CITY COUNCIL
MINUTES
OCTOBER 20, 1981
INITIATION:
1. CALL TO ORDER:
Mayor Merritt called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, October 20, 1981, in the Council
Chamber of the City Hall.
2. The invocation was given by Reverend Mike Brown, Bethlehem Lutheran
Church, 5319 N. Halifax Road.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. ROLL CALL:
Present: Councilmen - Atkins, Dennis, Gillanders, Tyrell, Merritt
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Planning Director Shaw, Parks
and Recreation Director Kobett, Captain John Butler,
Sheriff's Department, Roy Buchan, Regional Engineer,
and Julie Estrada, Temple City Times
5. CONSENT CALENDAR:
On motion by Councilman Atkins, seconded by Councilman Tyrell,
the Consent Calendar, Items A through G, were approved as recommended.
A. APPROVAL OF MINUTES: Regular Meeting of October 6, 1981
Approved as written.
B. RECOMMENDATIONS FROM TRAFFIC COMMISSION: Meeting of October 7, 1981
(1) TRAFFIC COMMISSION PRIORITIES FOR SIDEWALK PROGRAM
Adopted Master Sidewalk Construction Program developed by the
Traffic Commission as set forth in staff memo dated October 8,
1981, and on file in the City Clerk's office.
(2) LONGDEN AVENUE WESTERLY OF PRIMROSE AVENUE - TIME LIMIT
REGULATIONS
Approved recommendation to place three 2 -hour time limit signs
on Longden Avenue in front of the Temple City Unified School
District offices.
C. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of
October 13, 1981
(1) PROPOSED AMENDMENT TO TEMPLE CITY ZONING CODE TO ALLOW RETAIL
SALES OF PORTABLE, SELF- CONTAINED SPAS AS A PERMITTED USE
IN THE C -1 ZONE
Set public hearing November 3, 1981 to consider Planning Com-
mission recommendation.
(2) PLANNING COMMISSION ACTION:
Received and filed memo relating to action taken by the Planning
Commission at their regular meeting of October 13, 1981.

D. APPROVAL OF FINAL MAP: TRACT NO. 36739, 9547 -53 GARIBALDI AVENUE
Accepted the map and instructed the City Clerk to endorse Council's
approval. on the face of the map.
E. ORDINANCE NO. 81 -511: 2nd read. AMENDING TEMPLE CITY ZONING CODE
SECTION 9119(L)(9) RELATING TO THE DETERMINATION OF FRONT YARDS
Waived further reading and adopted Ordinance No. 81 -511 AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING AN AMENDMENT
TO THE ZONING CODE RELATING TO THE DETERMINATION OF FRONT YARDS AND
FRONT YARD SETBACKS.
F. CITY CLERK'S ELECTION LAW SEMINAR - NOVEMBER 18 -20, 1981
Approved the Chief Deputy City Clerk to attend the City Clerk's
Election Law Seminar to be held in Newport Beach, November 18 -20, 1981
and authorize necessary expenses.
G. RESOLUTION NO. 81 -2023: WARRANTS AND DEMANDS
Adopted Resolution No. 81 -2023 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$167,874.96, DEMAND NOS. 2700 THRU 2806.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: ADOPTION OF 1981 LOS ANGELES COUNTY BUILDING
CODES - 2nd read. ORDINANCE NO. 81 -512 - BUILDING CODE
ORDINANCE NO. 81 -513 - PLUMBING CODE
ORDINANCE NO. 81 -514 - MECHANICAL CODE
ORDINANCE NO. 81 -515 - ELECTRICAL CODE
City Manager Koski presented background information stating the
City Council, at their regular meeting held October 6, 1981, intro-
duced Ordinances No. 81 -512, 513, 514, and 515 for first reading
adopting the 1981 County Building Codes and a revised fee schedule
for the City. The building code picks up those provisions adopted
earlier exempting the property owner repairing or re- roofing his
own roof obtaining a permit, and the operation of a security lock
from the inside either without or with the use of a key.
Mayor Merritt declared the public hearing open and invited anyone
wishing to speak to come forward. There being no one come forward
to speak, Councilman. Dennis moved to close public hearing, seconded
by Councilman Gillanders and carried.
On question by City Attorney Martin, Roy Buchan stated his name and
his position as being Engineer with the County of Los Angeles, and
answered in the affirmative that he is responsible for the admini-
stration of the City building laws, that he is thoroughly familiar
with the amendment to the model codes, and that these amendments
are necessary due to the local conditions.
Councilman Atkins moved to waive further reading of the ordinances,
seconded by Councilman Tyrell and carried.
Councilman Atkins moved to adopt Ordinance No. 81 -512 AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 7100
OF THE TEMPLE CITY MUNICIPAL CODE BY ADOPTING BY REFERENCE THIS LOS.

LOS ANGELES COUNTY BUILDING NEWS, Ordinance No. 81 -513 AN ORDINANC
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 74
OF THE TEMPLE CITY MUNICIPAL CODE BY ADOPTING BY REFERENCE THE LOS
ANGELES COUNTY PLUMBING CODE AS CONTAINED IN THE 1981 EDITION OF THE
LOS ANGELES COUNTY BUILDING LAWS, Ordinance No. 81 -514 AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 7200
OF THE TEMPLE CITY MUNICIPAL CODE BY•ADOPTING BY REFERENCE THE LOS
ANGELES COUNTY MECHANICAL CODE AS CONTAINED IN THE 1981 EDITION OF
THE LOS ANGELES COUNTY BUILDING LAWS, and Ordinance No. 81 -515 AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING
SECTION 7300 OF THE TEMPLE CITY MUNICIPAL CODE PROVIDING FOR
ELECTRICAL. PERMIT FEES, all by title only, seconded by Councilman
Cil.landyrs and carried, Councilman Tyrell noting his objection.

B. PARTICIPATION IN COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
City Manager Koski presented background information stating the
County of Los Angeles Department of Community Development has
invited the City of Temple City to participate with the County
in the Federal Community Development Block Grant Program for a
three -year period commencing July 1, 1982. The County has
indicated that if Temple City participates in the CDBG Program
the estimated annual share of the grant would be some $235,000.
but that the final allocation would be known in January 1982
upon receipt of more precise funding level data from HUD. The
projects are designed to benefit the low and moderate income
citizen, however they can provide substantive value to the com-
munity as a whole. CDBG funds can be used for a wide variety of
projects such as capital improvements, rehabilitation, handyman,
removal of architectural barriers for the handicapped, and senior
citizen facilities.
Councilman Atkins stated he would like to see some of the money
that goes from the residents of Temple City to the federal govern-
ment returned to the City, but he does have some concerns about an
agreement with the County which originated with HUD.
Councilman Dennis questioned the City Attorney what the City's
position would be if the County or HUD decided to enforce some of
the agreement which would be unacceptable to the City, and could
the City buy out of the agreement. The City Attorney responded
that he has never seen HUD force a contract. He stressed that the
City's contract would be with the County and that the risk is slight.
Mayor Merritt stated that the City could use the grant funds and
reiterated that the contract is only for three years.
Councilman Tyrell expressed the concern that the City should only
enter into an agreement with the County for the purpose of building
a community center for all groups, as well as senior citizens.
Councilman Gillanders stated the three years of the contract will
be Reagan years; the County Board of Supervisors is a conservative
body. He did express his opposition to the basic philosophy that
the federal. government takes our money and then gives it back with
strings attached.
Councilman Atkins moved to approve cooperative agreement with the
County of Los Angeles to participate in the Community Development
Block Grant on behalf of a community center and appoint the City
Council the governing body, seconded by Councilman Tyrell and
carried, Councilman Gillanders noting his objection.
7. NEW BUSINESS:
None.
8. COMMUNICATIONS:
A. Claim for Damages: Scott Wilkins
City Manager Koski presented claim on behalf of Scott Wilkins for
damages alleged to have occurred July 19, 1981. Councilman Tyrell
moved to deny and refer to JPIA, seconded by Councilman Atkins and
carried.
B. Claim for Damages: Douglas Goodman
City Manager Koski presented claim by Douglas Goodman for damages
alleged to have occurred August 27, 1981. Councilman Tyrell moved
to deny and refer to JPIA, seconded by Councilman Atkins and carried.

RECESS TO CRA:
At this time, Council recessed to meet as the Community Redevelopment
Agency, all members being present, and approved the minutes of the
regular meeting held October 5, 1981. Minutes are set forth in full
in the records of the Agency.
RECONVENE AS CITY COUNCIL:
10. ACTION ON REQUEST BY CRA:
None.
11. MATTERS FROM CITY OFFICIALS:
A. Captain John Butler of the Sheriff's Station introduced Lt.
Bill Mangan, assigned as Watch Commander. Lt. Jeanne Robertson
will be Detective Bureau Lieutenant.
B. Councilman Gillanders stated he has attended a meeting of the
Select Committee on Southern California Transporation problems
on October 15. They have the opportunity to visit transit systems
in New Zealand, Australia and other countries.
C. Councilman Dennis stated that some members of the Council
objected to the City's participation in attending the League of
California Cities conference and he wanted to state the conference
was a very good one. Also that City Attorney Martin has been
selected as the City Attorney Department's representative to the
Board of Directors.
12. ADJOURNMENT:
On motion by Councilman Atkins, seconded by Councilman Tyrell,
meeting adjourned at 8:00 p.m. Next regular meeting of the City
Council will be held Tuesday, November 3, 1981, 7:30 p.m. in the
Council Chamber of the City Hall.
