HomeMy Public PortalAboutJuly 09 BOH Minutes BOARD OF HEALTH MEETING July 22, 2009 Town Council Chambers, Administration Building CALL TO ORDER: Dr. Straus called the meeting to order at 7:40 PM. PRESENT: Dr. John Straus, Cynthia Brooks, Steven Ward, Kristel Bennett, Cathleen Liberty, and Sarah Kinghorn. District 2 Presentation: Sanitarian, Cathleen Liberty and Public Health Nurse, Sarah Kinghorn presented the May and June 2009 Environmental and Community Health Report to the Board. Ms. Kinghorn highlighted and discussed Watertown involvement with H 1N 1, the communicable disease cases she had been working on, and the upcoming influenza season. Ms. Liberty discussed the Lead Law with the Board, as well as her research in a potential Biotechnology Regulation. 68 Maplewood Street: Kristel Bennett informed the Board that Areka DerKazerian, owner of 68 Maplewood Street, and her sons, Alan and Edward DerKazerian requested a hearing before the Board to modify the compliance time of the order to correct letter dated June 22, 2009. Kristel Bennett presented the findings of sanitarian, Mark Waksmonski's inspection. Mr. Alan DerKazerian on behalf of his mother informed the Board about the efforts to remedy the violations, but access to the dwelling had been denied. After much discussion thereof Cynthia Brooks made a motion to sustain the order letter for 68 Maplewood Street, and file a complaint in court. A reasonable access letter will be sent to the tenant for the purposes of correcting the violations. Dr. Straus seconded the motion. All were in favor. Diamond Nails and Tanning: Kristel Bennett presented the plan review documentation for Diamond Nails and Tanning. Mrs. Bennett informed the Board that Tram Nguyen was representing Diamond Nails and Tanning and was requesting a Tanning Establishment Permit. Mrs. Bennett informed the Board that the applicant has received Board of Health Minutes July 22, 2009 the in-service training regarding the requirements of the Tanning Establishment Regulations and has been instructed as to their responsibility concerning the inspection process. After a brief discussion Cynthia Brooks made a motion to approve the issuance of a 2009 Tanning Establishment Permit to Diamond Nails and Tanning. Dr. Straus seconded the motion. All were in favor. Easy Mart: Kristel Bennett present the plan review documentation for Easy Mart located at 39-41 Galen Street. Mrs. Bennett informed the Board the Mr. Moe Taha was representing Easy mart and was requesting a Retail Food Establishment Permit and a Tobacco Sales and Location Permit. Mrs. Bennett informed the Board that the applicant has received the in-service training regarding the requirements of the Food Code, the Tobacco Youth Access Regulations, and has been instructed as to their responsibility concerning the inspection process. After a brief discussion Cynthia Brooks made a motion to approve the issuance of a 2009 Retail Food Establishment and Tobacco Sales and Location Permit to Easy Mart. Dr. Straus seconded the motion. All were in favor. 77 Fayette Street: Kristel Bennett outlined the sanitary code history at 77 Fayette Street and the outstanding sanitary code violations against, Ms. Madeline Jay, owner of 77 Fayette Street. Steven Ward provided an update to the Board. After a brief discussion, Cynthia Brooks made a motion, to sustain the condemnation of order of the May 26, 2009 hearing, and provide a written plan to the Board of Health for accessing the dwelling to remove valuables, for cleaning the dwelling, and to raise the dwelling. Dr. Straus seconded the motion. All were in favor. Gerry's Italian Kitchen: Kristel Bennett informed the Board that Mr. Suhail Oweis of Gerry's Italian Kitchen was before the Board requesting a variance to utilize Time as a Public Health Control under Food Code 3-501.19 for pizza and calzones. The Board reviewed Mr. Oweis's submitted documentation. After much discussion, Cynthia Brooks made a motion that the variance for Time as a Public Control under Food Code 3-501.19 be denied for Gerry's Italian Kitchen. Granting the variance would remove an important Hazard Analysis Critical Control Point safeguard and potentially put the public at risk for 2 Board of Health Minutes July 22, 2009 Foodbourne illness. In addition, we would require Gerry's Italian Kitchen put pizza and calzones while on display in a NSF approved pizza warmer or proofing box. Dr. Straus seconded the motion. All were in favor. Upper Crust Pizzeria: Kristel Bennett informed the Board that Mr. Patrick Joyce and Mr. Barry Proctor of Upper Crust Pizzeria were before the Board requesting a variance to utilize Time as a Public Health Control under Food Code 3-501.19 for pizza. The Board reviewed Mr. Joyce's submitted documentation. After much discussion, Cynthia Brooks made a motion that the variance to utilize Time as a Public Control under Food Code 3- 501.19 be denied for Upper Crust. Granting the variance would remove an important Hazard Analysis Critical Control Point safeguard and potentially put the public at risk for Foodboume illness. In addition, we would require Upper Crust Pizzeria to put pizza while on display in a NSF approved proofing box. Dr. Straus seconded the motion. All were in favor. Old/New Business: Kristel Bennett outlined the sanitary code history at 41 Katherine Road and described the outstanding sanitary code violations against, Ms. Barbara Dziewanoski, owner of 41 Katherine Road. Mrs. Bennett informed the Board that outstanding sanitary code violations of the June 9, 2008 inspection no longer exist. After some discussion, Cynthia Brooks made a motion that based upon the report from the Health Director, Steven Ward and the Chief Environmental Health Officer, Kristel Bennett concerning the most recent inspection of the condemned property at 41 Katherine Road, the Board lifts the Condemnation Order issued on June 18, 2008 to Barbara Dziewanoski as the Board find that the Sanitary Code violations at the property upon which the Board based its condemnation Order no longer exist. The Board also finds that although the Condemnation Order is hereby lifted, the property may not be re-occupied until a Certificate of Occupancy is issued by the Watertown Building Department. Dr. Straus seconded the motion. All were in favor. Res4ulation—Keeping of Animals: The Board of Health discussed the proposed draft, plan review and application.
