A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD AMENDING THE MEMORANDUM
OF UNDERSTANDING WITH THE LYNWOOD FIRE
FIGHTERS ASSOCIATION
WHEREAS, Collective Bargaining was entered into in
good faith by a bargaining team from the Lynwood Fire Fighters
Association,. consisting of Donald Blaydes and Jerry Wallace,
and a Management Team representing the City of Lynwood, consist-
ing of Edward J. Valliere, City Manager, and Gerard Goedhart,
Administrative Assistant; and
WHEREAS, an agreement has been reached between the
Lynwood Fire Fighters Association and the City of Lynwood Manage-
ment Team; ~ and V M
WHEREAS, the Lynwood Fire Fighters Association and the
City of Lynwood Management Team respectfully submits this
Memorandum of Understanding to the City Council of Lynwood for the
purposes of amending the current Memorandum of Understanding;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
DOES, FIND; DETERMINE, ORDER AND RESOLVE THAT:
1. The Memorandum of Understanding be amended by the new agree-
merit between the Lynwood Fire Fighters Association and the
City of Lynwood Management Team.
2._-That the relevant resolutions and provisions be prepared to
reflect said agreement.
PASSED, APPROVED, AND ADOPTED THIS lath day of

SUBJECT: MEMORANDUM OF UNDERSTANDING WITH THE LYNWOOD FIRE
FIGHTERS ASSOCIATION
Gentlemen:
Attached you will find the Memorandum of Understanding which
has been agreed to by staff and the Lynwood Fire Fighters Association.
The agreement is for three (3) years and changes the current memo-
randum as follows:
1. An annual salary adjustment equal to the Area E Cities base
salary plus any benefit that an Area E city contribu:tes~in
lieu of an employee. '
2. A change in the Longevity Program from $250; $350 ,and~$500
to $250, $500 and $750.
3. A change in the City's Bereavement to. allow up to' two (2)
full shifts, but only at the Fire Chief's discretion and
approval.
~. A change in the City's step increase policy from a step
increase ever-y six (6) months. to that of a probationary
period of six (6) months, and other step increases to be
considered on the basis of merit and only after intervals i
of one (1) year.
5. A residency requirement for all new Fire Fighters which
will require them to locate within 20 minutes of the City's
boundary. ~
At this time, it is impossible to calculate the cost of this.
agreement since it is tied to the. ,average of Area E. -But it. 'should '
be, pointed out that City will save money by. the change in the step '
increase policy and that the City will be~well prepared for emer-
gencies through the residency requirement.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF LYNWOOD
AND THE LYNWOOD FIRE FIGHTERS ASSOCIATION
The wages, hours and conditions of employment that .are set
forth in this memorandum have been discussed and jointly proposed
by and between the Municipal Employee Relations -0fficer of the
City of Lynwood (hereinafter call "City") and the Lynwood Fire
Fighters Association (hereinafter called "Association") and shall
apply to all employees of Lynwood working in the classifications
as set forth herein. The terms and conditions of employment that
are set forth in this memorandum have been discussed in good faith
between City and Association; and the Municipal Employee Relations
Officer agrees to recommend to the Lynwood City Council that all
of the terms and conditions of employment as set forth herein be
incorporated in full in a resolution of the City Council or where
appropriate, in a policy statement. Upon the adoption of such a
resolution and/or policy statement, all the terms and conditions
of this memorandum so incorporated, shall be effective without any
further action by either party.
ARTICLE I
EMPLOYEE RECOGNITION
City hereby recognizes the Lynwood Fire Fighters Association
as the recognized representative for all members of the Association
to the fullest extent allowable under California law applying to
public employees and as further defined in Resolution No. 6926.;
adopted by the Lynwood City Council on May 20, 1968.
ARTICLE II
CITY RIGHTS
A. It is understood and agreed that the City retains all of its
powers and authority to direct, manage and control to the full
extent of the law. Said powers and authority include, but
are not limited to, the exclusive rights to: determine its
organization; direct the work of its employees; determine the
times of operation; determine the kinds and levels of services
to be provided, and the methods and means of providing them;
establish its policies, goals and objectives; determine staff-
ing patterns; determine the number and kinds of personnel.

move, modify or close facilities; establish budget procedures
and determine budgetary allocations; determine the methods of
raising revenue; contract out work; and take.action on matters
in the event of emergency. In addition, the City retains the
right to hire, classify, assign, evaluate, transfer, promote,.
terminate and discipline employees.
B. In cases of emergency., the City retains sts right to amend,
modify or rescind provisions of this Memorandum. Such amend-
ment, modification or rescission shall remain in force only
for the period of the .emergency. The determination of whether
or not an emergency exists is solely within the discretion of
the City Council.
Section 1. Effective June-l, 197g, any employee hired or promoted
to Step A of a different range of pay shall receive the Step B
4 salary at the successful completion of the probationary period.
Increases to Step C, D and E within any pay range shall be based
on satisfactory job performance by the individual and shall'be
reviewed at least at the following intervals:
Step C - One (1) year after the Step B increase
,~ Step D - One (1) year after the Step C increase `
~~ Step E - One (1) year after the Step D increase -.
Section 2. Employees hired or promoted to any step above Step A
shall receive the next step at the successful completion of the
probationary period. Other increases within the range shall be~
followed in the method described in Section 1.
ARTICLE IV
SALARIES/WAGES
Section 1. Effective on October l; of the new fiscal year or
when the Cities of Vernon, Montebello, Santa Fe Springs, Downey
and Compton (hereinafter called."Area E Cities") have concluded.
negotiations with their respective Fire Department employees,
whichever is earlier, the City will increase all ranks an amount
to~e,qual the average pay of the Area E Cities for such ranks.
(a) The average pay is defined. as the base salary plus any
.employee contribution for retirement that Area E cities
contribute in lieu of the. employee.
(b) Will also include half the amount of dependent's medical
insurance that Area E cities contribute in lieu of their
employee, provided, however, that this portion of average
pay. shall be calculated by a separate comp.u~:ation apart
from the calculation of subsection (a) hereof, and pro--
video further that the City shall-not be required to
.pay more than $30 per month by reason of this subsection
(b)•
Section 2. The average pay, when calculated, will be retroactive
to the first payroll period of each fiscal year beginning iri July..
Section~3• In the event that the Area E cities negotatioris.result
iri a benefit currently not available, the Association may request
the City to amend the wage formula to include the above benefit.
ARTICLE V
BEREAVEMENT
Subject to'~~the Fire Chief's discretion and approval, any employee
may be allowed up to .two full shifts for bereavement 'purposes.
ARTICLE VI
_ RESIDENCY REQUIREMENT
Sect on 1. Effective July 1, 1979, any Fire Fighter hired will be
required to locate within 20 minutes normal driving time of the
City 'boundary. The City's determination of the areas included
within 20 minutes normal driving time of the City boundary shall
be~final and, conclusive. This will be required by: the end of the
probationary period iri order.to successfully complete probation.

Section 2. Any Fire Fighter, Engineer;. or Captain employed before
July 1, 1979,~w11 be exempt from the residency requirement.
ARTICLE VII

Employees~shall~receive longevity pay as follows:: .
-After 5 years employment - $250'additiorialannual'pay over-
. - base pay.
,After 10 years employment - $500 additional annual pay over

ARTICLE"VIII ,
FULL FAITH 'AND CREDIT. CLAUSE ~ ,.

For purposes of .administering the terms and,provsioris of the
~~ various ordinances, resolutions; rules and regulations which may
be adopted by_the City pursuant~to this Memorand-um~of Understanding,
.all matters resolved. in Memorandums of Understanding for prior years,
:all resolutions of the City Council, and all existing mat.te'rs rem
solved regarding wages; hours, fringe benefits and conditions of
employment prior to Myers-Mlias-Brown Act of 1968,,wi11 remain un-
changed and. unaltered except where expressly changed or altered in
this Merriorandum of. Understanding., F ~ ~.
ARTICLE IX
SAVINGS CLAUSE
.Any resolution, of the-City iricorporatng~any provisions of this
memorandum ~sliall provide that if any provision of this memorandum

to be contrary to any law by any court of .proper jurisdiction, the
remainder of this memorandum and the remainder of such resolution
shall be affected thereby and shall remain in full force and effect.
ARTICLE X
DURATION
This agreement is to cover said employees for three (3) years
from July 1, 197g to June. 30, 1g82.,
