WHEREAS, pursuant to N.J.S.A. 40A:ll-5(1)(a) professional services are
exempt from the requirements of counpetitive bidding; and
WHEREAS, the local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough
of Carteret does hereby approve the appointment of Kill~m and
Associates at a maximum cost of not to exceed ~%iL~]QQ~D0__
~iii'~le per attached contract.
BE IT FURTH~ RESOLVED, that the Mayor and Municipal Clerk are hereby
authorized to execute said contract.
IT IS FURTH~{ RESOLVED, that the contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:ll-5(1)(a) due to the specialized
and professional nature of the services provided.

As per Resolution Number 00-181.
THE CONTRACTOR does hereby agree to perform the following
PROFESSIONAL SERVICE TO PROVIDE ENGINEERING SERVICE DURING THE
CONSTRUCTION OF THE CARTERET PARK COURT IMPROVEMENTS,
INCLUDING BID SOLICIATATION, SHOP DRAWING REVIEW CONTRACT
ADMINISTRATION AND FIELD INSPECTION.
THE INDEMNIFICATION AGREEMENT ON
THE REVERSE OF THE PURCHASE
NOT TO EXCEED $ll,000.00 ORDER SHALL BE LIMITED TO THE
VENIDOR'S NEGLIGENT OR WRONGFUL
ACTS.
According to the terms set forth in Resolution.
TItE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
