, Inc., Linda Lou Richardson and the City of Richmond, Indiana, have petitioned said Council requesting the vacation of 30 feet of right-of- way off the south side of Woodside Drive between Gravel Pit Road on the west and U.S. 40 East on the east, and WHEREAS the owners of all land abutting the above described public ways have joined in said petitions requesting vacation, and WHEREAS said Council, pursuant to Indiana Code 36-7-3-12, conducted public hearings on each of said petitions March 6, 1995, after publishing legal notice thereof at least 10 days in advance of said hearings as required by statute, and WHEREAS the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04 (b), conducted public hearings on each of said petitions February 28, 1995, after publishing legal notice thereof at least 10 days in advance of said hearings as required by ordinance, and WHEREAS public meetings have been held by the City Planning Department with neighborhood residents in the vicinity of North 13th Street as it extends north of North F Street, and WHEREAS it is desirable to vacate all of said public ways; NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public ways described below are hereby vacated and the abutting property owners shall acquire ownership of the land heretofore dedicated as public ways as indicated below, to wit: 1. North 13th Street between North E and North F Streets; (a) Mosey Real Estate, Inc. acquiring a strip 51 feet wide beginning at the north edge of North E Street and extending north 245 feet, more or less, to land abutting said street on the west owned by Norfolk & Western Railroad Company; (b) Mosey Real Estate, Inc. acquiring a strip 18 feet wide beginning at the north end of said 51 foot strip, located 15 feet west of the east line of North 13th Street as originally platted, and extending 26 feet, more or less, to land abutting said Street on the east owned by Norfolk & Western Railroad Company; (c) Norfolk & Western Railroad Company acquiring a strip 33 feet wide beginning at the north end of said 51 foot strip, extending north 160 feet, more or less, along the west line of North 13th Street to a point 10 feet north of the north east corner of lot 363 in Elizabeth Starr's Addition; (d) Norfolk & Western Railroad Company acquiring a strip 33 feet wide beginning at the northwest corner of lot 467 in Elizabeth Starr's Addition and extending south 144 feet, more or less, along the east line of North 13th Street to land owned by Mosey Real Estate, Inc.; (e) Devon Realty Corp. acquiring a strip 18 feet wide and 15 feet west of the west ends of lots 468 through 471 in Elizabeth Starr's Addition; (f) Primex Plastics Corp. acquiring a strip 33 feet wide abutting the east ends of lots 359 through 362 and a 10 foot strip abutting the south lot line of lot 362 all in Elizabeth Starr's Addition; 2. North 3rd Street north of Richmond Avenue, the City of Richmond acquiring all of said land; 3. North 4th Street north of the south line of Richmond Avenue, the City of Richmond acquiring all of said land; 4. The alley abutting the lots 160 through 163, a strip 13 feet wide off the north side of lot 164, and lots 254 through 257, all in Mendenhall & Coffin's Third Addition to the City of Richmond, Indiana; (a) Mary M. Taylor acquiring a strip 10 feet wide abutting the east ends of 25 feet off the south side of lot 161, lot 162, and 37 feet off the north side of lot 163 in Mendenhall & Coffin's Third Addition; (b) William S. Starr acquiring a strip 10 feet wide abutting the east end of 13 feet off the south side of lot 163 in Mendenhall & Coffin's Third Addition; (c) Central United Methodist Church acquiring a strip 10 feet wide abutting the west ends of lots 254, 255, and 256 and all the land abutting lots 160, 25 feet off the north side of lot 161, and lot 257 in Mendenhall & Coffin's Third Addition; 5. 30 feet of right-of-way off the south side of Woodside Drive between Gravel Pit Road on the west and U.S. 40 East on the east; (a) Atlas Alchem Plastics, Inc.acquiring a strip 30 feet wide along the north side of its property which is identified as tracts number 46-36-310-202.000-29 and 46-36-310-203.010 on the Auditor's Map; and (b) Linda Lou Richardson acquiring a strip 30 feet wide along the north side of her property which is identified as tract number 46-36-310-203.000-29 on the Auditor's Map.
