A RESOLUTION OF THE CITY CO~C7NCTL. OF THE
CITY OF LYNWOOD DENYING A CONDITIONAL
USE PERMIT FOR SAM MEN LO TO OPERATE A
RESIDENTIAL CARE FACILITY FOR THE ELDERLY
AT 4217 C.AR'LIN AVENUE ON .~ PORTION OF LOT 2,
J. J. BULLIS TRACT IN AN R-3 ZONE.
WHEREAS, the City of Lynwood .has received an application for
a Conditional Use' Permit from Sam .Menlo to operate a residential care
facilit~,r. far the elderly at 4z 71 Carlin A venue on a portion of Lot 2, J. ~. Bu~llis
Tract, and
WHEREAS,. the Planning .Commission of the City of Lyngvood,. after
giving notice thereof as required by law, .has .held and conducted a Public Hearing
concerning .said application and, based upon the evidence presented t.he.reat, .has
adopted its Resolution~No. 669 denying said Conditional Use Permit, and

.WHEREAS, said City Council, after providing notice thereof as
required by law, .has .held and conducted a Pub'1ic Iiearirig to consider said appeal
and has heard and considered al.l pertinent evidence presented thereat,
NOW, THEREFORE, HE IT RESOLVED that the City Council of the '
City of Lynwood .hereby does find, ,determine, ae-rd order as follows:
Section 1.
That the proposed location of the Conditional Use is ~
not i~n accord with the objectives of Lynwood .Zoning.Ordinance 570 and the purpose
of the zone in which the site ~is 'located, in that the proposed use .has been determined
to be a commercial use by the City of. Lynwood.
Section 2, That the facility wil'1 adversely impact the residential
character of the- g orhood.
Section 3. That the use as px°oposed by the applicant is inconsistent
withh surrounding :land uses,
Section 4, That the proposed location.of the Conditional Use and the
condition under wlilch it would be operated or maintained will be detrimental to
the public ,health, safety, or welfare, or materially injurious to properties or
improvements in the vicinity.
Section 5. On the basis of the evidence presented to it, ,the City
Counci'1 cannot make the affirmative findings required by the •Lynwood Zoning
Oreiinance in order to grant the subject Canditional Use Permito
Section 6. 'The decision of the Planning Cornrrxissian of the City of
L,yewood hereby is uphe'id, .and said application for a•Conditional Use Permit
.het: eby is denied.
