ORDINANCE NO. 14-1995
AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 1995 FIREFIGHTER
SALARY ORDINANCE
WHEREAS Indiana Code 36-8-3-3 (d) requires Common Council to fix the annual compensation
of firefighters by ordinance before August 2 of each year for the ensuing budget
year, and
WHEREAS Such an ordinance was not timely adopted because a collective bargaining agreement
between the City of Richmond and Richmond Professional Firefighters, Inc.
AFL-CIO Local 1408 was still being negotiated, and
WHEREAS it is now possible to adapt a firefighter salary ordinance because the parties have
reached an agreement on salary levels for 1995, and
WHEREAS the Negotiating Committee for the Board of Public Works & Safety has negotiated,
said Board has executed and Mayor Roger Cornett has approved a collective
bargaining agreement between the City of Richmond and the Richmond
Professional Firefighters, Inc. Local No. 1408 of the International Association of
Firefighters AFL-CIO July 29,1993, which is attached hereto as Exhibit A,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana that
the following positions be compensated not in excess of the respective sums hereafter set forth during
calendar year 1995, to wit:

Dear Council Member:
Indiana Code 36-8-3-3 (d) requires Common Council to fix the annual compensation of firefighters by
ordinance by August 2 for the ensuing budget year. This was not possible because negotiations between
the City and Local 1408 were not completed.
The Board of Public Works & Safety passed a motion fixing firefighter compensation from January 1,
1995, to the effective date of this ordinance, as authorized by Indiana Code 36-8-3-3 (d).
Upon adoption of this ordinance, the pay increase is retroactive to January 1.
This ordinance can be adopted in a single meeting on two motions to suspend rules.

Attached is a copy of the fully executed 1995 addendum to the Firefighter's Agreement entered
into by the City and Local 1408.
Also attached is a copy of a memorandum of understanding which is not a part of the contract but
was the subject of comment at the last Council meeting.
Please suspend the rules and adopt Ordinance No. 14-1995 so as to enable the Finance
Department to adjust the various items on each Firefighter's paycheck within the first calendar
quarter of 1995.

ADDENDUM TO PROFESSIONAL NEGOTIATION
AGREEMENT BETWEEN RICHMOND
PROFESSIONAL FIREFIGHTERS, INC., LOCAL 1408
OF THE INTERNATIONAL ASSOCIATION OF
FIREFIGHTERS AFL-CIO and the CITY OF
RICHMOND, INDIANA
THIS ADDENDUM supplements that certain "Professional Negotiation Agreement"
dated the 29th day of July, 1993, and entered into between RICHMOND
PROFESSIONAL FIREFIGHTERS, INC. AFL-CIO LOCAL 1408, and the CITY OF
RICHMOND, INDIANA, as follows:
ARTICLE 32
Increase the annualized rates of pay provided in Article 32 by three percent
(3.00%) for the period from January 01,1995 through December 31,1995, as follows:
Probationary firefighter $22,856
Firefighter H $24,583
Firefighter I $24,907
Driver/Operator (Engineer) $25,934
Lieutenant $26,962

Add the following new section within ARTICLE 32 to read as follows:

Beginning January 01, 1995, the City shall contribute for each member of the bargaining
unit as defined in Article 3 of this Agreement, a sum of one percent (1.00%) of the salary
of a first class firefighter to the appropriate pension fund, as applicable to that particular
member, as a partial employer contribution, as contemplated by the provisions of Indiana
Code (I.C.) 36-8-7-8(5) or by I.C. 36-8-8-8(A). The sum of one percent (1.00%)
contribution by the City effectively reduces the member's contribution to the fund by one
percent (1.00%).
MEMORANDUM OF UNDERSTANDING ( not a part of the contract)
In view of the fact that ratification of the above provision regarding a partial contribution
by the City on behalf of the member to the appropriate pension fund will take place at
least two months into the 1995 contract year, this provision will still be effective as of
January 01, 1995. Excess withholdings from each member's pay for pays occurring
prior to City's implementation of the new withholding formula will be rebated by adding
the gross amount of prior excessive Member withholdings and allocating said sum
equally, or as nearly equally as possible, over the remaining pays in 1995. City agrees to
have in place the proper system for pension withholding that will reflect City's one
percent (1.00%) partial pension contribution by no later than the final pay in March of
1995.
ARTICLE 28
Add the following sentence to the end of Article 28, Medical Insurance:
"During 1995, the aggregate amount of the member's share of the
health insurance premium for the selected type of plan coverage
shall not be increased above the premium level that prevailed on
November 1,1994."

(Emergency Medical Services) responses system within the
Richmond Fire Dopartaent until the terms and conditions
of such are negotiated with the Riabnond Professional
