Member Thies introduced the following resolution and moved its
adoption:
CITY OF MEDINA
RESOLUTION NO.93-08
RESOLUTION GRANTING FINAL APPROVAL FOR A LOT
DIVISION TO EMIL AND RITA JUBERT/CITY OF MEDINA
WHEREAS, Emil Joseph Jubert and Rita A. Jubert, Trustees of the Emil Joseph
Jubert Revocable Intervivos Trust dated December 5, 1989 and Rita Adeline Jubert
and Emil Joseph Jubert, Trustees of the Rita Adeline Jubert Revocable Intervivos
Trust dated December 5, 1989 are the fee owners of the following described
property:
That part of the Northwest Quarter of the Northeast Quarter of Section
11, Township 118, Range 23, West of the Fifth Principal Meridian, lying
Southwesterly of the right-of-way of the Minneapolis, St. Paul and
Sault Ste. Marie Railway Company, as now located and established,
according to the United States survey thereof, Hennepin County,
Minnesota
and;
WHEREAS, Emil Jubert and Rita Jubert, as Trustees of the above Trusts, and
the City of Medina ( collectively, Applicants) desire to separate from the above
described property the following property:
The Northwest quarter (NW 1 /4) of the Northeast quarter (NE 1 /4) of
Section Eleven (11) , excepting therefrom the Right of Way of the
Minneapolis , St. Paul and Sault Ste. Marie Railway Company as the same
is now constructed over and across said premises, also the Southwest
quarter (SW 1 /4) of the Southeast quarter (SE 1 /4) of Section Two (2) ,
all in Township One Hundred Eighteen (118) , Range Twenty -Three
(23) , subject to Easements of any nature, and except roads.
( Subject Property) ; and
WHEREAS, the City of Medina wishes to purchase the Subject Property from
the Juberts in order to construct its trunk sanitary sewer line across said property;
and

WHEREAS, the proposed lot division was reviewed by the planning commission
on February 9, 1993 and by the city council on March 2, 1993.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina that the Subject Property is divided from the remainder and shall henceforth
constitute a separate parcel.

The motion for the adoption of the foregoing resolution was duly seconded by member
Mayor Theis
and upon vote being taken thereon, the following voted in favor thereof :
Councilmembers Ferris, Johnson, Thies, Zietlow and Mayor Theis.
and the following voted against same: None.
Whereupon said resolution was declared duly passed and adopted .
